Synthetic Marijuana Gives Users Legal High

(CBS)  Across the country, demand for a synthetic form of marijuana is soaring. Unlike the real thing, this drug - called spice or K2 - is legal in most states. Now, a handful of lawmakers are taking action. This week Missouri became the sixth state to ban the use of K2.

It's a designer drug fad fueled online, CBS News Correspondent Seth Doane reports. Brian Siegal first heard about it from friends and then saw it on the Internet.

"The word gets out so quickly and just spreads like wildfire," Siegel said.

It has names like spice and genie but is mostly known as K2, providing a high likened to marijuana. If you have not heard of it yet, staffers at places such as the Georgia Poison Center sure have, fielding more than 50 calls about K2 in the last two months.

"We started seeing a mushrooming of calls," Dr. Gaylor Lopez, director of the Georgia Poison Center, said.

Nationwide, more than 500 people have phoned poison centers about the drug already this year, up from just 12 calls last year.

The synthetic marijuana is packaged in brightly colored bags and may only look harmless.

"This is incredibly dangerous," Lopez said.

K2 can be up to 15 times more powerful than marijuana and lead to a disturbing range of symptoms, Lopez said.

"We've seen people with slight tremors to even seizure activity," Lopez said.

Still, K2 is legal in 44 states and easy to get anywhere. The six states banning the drug are Alabama, Georgia, Kansas, Kentucky, Louisiana and Missouri. Illinois, Michigan, New Jersey and New York are considering bans.

"You can order it online, and you can get it in magazines," said Siegel. "Very easy to get."

It's not detected by drug-tests either.

"It's like a dream come true for an addict," Jason Schmider, a K2 drug user, said.

Schmider tried the drug more than 50 times until he wound up in the hospital, he said.

"That was the final straw," he said.

Then, he found himself at drug treatment center called Phoenix House outside New York City.

Meanwhile, the Drug Enforcement Administration is trying to learn what's in the drug itself. CBS News was granted rare access at a special testing facility near Washington, D.C.

'They'll market it as incense, or bath salts," DEA Special Agent Gary Boggs said.

Tests are part of deciding whether spice and K2 should be a controlled substance, Boggs said.

"The fact that they're legal really is almost irrelevant," said Boggs. "People are just basically playing Russian roulette with these every time they take them."

That's a gamble that means months of rehab for Schmider.

"It was like the scariest moment of my life," said Schmider. "It's not worth it."

That's a warning drowned out by the quickly spreading reputation of a powerful high that's legal, easy to get and hard to detect.

i myself smoke K2. i use it as a substitute for marijuana. i know that it is not healthy for you, but u can tell you get addicted to it... my opinion is if they make this stuff illegal, then they should legalize pot. how many deaths have u heard of relatin' to smokin weed? compared to smokin K2. i think they should make laws wit legalizin marijuana. such as no smokin and drivin, not bein able to smoke marijuana in public areas, and make it illegal to sell it on the streets. our country wouldnt be in debt if they sold marijuana in stores. they could tax the hell out of it and make so much money. anyways that is my opinion about makin K2 illegal, but one person is not gonna change the mind of the nys legislature.

