Lawmakers Urge Governor To Appeal Prop 8 Ruling

(AP)  A group of Republican lawmakers is urging California Gov. Arnold Schwarzenegger to appeal a federal ruling that struck down the state's same-sex marriage ban.

Twenty-seven members of the Assembly's Republican caucus sent Schwarzenegger a letter Tuesday saying it was up to the governor to defend the rights of voters who passed Proposition 8 almost two years ago.

Chief U.S. District Judge Vaughn Walker overturned the voter-approved measure as unconstitutional last month. The state has until Sept. 11 to challenge Walker's ruling in the 9th U.S. Circuit Court of Appeals.

Schwarzenegger and Attorney General Jerry Brown, who both refused to support Proposition 8 in Walker's court, have said they do not plan to appeal the ruling.

The coalition that sponsored the ban is appealing the ruling.

The California Republicans that are pushing this sure as hell are not representing Californians -- who now (that the bogus "yes is no, no is yes" ballot language has been exposed) support repealing Prop 8 and allowing EQUAL RIGHTSA in the state.

They also must either dismiss or completely misread the US Constitution. A vote is not above the right to vote -- which was given by this document. Rights supercede votes. Period.

Three branches of government (again that pesky Constitution) assure this fact.

When is the GOP going to admit, that they cannot ostracize tens of thousands of people, over their religious views?????? That's one of the major problems with the GOP, as a political party. Religion has NO PLACE in government.

It amazes me as to how willing conservative Republicans are to trash our nations constitution when it comes to others rights they do not agree with. This is just one example.

We have conservative Republicans wanting to stiffle our FIRST amendment right to freedom of religion.

We have conservative Republicans who want to trash the FOURTEENTH amendment to American citizenship.

We have conservative Republicans who want to trash the NINTH amendment when it comes to a womans right to choice.

I will continue to fight to protect our nations constitution against all those who want to change it to their own liking and not for ALL Americans.

If you get the "comment posted shortly" message in a REPLY field, hit the X next to it, then go back to "submit"... keep hitting it until it says "thank you. view comment".

Your comment will appear (at least 95% of the time) -- but it might take a while.

Too bad this doesn't work on an initial comment. Typing a thoughtful commentary and having it disapepear is frustrating.


Anyway, I agree they need to fix the cache problems.

You can take 100 civics classes, but that doesn't stop today's government from giving the Constitution a polite nod, then go ahead and do whatever they please.

I wish that Civics was once again a required class for all students as it was back in my parents' day.

The "Greatest Generation" understood that the Constitution couldn't be undermined or circumvented simply due to popular vote.

Good morning, Democracy. I agree. This is the reason the mosque near Ground Zero can be built. It may be unpopular, but it is absolutely Constitutional. Thank God and the Founding Fathers for the Constitution.

ya really ..this government is a real joke...a real bad joke...it's too bad ..."we the people"...can't all quit our jobs and let this government run and cry to the rich moguls they conspire with to rob us of everything for the revenues...they would soon get bitten by their partners in crime..!..and become a government without a country.

The government has become the defender of our nations constitution. The government will do what our nations constitution requires of us to do and not what any group of citizens want.
