NYC Says FDNY Test Not Discriminatory

(CBS)  The fire department in New York is one of the most respected in the world and the second largest after Tokyo's.

The FDNY has well over 11,000 firefighters and officers and their heroism on Sept. 11 and many other occasions is legendary. But a federal judge says something is missing in their ranks. Diversity.

A federal judge says New York City is resisting efforts to correct longstanding discrimination in its hiring practices of the FDNY. For many, the letters FDNY spell heroism. The judge says not when it comes to racial relations.

New York City fire captain Paul Washington has a big problem with his department.

"This fire department has been all white, lily white, for almost 150 years now," he said. "It has to end."

Eight years ago the fire department was 92 percent white and only 2.8 percent black in a city that was 24 percent black, a disparity that remains largely unchanged, reports CBS News correspondent Jim Axelrod. A group of black firefighters sued.

"We're in a tough situation because the fire department on one hand is tremendously heroic and the whole world knows about its heroism. And on the other hand we have this singular embarrassment," said Suzanna Goldberg from Columbia Law School.

Last January a federal judge agreed, ruling the hiring test to become one of New York's bravest was not just discriminatory but illegal. He ordered the city to fix it.

"Blacks don't fare as well as whites on this test, probably due to the disparity of education," said Washington.

Now the judge says the city "has been dragging its feet" and he tightened the screws, appointing a special master to ensure New York does what big cities such as Los Angeles, Philadelphia, Boston and Miami did long ago when they were sued.

They now have much greater diversity. But FDNY deputy chief Paul Mannix doesn't think New York needs to follow their example.

When asked about how Philadelphia, Los Angeles and Boston corrected their racial imbalances, Mannix had a one word answer: "Quotas," he said.

When told that whatever the method is, it worked, he said, "By using quotas. And we are against quotas."

Miami in particular expanded recruitment by targeting young minorities still in public schools with high school EMT training classes. Today they have firefighters like Maurice Kemp to show for it. That's Chief Maurice Kemp, the department's first African-American in charge.

Kemp said, "Like all other major city departments, it doesn't come without a struggle. I mean, we have to be conscious of the fact that we need to be diverse."

Mannix thinks the current FDNY test focuses too much on producing a racially diverse department and not enough on identifying the strongest candidates regardless of race.

"You're asking me to make my job more dangerous to satisfy a social engineering experiment," said Mannix.

Mannix doesn't officially speak for the city but the fire department and the mayor both declined our request for an interview. In a statement, the city said, "The city disagrees with the court's findings that these tests were discriminatory and intends to appeal."

The city says next time it hires, the incoming class will be one-third minority but no firefighters have been hired in the last two years and currently there are no plans to do so.

"I find it shocking the fire department looks like it does today and the city is fighting the decision and threatening appeal rather than going ahead and giving the city the department it deserves," said Goldberg.

"I want to see black New Yorkers share in this job because, like I say, it's not a good job. It's a great job," said Washington.

The only thing Paul Washington wants to change about this "great" job is the way New York City decides who gets it.

The Test is tough? Is it hard? Too bad poor you if you can't pass it. Weakling. Study and try again. It' about reading comprehension, memory and logic, and physical fitness. Let's hire Firefighters based on color instead of mental ability and fitness. That's a good idea. Let's hire doctors based on their sex appeal. Accountants by the height of their standing leap.

Judge Garrufis say's Firefighters don't need logic and reasoning to do their job. Well he is doing his job without logic and reasoning. So maybe he is right? Wrong without logic, reason, memory and fitness you would see more dead Firefighters and less incredible rescues. It's a think on your feet job. Don't weaken the test. Find smarter people who want the job.
While we are at it why don't we do this with the NBA. Why not make the NBA hire more Italian-Americans? Have pizzerias hire more French Jews.

Tea baggers are not a "re-branding" of the KKK. The KKK does not allow minorities into their hate group. There are many members of the Tea Baggers who are black, who have spoken out against liberals and the NAACP:

So it Appears that one has to look no further than the demographic of those fighting these changes for your answers. Let me see...."The KKK," The Republican Party," "Fox News," "Tea Baggers," NYCFD???? Has any one looked at the ethnic demographic of that 92%? Some interesting questions should surface from those numbers as well. Chivalry is the word I find synonymous with heroics, not entitlement. Either you live your "entire" as a hero, or you are a hypochrite. Which is it NYCFD?

You were talking about the FDNY?
Its not a news channel, not a political party if it were it would be democrats the union endorsed William Thompson and John Liu in the last election.

KKK? The FDNY puts out fires, responds to water leaks gas leaks and medical emergencies to name a few. The FDNY does not have lynch mobs, burn crosses and bomb churches.

That comment should embarrass you.

Entitlement is something you get by rights, law or court action. The test for Firefighter is open competitive. That means there are NO entitlements you are hired based on your score. Paul Washington's lawsuit' purpose is to give entitlements based on race. No one has said that the predominately white FDNY is entitled. No it's the opposite. They say the test is too hard for minorities to compete. Paul Washinghton wants to make it an entitlement to some. So if you are a little kid who wants to be a firefighter no reason to work out, study hard, got school and complete two years of college. Just check a box and get a job. You will be working alongside men and women who took the test and got hired based on scores but you will be hired because of your race.

Sound like a good idea?

Give it up. Sounds as if the court is really saying that it wants half of the department to be black and one quarter Latino. It does not matter what the people of New York think nor how well the job gets done.

Not sure what the test questions or the poem are for but apparently you're trying to prove your intelligence to someone...take it somewhere else, this is a discussion forum . I cordially accept your invitation to explain how a person of color can go to school easier and cheaper than I...by checking the box that is anything other than "white". By doing so, you are considered a "minority" which is a real scream because if an accurate census was done then we would see that the white male is now the minority (although we won't get that title for real until 2040, which is 10 years sooner than expected - but get ready, it's coming). The race card will stay intact as long as there are groups such as the NAACP that keep racism alive, or special privileges are allowed such as having an exclusive BET network. Racism may stand a chance of ending when there is an NAAWP or a WET network. Need I remind you of the "United Negro College Fund...A mind is a terrible thing to waste". Would it be acceptable for me to start a "United White College Fund"? No, we couldn't have that now, could we?

Katie, Did you get your job by diversity or via hardwork ? Did Ed Bradley get his position on 60 minuets because he was black or good at what he did.? The answer to these questions are the same many, many Firefighters are appointed.

What a hatchet job on condemning FDNY, I really thought you were coming around to mainstream, but I see you keep your liberal unfair views. In this piece you had several points from 3 people with the same opinion, 3 against one slanted story.. Katie their have been many FF and senior leader who were and still are black ( great ones) They did it the hard way..... like all fire personal. So please give the whole story.

Have you or Goldberg checked the diversity of the Transit or the Correction Department give me a break... try being fair in reporting. By the way Black Firefighter at the WTC also. You and your guest (Goldberg) consider it wrong for FD to appeal.... helllo its our right..
