Did Phillip Garrido Ply Wife with Meth?

CBSNews
(CBS)  The couple accused of kidnapping and raping Jaycee Dugard will be back in court Friday.

And one topic that may come up is Nancy Garrido's apparent past drug use.

Numerous sources tell CBS News her was heavily into methamphetamines, supplied by her husband, Phillip Garrido, reports "Early Show" National Corresondent Hattie Kauffman.

"If her lawyers could establish that, not only did he have this sort of Svengali-like control over her, but he also increased that mind control over her with this heavy supply of drugs, this heavy supply of drug use, then maybe that cuts in her favor," says CBS News legal analyst Trent Copeland.

Still, says fellow CBS News legal analyst Lisa Bloom, "Certainly (her dependency on meth) will give her a diminished capacity defense, that she didn't intend to cause the harm that she did but, over the years, if somebody is taking any kind of medication or drugs over and over again, knowing the effects it has on them, juries tend to be unsympathetic to that kind of a defense."

The Garridos were arrested in August and charged in the Dugard case. They allegedly snatched the girl off the street and held her captive for 18 years in a compound in their Northern California backyard, where Jaycee raised her two daughters, whom police say Phillip fathered.

Now, sources tell CBS News that, though the compound looked primitive, the tents there held a classroom with geography maps and electricity that powered a computer.

After their release, Jaycee's aunt, Tina Dugard, marveled to reporters about how well-educated the girls were, saying, "Jaycee is a remarkable young woman who raised two beautiful daughters. They are clever, articulate, curious girls."

CBS News has also learned the Garridos hid Jaycee and the girls in plain sight, taking them out in public, to the beach, the library, and the movies. They even went trick-or-treating, with phillip garrido in a gorilla costume.

Bloom calls that "just another example of all the flags and all the warning signs that were missed by the probation officers," noting that, "The California Department of Corrections here already issued a scathing report about the fact that phillip garrido was misclassified for most of his probation, not as a high risk offender as he should been, which would have given rise to constant monitoring."

Nancy Garridl 's reported to be very frail behind bars. She's had visits from family, Kauffman says, but Phillip hasn't had any visitors.

Meanwhile, Jaycee is about to celebrate the first Christmas with her family in 18 years.

I don't know what to say -- she met him while he was *already in prison* for *rape*; clearly he didn't force her to use drugs then. She chose, of her own demented free will, to associate with him, knowing exactly what he was capable of.

Drugs aren't a mitigation for violent crime -- they're an aggravating factor. A peaceful addict may deserve treatment and compassion; any violent one (like Nancy) is a defective sub-human and deserves to be destroyed by the system. We need to keep on this to insist that justice be served on both of them, and if it's not ensure they're followed and harassed forever, along with anyone who supports them, to ensure they don't do this again.

Always remember the victims of crime -- they're more important than any criminal.

I realize there are a lot of emotions going on. That grammer comment was actually made after my first comment regarding the drugs and so it was an aside. I do feel that if the papers want to be taken seriously they really need to keep their facts straight and present it properly.

My whole problem with this article is it is trying to lessen what monsters these people were. Aka the primitive tent had a computer and maps which may or may not be true. There was a computer in what looked like one of the sheds. We know there was electricity provided through a series of extension cords. And so what if the girls appeared educated. The fact is these people stole Jaycee's life. They hurt not only her but her mother, her step-father, her half sister. And we should feel, what, sympathy because they gave them a computer and a semblance of an education?

And now they are saying drugs made them do it. So who provided Nancy with her drugs while Phil was behind bars in the month of April 1993? Why did she not at that time release Jaycee back to her family? *Aside - Jaycee was still only 12 in April*.

Nancy is having visits from her family, so she is not alone in the world. She could have rescued Jaycee 1993 and then run to her own family for assistance. And I find it hard to believe that, being a meth druggie as is now being claimed, she would able to get a job as a nursing aid in 1994.

No, she knew exactly what she was doing.

Oh, and it would be appreciated if these "sources" would give dates as to when the outings occurred, how often and if Jaycee was allowed to go.

Guess I won't be eligible to be a jury member. :)

Excuses....methamphetamines for Nancy and Acid for Phillip. I am tired of these monsters using drugs as an excuse for violating another human being. If a judge had kept Philip Garrido in prison in the first place we wouldn't be having any of these conversations. (Philip Garrido should have done 100 years in prison for his first rape and kinapping instead of a ridicuous judge releasing him and blaming his actions on using acid.) I dont even see the relevance of drug use in a case like this, or any for that matter. These people chose to use drugs and chose to kidnap a little girl. They also chose to hold her captive and hurt her in everyway possible. I don't care how many drugs any of them were on. There are no excuses. Jaycee can never get back what was taken from her. Its about time our justice system started thinking about the victims and lock these monsters up for the rest of their miserable lives.

his wife met him while he was serving a prison sentence for serious crimes already, she wasn't an innocent person just drugged up unwittingly, she knew he was a criminal when she met him, they probably just fed each other their warped desires

Hi again. You all might want to proof read your article. There are loads of typos in it.

Geez, its interesting to see that your concern is with grammer and typos. People have many emotions going on about the injustices to Jaycee Lee Dugard and the failure of our justice sytem to protect her and others from this monster....you are concerned with spelling. WOW!

Drugs, right. She held a job, she got her license, she was operating fairly normally at that job. She took care of her elderly mother-in-law People said she was nice. Then all of a sudden she is now a poor lonely abused wife whose hubby plied her with drugs to control her. I think Nancy is reaching for straws here unless she thinks the jury of her peers are all going to be stupid, easily manipulated and mislead to believe this nonsense.

I can believe she used drugs, right along with her husband. I don't for a second think he used drugs to control her.

As far as her being frail behind bars... she was skinny when she went to jail. Skinny does not equate to frail. Most people do not like jail. She is sad to be there and sad she got caught. Like a child who pretends to be sick to get out of going to school she is putting on an act. However, if she succumbs to her frail condition and croaks, maybe then I will believe.

As far as the girls getting out and about, I am sure they did, because no one was looking for them. That does not excuse kidnapping and sexually abusing Jaycee. Read the rape report of Katie to see just what kind of abusive sex Phillip preferred and that Nancy allowed to happen to an 11 year old girl.

18 years. The woman has no humanity to allow that to happen for 18 years. The lawyers suffer from the same delusion to even try to manifest this in the minds of a jury.