My husband is currently incarcerated at the CRC in Orient, Ohio. He was arrested in Sept. 2010 for 5 Counts of B & E and 1 count of Possession of Criminal Tools.
His co-defendant, who actually committed the crime was the ONLY one to actually have possession of any Criminal Tools, sat in jail for three monthsdue to inability to bond out, then was sentenced by Judge Marcelain to time served and was let out on community control and LAPP.
My husband bonded out right away, and even though he is considered innocent until proven guilty, he was ordered to Pre-Sentence Reporting, which included drug testing and reporting, etc.
My husband missed an appointment with LAPP, which he rescheduled, and we never received a letter of an appointment for a LMCBCF Assessment.
At my husbands Change of Plea Hearing the bailiff kept him waiting outside the courtroom.Because of this he was considered late and "missed the hearing "even though he was there at 8 am as was directed.
Judge Marcelain revoked his bond due to the " tardiness and missing the appointments".
He bonded out again after another court bond hearing.
He was on pre sentence reporting again.
During this time he received a "driving on suspended license" ticket. The probation officer did nothing.
He was charged with driving on suspended a second time, but plead not guilty. He reported to his probation officer the following week as scheduled, and reported the ticket at that time.
His bond was revoked by the Probation Officer and he was arrested again and sent to county jail.
That was on a Thursday, and his Change of Plea hearing was on the following Monday.
He was sentanced by Judge Marcelain to three years in prison that was suspended, and three years community control. He was also sentenced to the CBCF in Nelsonville, Ohio for 150 Days, although he was accepted for the LAPP program that his co-defendant was sentanced to.
Additionally, the Probation Department informed the court that my husband had LIED on his assessment when he told the assessor that he had court pending for child support in Allen County, stating to the Judge that there was in fact no hearing scheduled. This was not true. Currently my husband has a holder bond on him out of Allen County for a child support hearing that was missed. The court hearing in Allen County was scheduled for the day after his probation officer revoked his bond, that Friday. This information was used in part against my husband for considertion during sentancing. The same probation officer told me personally that my husband had MANY dirty Urines, when in fact, he had only ONE and it was the very first test he was given while on Pre Sentence Reporting, and it was dirty for K2, a substance at that time that was NOT illegal.
My husband entered the SEPTA program and was scheduled to complete the program and be released on September 21th 2011.
With 43 days left in the program as of August 26th, 2011, he was discharged from Septa and sent back to Licking County Justice Center for failing a Urine Screen... he was positive for "K2".

My husband was a PREVIOUS pot smoker who turned to K2 so that he would not be doing illegal drugs.
During his stay at SEPTA, he NEVER had a dirty UA until the incident in August. The only reason he was "dirty" was because he bummed a smoke from another resident and the "rerolled cigarette" was laced with K2, unknown to my husband.
My husband never had even a single violation or reprimand on his record while at SEPTA, and my husband never ever violated his probation, until the dirty urine test.
My husband went before JUDGE MARCELAIN (his original Judge) for the probation violation of being dirty for K2, and was sentenced to his entire three years previously sentenced.
NO second chance, no drug programs, no other options... straight to prison.
Then Judge Marcelain denied my husband from going to the "Boot Camp" program in Lancaster.
He was told that anyone who is sentenced over 1 year is automatically denied to any IPP program if their judge is Marcelain, but yet two other CURRENT inmates who had Judge Branstool, another licking county judge, were sentenced 4+ years prison time but allowed to enter the IPP boot camp program in Lancaster, Ohio, that lasts only 3 months, with up to one year PRC to follow.
My husbands ONLY option left is to file for a Judicial Release, which will be decided upon by, big surprise and drum roll please... you guessed it: Judge Marcelain. What do YOU think the answer will be?

• K2 was not illegal to smoke or consume until October 1st 2011, and it was not even Illegal to sell until September 2011, as far as I know.
• Inmated with worse crimes and longer prison sentances are getting second chances at other programs even after failing a first one, and my husband, a non violent offender who had only one PV is getting three years in prison. His co-defendant who did the actual crime (my husband was only present but not a participant) served THREE months of time served and probation.
• SEPTA is somewhat a treatment setting, but inmates had access to K2, apparently, but no one who ever got caught with it was kicked out of the program. In fact, many times there were infractions that occurred concerning possession with other inmates, and dirty urine's of other inmates of SEPTA, and they only received an extra 30 days in the program, while my husband got kicked out and sent to prison.
• While my husband was awaiting court at the Licking County Justice Center he had the opportunity to speak with other inmates, and many with the same circumstances, failing urine tests while in a treatment program like SEPTA or Spencer House, were sent to another treatment type facility, NOT given prison time.
• With no previous vilations, My husband was sentanced to 3 years, his entire time. Not half, not a percentage, nothing.
• My husband was denied a program that has no sentence limitations on it, because of a particular Judge.

