College Student Guilty Of Sex Offense With Drunken Victim

FREDERICK, Md. (AP) -- A former Mount St. Mary's University student has pleaded guilty to a third-degree sex offense involving a drunken female student who police say was unaware of the incident until his roommates reported their suspicions to authorities.

Twenty-year-old Evan Haggarty of Honesdale, Pennsylvania, avoided trial on a second-degree rape charge by striking the plea deal Wednesday in Frederick County Circuit Court.

Sentencing is set for May 24. Prosecutors agreed to a suspended sentence and probation. The maximum penalty is 10 years in prison.

Haggarty told police the woman initiated consensual intercourse in November 2014. Police say his two roommates gave evidence of the encounter to their dormitory resident adviser after Haggarty told them he hadn't had sex with the woman.

Defense attorney Paul Kemp says no force was involved.
