Lesbian Teen Speaks Out on Cancelled Prom

The American Civil Liberties Union (ACLU) is seeking a court order to force a Mississippi high school to hold its senior prom. On Wednesday, school officials cancelled the event after a female student asked to bring her girlfriend and wear a tuxedo.

CBS News correspondent Mark Strassmann reports that, in Fulton, Miss., charges of discrimination and violation of a teenager's rights have derailed the prom plans.

Senior Constance McMillen, 18, was ready for the prom. She even had a date. But the problem at Itawamba County Agricultural High School, says Strassmann, was her sophomore -- girlfriend.

McMillen told CBS News, "I just want to go to the prom and bring my date, just like everyone else gets to."

But in Fulton, says Strassmann, the idea of a lesbian prom couple hit a nerve.

The school board said it violated their policy against same-sex couples at the dance.

So McMillen couldn't bring her girlfriend. And she couldn't wear a tuxedo. Lawyers on all sides got involved. he school board cancelled the dance, saying in a statement the decision was "due to the distractions to the educational process caused by recent events."

McMillen said on "The Early Show" that, when she spoke with her school's principal in December about her intentions to bring her girlfriend to the prom, he told her it wasn't allowed. When she asked why, he told her it concerned the tickets for the event.

She said, "He said that something about when the tickets were first started, that it was cheaper for people to come as a date, like just two friends than to come individually, so people would do that and they were just trying to prohibit that."

But McMillen said, "I explained to him that you can't pretend like there's not gay people at our school, and if you tell people they can't bring same-sex date, that is discrimination to them."

McMillen said the feeling at school is "hostile" and "silent" since it was announced the prom has been cancelled.

She said she's been told by classmates that she's ruined their senior year.

"But you'll have people that are going to be like that," she said. "It hurts, but there's nothing I can do about it, but just hope they understand that was never my intention. Now I'm fighting for prom for everybody now."

But McMillen said she doesn't regret asking to go with her girlfriend.

Hill pointed out that McMillen's school hasn't explicitly said they've cancelled the prom because of McMillen's request. But McMillen's lawyer Christine Sun, of the American Civil Liberties Union, thinks it's clearly the reason the prom was called off.

She said, "The ACLU sent a letter on Constance's behalf, and one week later, the school cancelled the prom."

Sun said the ACLU is "fighting tooth and nail" for the prom to be reinstated, adding, "We're working on an emergency motion it go before the court to get the prom reinstated so Constance can bring her girlfriend and everybody can be themselves."

On a national level, McMillen said, "I just want other kids to know that it's not right for schools to do that and I want them to be able to know that they can get a hold of the ACLU … and they help people through stuff like this. Because schools, they shouldn't be able to do that."

McMillen added that kids need to be true to themselves.

"That's how I was raised," she said. "I don't know how everybody was raised, but that's how I was raised, to always be yourself and be proud of who you are. And it's like they're asking you, like for prom, you can be gay, just don't be openly gay, just hide it for a little while."

Perhaps my biggest problem here is that high school is supposed to prepare teenagers for real life. To teach them the academic and social tools to enable them to be a properly functioning member of our highly diverse society. To not allow same-sex couples at prom (and other high school functions for that matter) is doing a dis-service to all of the student body.

It is unfortunate that we live in a society that legislates morality or culture. Check out this example:

The ACLU lawyer knows the school and school district cannot be forced to hold an extracurricular, non-academic event they cancelled. It's over.

Wait can we address the real issue here? DawnBroderick thinks that there is empirically based evidence on "abnormalities" in a homosexual's brain. Whatever bogus lab is producing these "results" needs to be shut down, because no where in science is there an article that will state that there is a significant enough difference between a homosexual's brain and a heterosexual's brain. She claims she is "fully educated" on the "medical" aspect of homosexuality. Dawn, do you have an MD or a PhD or both? Sorry, Dr. Broderick, if you have evidence that this difference actually exists, I'd like to contact the NIH for you so they can fund further research in this area, because you can absolutely win that Nobel Prize in science. Do you also believe that humans and dinosaurs co-existed?

what i find absolutely funny is that if the Almighty Church has such a hold on politics, why wasnt all that lobbied money poured into a study such as this? Im sure it would be to their benefit, not that i wanna throw the "establishment" a bone...

It is an abomination! In the eyes of the Lord the entire situation leads straight to and through the gates of hell into the fire and everlasting weeping and gnashing of teeth! If the Lord had so wished we would have been born in prom gowns and tuxedos. Let them all go to service on that night and pray to be rid of such sinful desires.
amen and verily and so on

First of all read McCollum v. Board of Education, Abington School District v. Schempp and most importantly Lemon v. Kurtzman. You'll notice that the common theme is a seperation of church and state, kind of the basis of our countries founding and all. So parading around a religious view on this topic is a moot point and it holds no bearing on this issue at all. Further than this, the right to free expression in school (the issue here), is a constitutionally protected right for students regardless of their age (see Tinker v. Des Moines School District). The famous part of this of course being the phrase in the decision stating "It can hardly be argued that either students or teachers shed their constitutional rights to freedom of speech or expression at the schoolhouse gate." So this type of issue has already received support by precedent from the US Supreme court, therefore, there is no logical reason to show that the prom should be cancelled.

Is the gay girl just a me person..I realise there are gay and transgendered students..So..The dress code is there for the students..I don't care who she dates and dances with..What is at issue here is the school shut down the prom..If it was a transgendered student they would still make an issue of it,,The gay person is told she must wear a dress as she is a girl and bring a boy as her date..The school system has the means to see how others school handle this. What if it was a male to female transgender who lives 24/7 as a girl.. Would the school say the student must dress as a boy when the student is dressed as a pretty girl, Doctors tell the student to do so..It is not me. What about a sp needs student. The dress code is there for a reason.

Do you really think we should accept that this school shut down the prom solely because one girl wanted to wear a tux?! I don't think so.

IT DOESN'T MATTER! it is who she is! she may not have money to have an operation like that! it is discrimination and it was called off due to her sexual oreientation! its disgusting and those people should all have there jobs taken away! because coming from a place that is supposed to teach people about being good members of society, all they are teaching their students through acts like this is hate and intolerance for people who are not like them

@DawnBroderick40 -- What science? Apparently, JUNK SCIENCE, because the position of every medical, nursing, psychological, psychiatric, and social work body of professionals is completely counter to your so-called "science". Do you know for a fact that the younger girl is 15? The age of consent is 16 in MS, and you don't even know whether or not they re having sex, just like you don't know whether or not anyone else going to to the prom is having sex. You are obviously prejudiced against gay people and ignorant in general so your comments aren't worthy of this attention to begin with. Your beliefs about gays conflict with the mainstream medical opinion about gays which has been accepted for the past 40 years.

The adult student in question is 18. The child she wishes to take to the prom is a minor. I was 15 when I was a sophomore. No underage child of mine would attend a prom with an adult. I call sexual exploitation of a minor and the minor's parents should be ashamed of themselves. It truly is a shame how the gays are ruining this country. It used to be a decent place to live. I am allowed to feel this way and am far from homophobic. I am fully educated on how there is something medically wrong with the brains of gays. There are a lot of brain abnormalities that result in abnormal behavior, but that doesn't mean that society has to accept it as the norm. Nothing will ever change my opinion about it either. There's no religion involved for me, just science.