Is there anything that can be done to get my husband released, retried, seen before another Judge, appeal, ANYTHING... ? Can we sue the Judge for "picking on him" or having a vendetta against him? Is it considered discrimination or something since he is not being treated fairly and the same as other persons? I have so many questions, but I am disabled with three teenagers at home and trying to make it on $483 a month and foodstamps while fighting for disability. Knowing that I would be forced to live off of the system and that I needed my husband to help support us and to run our family business that is now closed down due ot his incarceration, the judge still chose to not allow him to be out on house arrest or a work release program or anything that might help keep us from living on the State Assistance. I DO NOT have money to be able to pay an attorney, but if you could give me any help or advice on what I may or may not be able to do, or if you know any lawyers doing pro bono work, please let me know. My next step is to take this to the papers and the news stations to see if they can help me at all.

lol, marijuana is only illegal to protect financial interests and because of blind fear. This is what politicians and the heads of such industries as the tobacco and alocohol company cause by paying and supporting the continuation of the epic failure that is marijuana prohibition. One of the many reasons that I am so disillusioned with our system and the people running. God Bless America, lol.

and I also wanted to add that I'm so glad the politicians and tobacco companies are so concerned about our well-being, he said with heavy sarcasm. They only care about their financial health. I'm not going to ever stop smoking marijuana because they say I can't.

Yeah i wish the politicians would stop acting like they care and legalize it all what is a the definition of freedom is the freedom to make choices plus i rather have the goverment put the age limit on all drugs instead of my teenager who can go to detroit and buy anything he wants there's dope everywhere how come I could find and the DEA couldn't. Why cause there are corrupt indiviuals in all facets of life. To try to control something that is out of control is insane so let go of control so it can control itself. Remember control the things we can and have the wisdom to know the difference

Of course there should be age restrictions on k2 incense, as with tobacco and alcohol, but these bans are just another knee-jerk reaction by our Government to control what we can and cannot do. They were passing emergency bans and proclaiming danger before they even knew anything at all about it. These guys, http://www.buyk2incense.com claim to have k2 incense products that aren't restricted in any state by any current ban. So as you see, not only are these petty bans exhausting resources we don't have, they are pretty much useless! It's just going to continue to morph and the authorities are going to continue wasting time and money. People will still buy k2 incense. And so on and so on. Same old cycle.

Banning it is a waste of time and money. I mean, these k2 incense bans have been taking place in various states for the past year yet there are still places like, http://www.k2incense.org advertising k2 herb products that aren't prohibited under ANY bans whatsoever.

My wife is a recoveribg addict. I am really proud of the progress she has mede, but we have been through some tough times.

Recently she tried some of this "legal mariguana" crap from the local cigarette and liquor store. She isn't reacting to it like marijuana. It's more like crack.

I don't mean it makes her feel like crack; I mean she will take the bill money or kids's christmas money to buy more. I don't know what's in this stuff but it is very addictive.

Of course, I shouldn't make a big deal out of it. After all, it's legal.

I just wonder what this legal substance is going to put my children through.

I think they act like hypocrite's cause how are you going to make weed illegal and say its a drug, now say they want to make k2 illegal and say its a drug....but its ok to drink alcohol and smoke cigarettes which is a drug also and more people get killed smoking cigarettes and using alcohol.
If you going to be a "DRUG FREE COUNTRY", make everything illegal, make weed, alcohol, and cigarettes illegal, don't half do anything make all of it illegal!!!....Why they won't make alcohol and cigarettes illegal? why cause they smoke cigarettes and drink alcohol. So its fair to keep your drug on the market but want to take away others people's means of relaxation...*smh*...its makes no sense, thats being a hypocrite

I most definitely feel there should be age restrictions, as there are, with tobacco and alcohol products, but really, what do they hope to accomplish by banning these chemicals? These guys claim to have k2 incense products that are legal in every single state, http://www.k2incense.net so you see, these bans aren't so effective are they?
