Hasan Ordered Held until Court-Martial

(AP)  The Army psychiatrist charged with killing 13 people at Fort Hood will be confined until his military trial, initially staying in a hospital where he is recovering from gunshot wounds, his attorney said Saturday.

During a hearing in Maj. Nidal Hasan's room in a Texas hospital on Saturday, a magistrate ruled that there was probable cause that Hasan committed the Nov. 5 shooting spree at Fort Hood, said his civilian attorney, John Galligan.

Hasan has been at Brooke Army Medical Center since the shooting, and his attorney said Hasan has been told he has permanent paralysis.

Galligan told The Associated Press in a telephone interview that the judge also ordered Hasan to pretrial confinement, which usually means jail, until his court-martial. The military justice system does not have bail for defendants.

The magistrate ruled that Hasan will initially remain in the hospital, where he is in intensive care, Galligan said.

Saturday's hearing was closed to the media. Officials at Fort Hood declined to comment.

Galligan said Hasan has no feeling from the chest down and has limited movement in his arms.

Hasan was shot by civilian members of Fort Hood's police force after the shooting spree in a crowded building where soldiers must go before they are deployed to finalize wills, update vaccinations and get vision and dental screenings.

Hasan has been under guard at the hospital, Galligan said, and military officials have not told him how the pretrial confinement status will change anything.

"I don't know what rights and privileges he had that will now be changed, such as visitors of if they'll open his mail," Galligan said. "There are still many issues that haven't been addressed. I feel like I just wasted a day."

Hasan has been charged with 13 counts of premeditated murder. Authorities have not said whether they will seek the death penalty, his attorney said.

Galligan said he is concerned about where Hasan will be moved once he's released from the hospital, but he does not know when that will happen.

What I think so many people are over looking and why his crime is particularly heinous is the fact that he was a SOLDIER, he went through basic training like every one of us has, He went through training with other officers, and despite the total love you are inspired to feel for your comrades, your battle buddies, he managed to do this. Even if you hate the Army, it is really difficult to feel anything but compassion for the people to your right and left who are willing to die with you and for you.

He should die in my opinion, paralysis or no, not because he's a Muslim or a jihadist, but because he killed his battle buddies, he harmed people who would have died for him, just because he wore the uniform and stood beside them.

And no they shouldn't show him in uniform.
And he should be charged with treason not just murder.
UCMJ has many more options then forfeit of rank and pay, if desertion can be punished by death then surely so should treason against your country.

pfc_rodgers, the term treason is not part of the UCMJ, although, should the Army wish to pass jurisdiction to the feds then a charge of treason could be considered. Ultimately a courts martial for the 13 counts of muder will most likely see MAJ Hasan in a concrete box for the rest of his life, and given his injuries that life will most likely be very uncomfortable and probably short. I don't think, although not-unexpected, that the insanity defense is going to work.

BTW, even though max punishment for desertion is death that would normally be in the face of the enemy and as far as I know has not been used since WWII.

Put a wheel chair beside his bed. Put 2 AK-47s loaded with blanks on the table beside the bed and leave the room. See if he comes out firing. Let's see if he still wants Jihad or if he is sorry.

Considering his current and future condition of being paralyzed from the chest down means that the military trial should be carried out swiftly.
He now needs nursing care, and prison guards are not trained and paid for changing his necessary 'pampers' twice a day or more often.

Therefore, get him to court in his hospital bed. Try him, convict him, and give him his lethal shot short afterwards. This will save a lot of taxpayer's money.

He should not be in military uniform, he was only a US soldier under pretense. He is a killer for his Islam religion & should be sent directly to Alah after much suffering. What a shame that the people that could have prevented this did not do their job. We have alot of sick religous nuts in our country, more now than ever, lets be more watchfull of their daily lives to protect us all from their evil.

Have you ever heard of John M. Russell? What or who was his inspiration to murder 5 fellow soldiers on a U. S. base in Iraq? Where or to whom should Russell be sent? Should Russell undergo "much suffering?

cbsboycotternow4ever - What I find offensive about the photograph is that this guy is shown wearing his military uniform. That is an affront to anyone, past, present, and future who serves or served in the military.

I am very concerned with what lead up to this horrible autrocity. We have become a "politically corrrect" society. Even if it means not only harboring, but, promoting individuals like Hasan. The Army knew he was dangerous years ago. Because he is Muslim, he was given sepecial treatment. If you really want justice, turn him over to the families and let them carry out the punishment.
