Rather sued CBS and his former bosses in 2007. He claimed they removed him from his "CBS Evening News" anchor post after controversy over a report about President George W. Bush's Vietnam-era military service.
Last year, Judicial Hearing Officer Ira Gammerman struck down the parts of the suit that named Viacom Chairman Sumner Redstone, CBS President Leslie Moonves and former CBS News President Andrew Heyward as individual defendants.
Monday's filing in state Supreme Court seeks to add Moonves and Heyward again. A CBS spokesman said the network would move to dismiss the lawsuit.

- Good for you Dan. Go get those jerks. It's about time the execs that ruined ethical news outlets on TV be held accountable. CBS used to have one of the finest news programs...now most people get their news online because of idiots like Moonves and Heyward. Never was more happy to see their ratings drop and their news programs lag well behind online outlets. That's what you get for trying to influence the media with corporate politics.
