Court: Man Stuck With Lying Virgin Bride

(AP)  A French appeals court on Monday reinstated the marriage of a Muslim man who had sought an annulment because his bride lied about being a virgin.

The controversial case pitted France's secular values against the traditions of its growing immigrant communities.

The couple married in 2006 but the husband quickly sought an annulment after discovering on their wedding night that his bride had lied about her virginity.

In April, a lower court in the northern town of Douai granted the annulment, saying the woman "acquiesced" to the man's demand for one "based on a lie concerning her virginity."

On Monday, the appeals court in Douai overturned the annulment, effectively ruling that the couple is again married, said lawyer Xavier Labbee, representing the husband.

Labbee said Monday's ruling amounted to a "forced marriage." He criticized "the intrusion of the notion of secularism into the most intimate parts of family life."

Both the woman and the man opposed the appeal, according to their lawyers. The woman's lawyer, Charles-Edouard Mauger, has said she was distraught by the dragging out of the humiliating case.

The couple must now seek a divorce if they want to separate.

Prosecutors argued the annulment discriminated against women and wanted it thrown out. The lower court had based its decision on an article of the French Civil Code that states that a spouse can seek an annulment if the partner has misrepresented his or her "essential qualities."

The couple, a man in his 30s and a woman in her 20s, has not been identified by name.

In Monday's decision, the appeals court said virginity was not "a condition posed for their union," according to a statement from the prosecutor's office. It said the lie was not enough to justify an annulment.

Regardless of your personal or religious views, the virginity of a spouse is considered a requirement in some cultures. She intentionally lied to him about a requirement for his and her marriage.

Kenny Chesney and Rene Zellweger had their marriage annulled because one of them lied about their life''''s plans (far less of an offense).

This should be an open and shut annullment.

"In some cultures" is the point exactly. Not in France. You have to abide by the laws of the country you live in. If a Muslim wants to move to a non-Muslim country, one that is not ruled by Muslim law, then he needs to abide by those laws. Don''t move to a secular country and then whine because the laws are secular.

LOL. Well, bud, there are plenty of countries that will impose religion in those most private parts of your life, so move on. You want to come to the freedom and economic prosperity of a western, secular, country, and then want to yap about your traditions. What a hoot.

No judgement, just an observation here, they wouldn''t have been happy together; their values were different. It was very important to him that she be virginal and she didn''t deem that an important thing to save for marriage.

Lots of girls of that belief system see a plastic surgeon and have their hymen reattached.

If he wanted the law to be different, he should have gotten married in a place where the law reflected his values, like anyone else.
Maybe he could have gotten married in some dark corner of the muslim world, where instead of an annulment, she would quite literally have been dragged screaming to the town square, where her loving fellow muslims would have been deeply happy to stone her to death with sharp rocks, to help them express "God''''s love", or "justice" or whatever else religious lunatics all over the world call their murderous barbarism

After the marriage is annulled, THEN WHAT!?!?!?

Is the bride''s father going to kill her for bringing shame to his family?

I become highly amused at Muslim men confronting the laws of divorce in many countries, when their wife uses her right of free will and sues for divorce.

Nothing is lower than the closed mind of those who gave control of their life to extremist religious beliefs.

I would just like to make this comment. WAS MR. MUSLIM A VIRGIN ALSO. What a piece of garbage, he has probably slept with 100 women, the creep. THIS MAKES ME SICK TO MY STOMACH, the judge should have thrown this case out, that is my opinion. I can''t say anymore, I can feel my blood pressure rising.

I can definately say without a doubt, yes, you are a bigoted individual. If you have lived in any part of the Muslim world, as you say, I feel sorry for you, that you were not able to let go of your prejudice and bigoted views...if only for a moment to let, average, every-day Muslims show you what their life is all about. If you did, you would''ve probably seen, that they are not much different from you (minus the bigotry, of course) and they want very much the same things you do...a happy life, with happy children and the ability to live their lives in a peaceful manner. I have known individuals that are jehovah''s witnesses, and thankfully, they are nothing like you...in that they do not spew hate or bigotry...i may not agree with their teachings, but I am glad to count them as friends. My religion, teaches me to love all people and practice tolerance and not hate. Too bad, yours doesn''t. Also, i think your ''we vs. them'' attitude is part of the reason why we have so much misery and war in this world....try being inclusive instead of exclusive...it might just change your world. This is why it is important for we women to be chaste before marriage and to resist being liberal ***. When we find a good wealthy man to marry they expect things like virginity and its the smart woman who will have that.
