James Martin Davis, the attorney for 26-year-old Kelsey Peterson, said his client will plead guilty Wednesday to federal charges of having sex with a minor across state lines.
It's similar to the original charge of crossing the border to have sex with a minor but doesn't carry a minimum 10-year-sentence, Davis said.
A message left for the U.S. Attorney's office in Nebraska on Tuesday was not immediately returned.
Peterson and the boy left Lexington in October. They were found a week later in Mexicali, Mexico.
The boy, who is now 14, has told The Associated Press that he did not consider Peterson his girlfriend but that they did have sex.
Davis has maintained that the law under which Peterson was being charged was inappropriate because it was intended to combat forced prostitution.
"She's always said like I did, she'd plead to what she did do, but she wasn't going to plead to what she didn't do," Davis said Tuesday.
Davis said he expects his client will spend six to seven years in prison.
He said he hopes state charges, which include kidnapping and first-degree sexual assault, will be dropped. An after-hours call to the Dawson County attorney's office on Tuesday was not answered.
The Associated Press previously named the boy as police were searching for him but stopped using his name after authorities charged Peterson with a sex crime.
He was an illegal immigrant in the United States when he left with Peterson. He is back in Nebraska temporarily after being granted humanitarian parole by the Department of Homeland Security.

Kevzgirl: Your note requires a focal response. By ignoring the impact of sports as a metaphor of ***, you miss the entire reason for their existence. By promoting the "hard" sports, the ones bringing physical contact, dominance, "back ends","sliding into first" "pinning" etc, you are transferring and amplifying sexuality into the schools. An elegant study by a colleague of mine showed that the elimination of foot ball, and base ball, and wrestling and implanting more golf reversed the trends of male groping, "feeling up" and unwanted advaces and spontaneous "conversations" from men in High School, over one year, as well as teen age pregnancy rates. Unfortunately the State of Conn would not eliminate those "sport" programs, but we are still pushing this within the State COURTS.
It is not a "crazy" idea, if you open your mind to the facts.
There is no reason on earth for us to sanitize these "sports" or for my and your tax money to support such portional- sexual expeditions into disruption of the balance young women need . Men can not dominate us, if we fight back.- Reply to this comment
- I want to thank you for all your comments. I tell my students that the first step in learning is to hear other voices, and ideas, that may be in conflict with the "tape" in your head, your own convictions may be demons placed there by societal forces, not within your control. Yes , you may not at first agree as new ideas outside of your hereditary "comfort zone" chafe against the big boys of your brain - male dominance, servitude, BREEDING, and drudgery of housework, all programed responses to expectations.
My students listen, consider, and learn.
And...I have a feeling that I have made a wider impact with a few enlighten posts that have brought some degree of academic frontage to the backwater locals, Janes and Joes, about to enjoy the 4Th of July. Perhaps on this glorious day celebrating the freedom of one people- people of Color-from slavery- 200 years ago, we may all work for the freedom of the female gender, soon. So men, do not force your "spouse'' (What an ugly word- sounds like out ! out!) to do your chores, dishes, or forced sexxx today. Give her a day off from her servitude as well.
I am not offended by hearing other voices, are you ? - Reply to this comment

- I am someone who normally does not get to riled when I hear about college professors with agendas because I believe most students can see the agenda and make their own opinions. However, my stomach turned a little when I pictured students feverishly talking notes from a lecture with "Women and the World" Professor HamiltonGRAD.
Better uses for this note paper can be found in the boys And girls bathrooms. - Reply to this comment

So you are a Feminist! Isn''t that Cute. - Reply to this comment
- HamiltonGRAD: Just WHAT kind of upbringing did you have, to see something se-xual in baseball/football/soccer? That is just perverted, IMHO. The fact that this "mature" 26 year old WOMAN would have se-x with a BOY half her age is sick, and IS A CRTIME, and therefore SHOULD BE PUNISHED. If it were a 26 y.o. male and 13 y.o. female student, the man would lose his teaching license and spend a long, long time in jail - the ONLY inequity here is that she won''t do more than 6-7 years. Pedeophilia, regardless of the se-x of the perpetrator, is still WRONG and they should be punished the same.

- HamiltonGRAD: How can you even be considered a "Professor" with the mentality that you have proven to us all. In a logical way of speaking, what you say and what you are does not make sense. And after reading the last few comments, at early in the morn'', it seems as though you are talking in your sleep.
Now wake up, shut up, and bring me my danm beer, wench!!! - Reply to this comment
- A full professor of.....wait let me guess....women''s studies.
With that degree, being a professor of said degree is the only job available to you. So you sit around all day dreaming up perceived societal imagery of the proverbial male thumb squeezing down on women...keeping them from achieving anything in life and causing them to commit crimes because they have not the capability to have an original thought in their head.
I am going out on a limb here but I wouldn''t be surprised if 99.99999% of women would take offense to you characterizing them as subservient dolts incapable of an unbiased thought and action. That every action in their life (good or bad) is because a man forced her into it. I say good actions also because if all the bad things are caused by men, then by extension that also means the good things also are caused by men. Can''t have it both ways. - Reply to this comment
