No Criminal Charges For Garbage Truck Driver Who Struck And Killed Cyclist

BOSTON (CBS) – The driver of a garbage truck that struck and killed a Chelsea cyclist in Charlestown in April will not face criminal charges, the Suffolk District Attorney's office reported.

Prosecutors say they are disappointed a Suffolk County grand jury voted not to indict Ricky Prezioso of Swampscott for motor vehicle homicide and leaving the scene of an accident causing death in the April 3 death of 34-year-old Owen McGrory of Chelsea.

McGrory was struck and killed by the garbage truck as he rode his bicycle on Cambridge Street in Charlestown near Sullivan Square.

At the time of Prezioso's arraignment, officials said he told police he thought he struck a pothole and after checking his truck farther down the street he continued on his route. His lawyer said the cyclist initiated the contact.

"We wouldn't have pursued these charges if we didn't believe the evidence supported them," said Jake Wark, spokesman for the district attorney's office.  "We're disappointed, but we've already begun the process of opening our investigative file to the McGrory family's civil attorney."
