High Court Ruling Decriminalizes Consensual Gay Sex, Previously Punishable By 10 Years In Jail

(AP)  A court in India has made a groundbreaking ruling to decriminalize consensual gay sex in the capital of the deeply conservative society.

The Delhi High Court ruling, the first of its kind, applies only in New Delhi. The ruling says that treating consensual gay sex as a crime is a violation of fundamental rights protected by the constitution.

Anjali Gopalan, head of a foundation that filed a petition prompting the ruling, says that India is finally entering the 21st century

Sex between people of the same gender has been illegal in India since British colonial times and can be punishable by up to 10 years in prison.

The court's verdict can be challenged in India's Supreme Court.

Homosexuality is spreading faster than wildfire in a dry forest,while aids is rapidly becoming the number one killer.Odd how the w.h.o. declares a level 6 swine flu pandemic with a few hundred deaths. while basicly ignoring the hundreds of millions dying by aids.Maybe this is the manner in how mankind will destroy itself.

Good for them. Unfortunately, most of the previously colonized lands of imperial Europe (especially Britain) became rabidly homophobic because of the imposition of Western morals. However, in Indian temples and in some of their sacred writings, it is obvious that gender and sexuality were more open in pre-colonial britain, as was the case with Native Americans before colonization. It is known definitively that about have of all Native americans had a role for other genders, that some called two-spirits, and were esteemed members of the community. They were often thought to have greater ability to be spiritual because of their male and female natures. In India, we see this remnant today in the role of Hijra, some of whom have become mayors in recent years as part of a protest vote. Hijra are usually men that dress as women. What we would call transgendered. Interestingly, while the society reviles them. They are kicked out of their homes, many are forced to become prostitutes in order to live. They are still sought out to bless weddings, and child births because they are believed to have the power to bless or to curse.

Just because America consumes tons of porn despite the objections of janet jackson's breasts. There are cultures that are more open about certain things while being more closed about others. And some that are just more open. Having perversion does not make one liberal or open, perversity is usually most perverse behind the closed doors of the so called moral people. Hence, why Anglo culture (and almost all others now) are so fu**ed up. Your prison example, as well as the macho power dynamic inside, speaks more of conservative values. Remember, rape and sexuality are not really the same thing. But "moral" people, and misguided people, don't know that. Hence, the sins.

PS. Just so you know, Mexico City has Civil unions now, New york city doesn't. Most states in the US are still busy trying to impose basic anti employment discrimination laws and anti-bullying laws. Uruguay, a Latin American country recently passed a civil unions law and a law that allows gays in their military. The prime minister of Iceland is lesbian. Many countries including Spain, South Africa, and Canada have legalized gay marriage. A member of New Zealand's Parliament is a former prostitute Maori Transgender.

We've been frozen in time a bit with Herr Bush here. We've been too busy trying to re-start the 1950's here.

India! Deeply conservative!??? BS! Here in Florida we have many dot heads that open discount liquor stores. All of those stores are equipped with racks of pornography. I did'nt know the religious conservatives were into porn. LOL
