Jury Sides With Frederick County In Music Festival Dispute

BALTIMORE (AP) -- A federal jury has decided in favor of Frederick County officials in a lawsuit over a botched 2009 music festival.

The Frederick News-Post reports the jury was considering whether concert promoter Dale Ihnken's constitutional rights were violated when the festival was shut down. Ihnken sought $7.5 million for lost income, damages and attorney's fees.

The Summer Solstice Projekt was to be held in Myersville in June 2009. On the second day, county officials closed the festival after investigating noise complaints.

Last year, a federal judge dismissed claims against several officials. A jury was seated Monday to consider the only remaining issue. That was whether Sheriff Chuck Jenkins or county zoning administrator Larry Smith violated Ihnken's due process rights by closing the festival. The jury decided their actions were justified.
