The 50-year-old Lohan was arraigned Tuesday morning in Nassau County First District Court in Hempstead. During the brief court appearance, a judge suspended her driver's license before releasing her without bail.

"You may not drive, do you understand?" the judge asked Lohan, who nodded in response, CBS New York's radio affiliate 1010 WINS reported.

Lohan was driving a white BMW on the Northern State Parkway in Oyster Bay around 11 p.m. Sept. 12 when she was pulled over for going 77 mph in a 55 mph zone, police said.

A breathalyzer test revealed Lohan had a blood alcohol concentration of .20%, more than twice the legal limit of .08, police said. She was arrested on a charge of DWI and aggravated DWI, the station reported. She was also reportedly issued tickets for DWI and speeding.

Lohan's attorney, Mark Heller, told reporters that his client has been a victim of what he called a "challenging trilogy."

"Family substance abuse and domestic violence, financial crises bordering on bankruptcy and foreclosure and raising a family in a fatherless home when the father is in prison," Heller said, according to the station.

He said he hopes the judge is merciful and spares Lohan from having to spend any time in a jail cell, the station reports.

Heller then escorted his client to a chauffeured silver Rolls-Royce.

Lindsay Lohan, 27, has been plagued by legal and substance abuse problems. She completed her latest court-ordered stay in rehab in July.

In an interview with Oprah Winfrey that aired in August, the younger Lohan acknowledged an addiction to alcohol, which "in the past was a gateway to other things for me." She went on to say she's "in a different head space" and vowed to stay "present and clear-headed and focused."
