Saggy Pants Foolish But Legal, NYC Judge Rules

(AP)  Wearing saggy pants is not a crime, just foolish.

That's how a New York City judge ruled in throwing out a summons issued to a man wearing low-slung pants that exposed his underwear.

Judge Ruben Franco said that the summons appeared to be an attempt by one police officer to show his displeasure with the style.

The Bronx man, Julio Martinez, was issued the ticket on April 20.

The judge writes that many may find the low-slung trouser trend distasteful and foolish. But he says people can dress how they want as long as they do not offend public order and decency.

Franco's decision was issued last month. Martinez and his Legal Aid attorney could not be reached for comment.

The style is prison-wear, where prisoners aren't allowed belts and shoelaces....It became gang wear as the younger family members grew up in the atmosphere of crime....only to be emulated by rebelous youth who know not about its roots other than it's "cool" to wear...I cant help but laugh when I see people, usually unmature youth and foolish adults some gangsters walk by me as they look more like penguins as the warden's view of the prison quad makes the multitude of prisoners look like.

Last week while walking my dog, I was confronted by a young man with no shirt and baggy pants. At least 6 inches of pubic hair were visible. I confronted him and while he was polite and told me that it was a public street, he refused to pull up his pants. I am a 63 year old grandmother and I was very offended by this site. In fact, I was disgusted. Where does this end and how can we put a stop to it???

Pay a strong runner to rush him from behind and pull his pants and drawers down to his knees in a public place, then slap his behind hard and push him over, he'll get the message.

females wear low slung trousers, shorts, whatever, to the point of exposing their underwear including thongs and no one seems to complain about them.

Can we at least make it legal to use them as self closing portable trash cans?
There are times when I can only get half way through a milkshake & I get full. It sure would be convenient to just pull back the elastic band & drop that cup down there.
