Ohio Woman Spared Death Penalty In Murder Of One-Month-Old Daughter

(AP)  A woman in Dayton, Ohio, has been sentenced to life in prison without a chance of parole for killing her baby daughter in a microwave oven.

Twenty-eight-year-old China Arnold chose not to be in the courtroom for Monday's sentencing.

Arnold was convicted of aggravated murder in the 2005 death of month-old daughter Paris Talley.

She was spared the death penalty because jurors could not reach a consensus on the punishment.

It was Arnold's second trial; the first ended in a mistrial when new witnesses surfaced.

Defense attorney Jon Paul Rion has asked for a third trial, saying a former cellmate who said Arnold confessed has now changed her story.

The defense had argued that Arnold was drunk when the offense occurred and had no motive, while prosecutors had called the crime "heinous" as they argued for the death penalty.

During the trial, an 8-year-old boy said he saw another boy walk into the kitchen of a nearby apartment with the baby, heard the microwave go on and then later saw the burned baby in the microwave.

The thing is, they need to be sure that she did in fact put her baby in the microwave. If she did commit this horrible crime, then She should get life in prison without parole.

Shanev137, Actually there was a case within the last 12 months where a father DID put his infant in the microwave. I don''t THINK his baby died but he claimed a mental problem (which there was record of.) The case did leave media spotlight after the initial report so there IS gender bias.

For those who compare this abortion get real. The fact is she was convicted and sentenced by the jury and in our justice system we have to hope their judgement was sound based on the evidence. Does the death penalty really do any good anyway? I am not opposed to it, but it isn''t used within the spirit of the law and it cost millions of taxpayer dollars for all of the appeals and usually to pay for the defense.

I''ve been following this case since it was first reported. IF the jury is right, this woman should not be supported by public taxpayer dollars. Make her earn her own keep; work her 16 hours a day, six days a week. No TV, no books, no newspapers, no frills, just basic food, water and medical treatment. What you fail to consider is that these women were tried in different states by different juries with different judges and different defense and prosecution lawyers. Even the wording of the laws vary from state to state. To blame race for the differences in the sentencing is getting old, very old, and should only happen when there is evidence that race really affected a trial.

I wonder if the posters who are outraged at the life instead of death sentence for this woman are the same posters who were outraged at the sentence a father got for killing his kids'' cat in front of them. Both defenses were the same, they were too drunk to know what they were doing...cat or baby, it is the same cruel, sick act and the same drunken excuse, so why defend one and not the other?
