Lindsay Lohan Dad Surprised She Didn't Overdose

Lindsay Lohan reportedly is asking the attorney she's said to have hired, Lohan Tiffany Feder-Cohen, to try to keep her from going to jail, which she's slated to do on July 20.

Her former attorney, Shawn Chapman Holley, resigned Thursday after calling Lohan's 90-day sentence for violating her probation "harsh and unfair."

Legal experts say an appeal of the sentence is unlikely.

Following her jail time, the starlet will enter a rehab center for 90 days.

On "The Early Show" Friday, Lindsay Lohan's father, Michael Lohan, sat down for an exclusive interview.

He said he wishes his daughter would receive rehab help before jail.

He said, "I'm glad the judge did mandate Lindsay to rehab, but it has to be the right program. I just wish she would have given her rehab first and then if she doesn't complete the rehab completely and sufficiently, then -- then give her jail. And I hope those are the grounds for the appeal, as well."

Michael Lohan and his attorney, CBS News Legal Analyst Lisa Bloom, wrote a letter to the court pleading for rehab, rather than jail time.

But Michael Lohan said the gesture has received some backlash from his ex-wife and daughter.

"I was on great speaking terms with my ex-wife (Dina) and daughter, but someone gave Dina and Ali and Lindsay the letter we gave to the judge, asking to matter what, they put Lindsay in rehab. They said, 'We don't need rehab,' and they're mad at me because I sent the letter."

Lindsay's sentence, Michael Lohan said, "blindsided" the whole family.

"I was kind of surprised as Lindsay was," he told "Early Show" co-anchor Chris Wragge. "...I think Shawn and Lindsay were under the impression she wasn't going to get that amount of time."

Michael Lohan added that his pleas for help from the court "fell upon deaf ears" prior to the sentencing.

"I think everyone realizes due to the probation report there is a major prescription drug problem," he said. "And I do think that the sentence warrants some kind of investigation or appeal based upon the inconsistency of the program's evidence and the DA's case. At the same time, I think -- I'm glad the judge did mandate Lindsay to rehab, but it has to be the right program."

Lindsay Lohan's probation report lists the star is currently taking five powerful medications, including Adderall, Dilaudid and Zoloft.

Michael Lohan called the combination of drugs "toxic."

"It's surprising that something didn't happen to her already," he said. "It's surprising she didn't overdose or worse."

But Lindsay Lohan's father said he takes some part of the blame for her current state.

"I have to share my part of the responsibility, my accountability," he said. "I'm not going to deny it. I mean, being away from my family because of, you know, the whole ruckus with my brother-in-law and the DWI, did create some part of this downfall. Lindsay was never on a prescription drug. She never had a drink or a cocaine problem until that happened and the divorce (from Dina) ensued."

Michael Lohan hasn't been in contact with Lindsay for some time, but he said in court, he leaned over and told her he loved her and "God bless."

One of the major problems for Lindsay, Michael Lohan said, is that she's not around people who have her best interests at heart and enable her behavior. "It's a shame she doesn't have friends that are true friends around her," he said. "I mean, they're running around documenting it. HollywoodTV is documenting what's going on right now, instead of saying, 'Lindsay, let's get you in a program, let's get you help to show the court before you go to jail that you're taking serious efforts to change your life.' When I did call up and try to get in touch with Dina, she said, 'Listen, the guy from HollywoodTV is handling the situation. So, now it's in someone else's hands."

Wragge added there are reports the family is reportedly pitching a $1 million offer for her out-of-jail story.

Michael Lohan said, "It's ridiculous."

Just goes to show there is some, albeit just a little, justice. This is one crazy twisted drama. Just like hollyweird made it up to be. There is no such thing as bad press. By the time LL gets out of her prison uniform. She will be too old for porn. Hollyland may even have forgotten her and moved on to more brittany like dramas. There are many more up and coming young stars who haven't a clue how to act in a social environment or in front of a camera. Divas only rule the day. Once the day is done, so are they...bye bye to little abused misunderstood LL. They should lock up her mother too.

Don't you worry, Mr. Lohan, she didn't overdose. But I wouldn't give her liver good odds for surviving til she gets old. Oh wait... she's a rich little spoiled kid... she'll be able to get liver transplants til the cows come home... while many other less-rich people will die because they can't afford it.

Is this really news worthy,when there is so much more important news out there?? Where is the story about the NEW Black Panthers harrassing voters at the polls? and the rant against white people and killing babies? Where is the news about Obama sliding through yet another Progressive Liberal Socialist into a position of power over our healthcare? Where is the news about the DOJ's killing the case against the Black Panthers after the case was already in progress? Are you a news channel, or a fluff rag??

Send the brat to jail and let her dry out and think for a bit then give her rehab.

Ya know I get so tried of everyone protecting Lindsay, I have to agree with her father on everything that he is doing. Yes, he is not a great parent, but he is trying to be one now. Like the old saying "better late than never"... Lindsay has cried her way out of rehab and jail, and look where it has gotten her, dud, right back in the same position. I mean come on people she needs this to hopefully straighten her act up. She had it all but is letting drugs and alcohol destroy her. So, once again I agree on the Judge's decision and in hopes that this will help her as well.

Lindsay should be required to go to college for 2 years and pass her courses. After that she might have something inside her head that is worth something and not self destructive.

It matters because we continue to let these types of people get away with murder LITERALY (O.J.). The nwhen a "nobody" goes to court for the same thing and it's not in the public spot light they get maximum sentence. She NEEDS to go to jail and do her time like the rest of society, she is NOT above the law, period!
