Md Police Seek Missing 11-year-old

(AP)  Police in Maryland were searching Christmas Eve for a missing 11-year-old girl last seen wearing fuzzy Christmas pajamas, and they have charged a registered child sex offender in her disappearance.

Thomas J. Leggs Jr. of Salisbury, 30, is charged with burglary and with kidnapping Sarah H. Foxwell, according to court documents.

A charging document says Leggs was the last person seen with Sarah.

Wicomico County Sheriff Mike Lewis said Sarah was last seen Tuesday night at her home on Maryland's Eastern Shore. A relative discovered she was missing early Wednesday while checking on Sarah and her 6-year-old sister.

"She wasn't in her room," Lewis said. He said there was no evidence of forced entry to the home where the girls live with their aunt, who is their legal guardian. Leggs is a former boyfriend of the aunt, officials said.

A "juvenile witness" awoke during the night Tuesday and saw Sarah leave the bedroom with "Tommy," and said he was wearing blue jeans, an orange jacket and white sneakers, the charging document says.

The statement of probable cause also says Sarah's aunt, Amy Fothergill, with whom Sarah lives, noticed that Sarah's green toothbrush was missing from the home. Deputies found a green toothbrush and a lollipop in a truck Leggs admitted driving. Leggs said he had been wearing jeans and white sneakers the previous night — the same clothes he was wearing when police questioned him.

The sheriff said Leggs has been uncooperative and "of no assistance to our investigators."

Lewis said Thursday night police were still in search and rescue mode, and he said searches would continue throughout the night. "We have not lost hope," he said.

The sheriff said the department is encouraging hunters familiar with their hunting areas to start their own searches beginning at 7 a.m. on Christmas Day.

Dive teams searched a local pond Wednesday night, and scores of police officers from across the region scoured several square miles of dense woods on Christmas Eve. They brought in helicopters and dogs to aid their search.

Police also released a photograph of a 2003 Dodge Ram 1500 pickup used by Leggs and they asked anyone who may have seen the champagne/tan-colored vehicle to contact authorities.

Sarah is white, 4-foot-8 and weighs 78 pounds. She has brown hair and blue eyes. When she disappeared, she was wearing red fuzzy pajama bottoms with Christmas trees on them and a pink John Deere T-shirt.

Leggs is being held at the Wicomico County Detention Center without bail, Lewis said. He is being represented by the public defender's office, which did not immediately return a call seeking comment. A woman who answered the door at Leggs' parents' house declined to speak to a reporter.

Leggs is listed on the Maryland and Delaware sex offender registries. The Maryland listing notes that he is a child sex offender, but does not give details about his conviction.

Lewis said Leggs has been convicted of sex offense in Wicomico County and was charged Oct. 29 with fourth-degree burglary.

"He was developed as a suspect early on in the investigation before we were aware of his criminal background, but he does have a criminal history to include third- and fourth-degree sex offenses of small young females," Lewis said.

In 2001, Leggs was convicted in Delaware of rape for having sex with a victim who was 16 or 17, according to the Delaware registry. The registry describes his risk level as "high" and notes he is unemployed.

Leggs, who has been convicted of assault several times, also is awaiting trial on charges of burglary and destruction of property in Ocean City.

It would help if the ignorant guardians and parents of these children would quit dating them. The aunt deserves to be arrested too.

CBS - why can't you keep this in the top of your headlines? She may not be kept locally. The subject had quite a few hours to take her away. Please keep her face to the top of your page for people in the surrounding areas.

The pictures of the balloon boy's parents have received more national attention than this innocent child has.

It thought the same thing! I had to hunt for this article, CBS! Yesterday it was big news, and on Christmas day it's buried beneath less relevant news.

A little girl is missing and it's Christmas Day! How horrible is that! How sad it is, that she is Not there to open her gifts this morning! This is the kind of news I want to read about!

Our community (Salisbury and surrounding area) is pulling together to bring Sarah home safe. This morning, we've had over 3000 volunteers sign up to search.

Please keep Sarah and the efforts of these volunteers in your prayers.

it is our fault. we don't demand that sex offenders be locked up for life, without parole, or at the very least that they must serve 50 years without parole. apparently, judging from news stories across the nation, they are released and re-offend again. when you rant and rage about sex offenders, look in the mirror because it's your fault too for not demanding tougher punishment for sex offenders of any kind, age, type. meanwhile, if their victims survive, they are scarred for life and if not, they turn to dust while the sex offender is allowed to continue to live, looking for the next opportunity, the next victim. victims can be of any age, any gender. recently an 82 y/o man, and et al, was arrested in california for child porn in a leo sweep of child porn. sex offenders are everywhere and they know there is little or no punishment.

Yes, I agree, and the re-offendars end up killing the child because they are scared to go back to jail. I think that this is the worst of crimes and they should be locked up for life. How can you be allowed to rape or molest a child and breath freedom ever again. There is something wrong there.

Why was she living with the aunt instead of her own mother? Why did the aunt date a known criminal and sex offender and expose her niece to him? These people are crazy and are unfit to be raising children.

This is an ex-boyfriend. It hasn't been released as to whether she knew his record or if in fact that this is why they are no longer together. He was not authorized to be in the home - he entered illegally.

I dont buy the fact that she may have not known he was a sex offender. It is simple to check the database and I am sorry but if you have kids in the house you owe it to them to do that. It doesnt hurt to check. I check my state database regularly because you never know who could be a monster.

This guy should have his stuff cut off and shot in the face. I am in PWC Virginia makes me want to go to Salisbury MD myself and start looking! I would spend my Christmas looking for her in the hopes she would be found alive.

I am so tired of reading on the news that this kind of thing happens to these innocent children and they are found dead once the PD finds them. The community general public needs to get involved in finding missing children.

There also needs to be education classes for children on stranger danger. The little girl knew this guy and probably didnt expect danger but if there were classes to inform kid then they would know that a man sneaking you out of your house in the middle of the night is wrong and you should scream as loud as possible. I dont know if that would help at all, but it is worth a shot. We have sex ed classes. Why not stranger danger classes.

I hope and pray that they find this little girl alive. Sadly, he has already served time for rape once, he most likely had no intention of leaving a witness behind this time. My prayers are with this family and that little girl.

This is one crime where the offender WILL reoffend and our criminal justice system needs change the laws so they are prevented from reoffending, whether that be life without parole or the death sentence.

I'd shoot him in the hip with my 44, and then give him 30 seconds to tell me where she is. Then he's dead anyway. I can't believe someone would kidnap a child on Christmas. That's a death penalty in itself.

There is so much wrong with this situation,

A person convicted of sex offenses against young girls is not in jail (deserves long sentences) and some idiot thinks it's OK to leave him with an 11 year old in her home.

The stupid runs strong in this community.

She was not left with him. He is an ex-boyfriend who entered the house illegally and is being charged with Burglary for the unauthorized entry as per MD law. The younger sister has reported that she saw him with Sarah, but he was not a guest in the home.

Will judges ever be held accountable? This guy has a rap sheet longer than my arm. How does our criminal system justify letting these people out on the street? Perhaps the law needs to be changed so that judges can be sued by the victims or their families when repeat offenders are allowed out of jail to commit additional crimes.
