BP Execs Could Face Potential Jail Time

As the U.S. government launches criminal and civil investigations into the nation's worst oil spill, executives at BP could face potential jail time if convicted of obstruction of justice and fraud charges, according to CBS News chief legal correspondent Jan Crawford.

"If you lie to the government, you can go to jail - if the government proves you made a knowing, false misstatement," Crawford said Wednesday on CBS' Early Show.

The probe could ultimately expose BP and the two other companies - Halliburton and Transocean - to a multitude of criminal charges. As a result, the companies could be looking at penalties and fines that could well exceed the $100 million Exxon paid to settle criminal charges after the 1989 Valdez oil spill.

Crawford said the charges brought depend on the specific laws that prosecutors are reviewing. Several environmental laws are now under review - the Clean Water Act and Migratory Bird Act, for example.

But it's the other traditional criminal statutes that could land BP and the other companies in real trouble.

"That's where you get some of the more serious criminal penalties, like obstruction of justice, conspiracy, fraud," Crawford said. "If BP, or executives made false statements, and several senators already have accused BP of making false statements, not only in getting the permits to dig that well, but also in kind of underplaying the gravity of the spill."

The charges may also be at the state level, as it was with the Exxon Valdez spill. In that case, Crawford notes, the federal government coordinated its efforts with the state of Alaska. The current oil spill, however, is having a detrimental impact on several states.

"I expect that you'll see similar efforts to coordinate this, similar efforts to consolidate all these investigations and similar efforts to kind of spread out the payment at the end of the day... to the states and the people who are hurt the most," Crawford said.

put a smaller pipe down the existing pipe. use a fiberous balloon to put down beside the smaller pipe.. Attach them first so they go down togeather.
fill the balloon with air.. The hole is plugged and you have a controlled new pipe to get the oil out or plug. the leak is stopped..

Do they not want it to stop. whats up. this is not rocket science.

If any of them ever go to jail, let's not call it a jail. It's more like a camp, rehab center. Hardly punishment. They will welcome and embrace the low key lifestyle.

They won't go to jail, perhaps some hotel, but certainly not a jail setting, sort of like a reprieve from all that hard work of making money at any cost.

For all of you thinking this is B.S., Exxon faced criminal charges as a result of the Valdez spill in 1989. That would have been under H. W. Bush. If they violated the law, the deserve to be charged, and if Exxon faced charges in 1989, I really don't see how BP wouldn't face charges now.

Political theater to pander and quell the chorus of critics of the government for not doing enough, quickly enough over this accident. Nevermind that the government really doesn't know what it's doing. Be that as it may, if laws were broken, then charge them. If not, then a major mea culpa and apology is in order for this grandstanding.

Agreed. Corruption of government agencies, corruption of Corporate America, nothing new there. Sit on your hands and spout that its BP's problem and they have to fix it and pay for it while ignoring 15 countries offer of equipment and experts to help with "clean up" to prevent damage is just plain dumb. President Bush's Katrina was dumb, unfeeling and criminal.

Sure... it's the greatest environmental catastrophe in the history of the oil business. And yes, a large portion of the Gulf of Mexico may well be a dead zone for years to come. There's nothing we can do about those facts... so why not focus on happy news?

There's lots and lots of positive things to put a grin on our faces. For one... There's our patriotic war against the bearded barbarians and the turbaned terrorists. We are still able to keep our wars of occupation in Iraq and Afghanistan fully funded to the tune of $3,000,000,000 a week. Hooaahhh!

Now... $3 billion kinda sounds like a pile of peanuts in these days of an Empire gone mad, But, do you know how much $3 billion really is? If the Pentagoon collected that moola every week in stacks of $100 bills, that weekly shipment to the war front would weigh in at 18 tons! Let's see France or red china or Mexico or any of the other pipsqueaks match that kind of war spending! (God! Makes me swell with pride and puts a tear in my eye.)

I am pleased to see the criminal/civil investigation proceed. The Justice Department can handle this while other agencies focus on stopping the spill. Delaying investigations can harm them a great deal. Evidence disappears, people's memories fade, perpetrators have time to cover their tracks. This is going in the right direction. People and companies should be held accountable.
