Did Filing Error Free L.A. Murder Suspect?

(AP)  A newspaper reports a man charged with killing a 17-year-old girl in Los Angeles may have been free because of a clerical error that misstated his criminal record.

The Los Angeles Times reported Monday on its Web site that authorities did not know that Charles Samuel was eligible to be prosecuted under the state's three-strikes law when he was convicted of burglary in San Bernardino County in 1997.

The Times says a San Bernardino County district attorney's official said he believed prosecutors would have filed the burglary charge as a third strike had Samuel's "rap sheet" properly shown that he had previous convictions that counted as two strikes rather than one.

Under the three-strikes law, offenders convicted of a third strike face a minimum prison sentence of 25 years to life.

Samuel is charged with the murder, kidnapping and robbery of Lily Burk.

At midyear 2008, there were 4,777 black male inmates per 100,000 black males held in state and federal prisons and local jails, compared to 1,760 Hispanic male inmates per 100,000 Hispanic males and 727 white male inmates per 100,000 white males.

Who commits the vast majority of crime?

The other case in OAKLAND police mess again.

Some people believe without any thing about this case, " Oh, yah, you're the angel."
It means the guy ( black guy) was wrong and the white female officer was not wrong to shoot him to death.

Some people just say, African American's special deal or right, but in Oakland we don't see such special deal for black people either any races.
I did not have space to write this today and I put here about this case.

The handy man was shot to death by Oakland female officer, the point of this incident,
the officer said " The guy was wrong."
But the other eye witness and even the store employees did not say so.
The black handy man was visiting the shop often and they knew each other.
So it seems the officer over reacted to kill the guy.

As a Japanese, I always think unbelievable USA officers shoot kill people so often, they kill people more than dogs.

The news ( the officer ) described as " armed man" as handyman.
His job is handy man and he had a tool.

So poorthing.

I recall Vietnamese wife had a peer in her hand and the officers arrived to her house and when she opened the door, I guess she was so surprised and so get upset why the officers there, but the officers shot her to death in California, Sacrament or Sanjose.

California 's law does not allow to hit kids to discipline, but many countries even Japan and Europe have this custom, and in her case, the neighbor saw her, she hit her kids and called 911.

How do you think there is enough reason to shoot her at her entrance?

She only had a peer, she was cooking.

Such incident usually created by white officers often.

Last night in the local news, the other officer said, " We are not able to shoot people if they don't seem wrong. or We are not able to shoot people easily."

But the news watcher even misunderstood what officer said, " Officer said they can shoot whatever they want."

Why white people support white people like this? Even misunderstanding what the officer said.

INSANE.

I had to give explanation to the man and he finally understood the incident though.

At least, the Harvard professor's case, and the shooting is much worse and the officers who shot people
they don't apologize at all.

it is really strange for foreigners, the police should protect people but here is USA people also tortured or executed by offers, this is a hell in the world.

Sorry for USA people.

USA people, you are really pity and miserable in this situation,

who can trust your police system like this?

japanese police don't shoot people often, they are brave enough, they catch them without using guns but
may be often use the long stick to beat.

But beating people are not killing people.

USA people watch Iranian revolution and say " IRANIAN communism police beat people!!!"

But look inside of your country, USA, it is worse than any other countries often.

Police shooting to innocent people or non harmful house wife or handy man,

And " I am not wrong " and make up story to justify themselves, it is USA police and Oakland police.

Shame on you.

The "clerical error" is irrelevant, his "rap" sheet's completeness is not his fault, or problem. The law said what the law said, he served his time, and was freed. So he gets out, and while free commits another very serious crime, so what? Other than his subsequent actions being an affront to our sense of morality, his being freed correctly conforms to US law.

That is the way the law works in America, serve the time imposed, plus any reductions or extensions based on your actions while incarcerated, after which you go free. There is no retroactive imposition of extra penalties based on the post process correction of "clerical errors". The judge's sentence is carried out, you serve your time, then you go free. If you commit another crime after that and get caught, you serve the sentence for that one also, as the criminal of this story certainly will.

That someone got an extra strike because of a "clerical error" really is nothing actually newsworthy.

Gladly, this is a regressive. de-evolutionary trait that is rapidly (although not rapidly enough for most sane people) dying out of the species, in a few more generations the last specimens will be slowly decomposing in anthropological lab jars filled with formaldehyde.

pw08-2009 I happen to be white and i would like to ask you,How many african americans do you personally know? Did you do some sort of poll of the "majority of african americans", if so where can I find those statistics? If I find a comment offensive no matter who said it I dont feel its worth repeating. The sad part here is that a terrible crime took place,a 17 year old child lost her life and the only thing anyone comments on is race!

An acquaintance I worked with, who happens to be black, suggested that the "white men" are partially responsible for this tragedy. He said the "white men" liked to keep the "brother" down so he had to resort to a life of crime.
I was so disgusted and just had to walk away.
