(AP)  A former teacher accused of having sex with a 13-year-old student and fleeing with him to Mexico is expected to plead guilty to reduced charges, her attorney said Tuesday.

James Martin Davis, the attorney for 26-year-old Kelsey Peterson, said his client will plead guilty Wednesday to federal charges of having sex with a minor across state lines.

It's similar to the original charge of crossing the border to have sex with a minor but doesn't carry a minimum 10-year-sentence, Davis said.

A message left for the U.S. Attorney's office in Nebraska on Tuesday was not immediately returned.

Peterson and the boy left Lexington in October. They were found a week later in Mexicali, Mexico.

The boy, who is now 14, has told The Associated Press that he did not consider Peterson his girlfriend but that they did have sex.

Davis has maintained that the law under which Peterson was being charged was inappropriate because it was intended to combat forced prostitution.

"She's always said like I did, she'd plead to what she did do, but she wasn't going to plead to what she didn't do," Davis said Tuesday.

Davis said he expects his client will spend six to seven years in prison.

He said he hopes state charges, which include kidnapping and first-degree sexual assault, will be dropped. An after-hours call to the Dawson County attorney's office on Tuesday was not answered.

The Associated Press previously named the boy as police were searching for him but stopped using his name after authorities charged Peterson with a sex crime.

He was an illegal immigrant in the United States when he left with Peterson. He is back in Nebraska temporarily after being granted humanitarian parole by the Department of Homeland Security.

As a feminist and a college Professor (Women and the World), I an shocked that this poor woman has been treated as if she is a criminal.
She is a victim.
What type of social / school pressures was she under at this school. She is obviously an attractive person, and we need to know if she was the center of "jokes" by male staff or students, thus forcing her into a role she did not want to play . Just because this was a ''boy" does not mean that he could not prey upon a female. In fact he sounds pretty "grown up". He is not an 8 year old.
As an adminstrator, I see the stress that women teachers have in dealing with any males over the age of 12, even so called "teenagers" - In truth, they are the most free to dominate girls in the classroom. In doing so , they want to step up to dominate the teacher as well. Sports for boys should be banned, as they encourage Boys to act like men, we do not need football, or baseball, or wrestling, as they just encourage the stereotype of MALEness, when in fact school should do all we can do downplay those primitive impulses.
This woman, like all woman , is not to blame. We all all.

As I woman, and a teacher, I am appalled at your justification of this woman''s actions! Women are not helpless infants who, by virtue of there ***, who fall prey to wily teenagers. I work with teens everyday, and there is nothing any of them could do to entice or force me into engaging in any sexual activity whatsoever -- much less flee the country with one! I am the adult, they are CHILDREN. You really sell your own gender short. As for the claptrap about the damaging effect of sports on boys, ridiculous!

As a male teacher if you were my administrator I would hope you could at the very least spell administrator correctly.

I also coach which I do not think enforces MALEness. There are traits which boys need to develop to become men that we learn from hopefully our fathers or else from our male peers not a sport. The fact that you think that sports brings about a maleness is ridiculous.

To those writing below: Why are so many men so angry ? I have many answers for this,so I need not be offended, rather I am cautious and vigilant and try to teach my students a better way to behave, without anger issues clouding our mentation. Clearly, some schools and even female teachers (klew) are dominated by MALEness to the point of denial of reality.
Just look around at your so called TEEN age boys. They are men. That is why the ARMY recruits them !
This teacher is a focal point, an emblem of all that our society claims but fosters itself in a mirror of lies. Who should be in jail ? perhaps the boys gym coach !

I had my Neighbor arrested for enticing my 15 year old daughter into sleeping with Him he was 21. It was a crime and he was jailed and did 6 years for that crime and I seriously doubt it changed his ways I moved my family across the country after that but doubt he would ever change as it turned out he had done it before to other teenagers who''s parents refused to prosecute which is a shame my Daughter might have not been plaxced in that position had he been in jail.

You simply and obviously do not have a Moral compas or Maturity to grasp the true nature of such a crime even if both participants are willing... Your repugnant in your ignorance.

As a former Marine, and as a Scoutmaster for many years, I can say that we should support sporting activities for all young males. It is healthy for them; it helps promote traits that will serve them well in later years. And, I support those young males who are not interested in conflict sports, to those I try to lead them to fun and less competitive sports, such as volleyball which is more fun to play than basketball or football which is often accompanied with long tiring practice and long periods of waiting for your chance to play. But sports are very important for all children male or female.

Most all boys are driven by hormones by the time they are 13, and boys will experiment with many forms of se*x, this is the time to keep watch over them, while not interfering with what comes naturally to them, just be there for them when they have questions, let them explore with their peers, and keep adult predators away from them - for the sake of the our children who are on the cusp of entering adulthood. Treat them as we would like to be treated, and most boys will become great men and leaders. It takes conflict and competition to make a great leader, Scouting, and sports will give that to them, and the Marine Corps will to the rest.

Just amazes me that 17 year olds can get 10 years in prison for having *** with 15 year olds, but the same courts will accept plea bargains from real adults having *** with even younger children. Something is wrong with our judicial system. Very wrong.

*** is humanitarian parole? A 14 year old that admits to having sexxx with an adult but does not consider her his girlfriend. (he probably has to say that to keep from getting ribbed by his friends for screeeewing such a dog) But here''s the deal: this kid is obviously not some innocent--the woman is guilty and should be put in prison, but the kid is illegal and should remain in Mexico--at the very least, when next he decides to "indulge" an adult, we don''t have to let it be an American who is stupid and nasty enough to go with a child.

No way should this kid be allowed back here--if for no other reason than as an illegal--he does not belong here--and if he is illegal, odds are so are his parents. Send them all home, out of work Americans need their former jobs.

Why is it that a woman will be given or allowed to plea to reduced charges. From reading it appears the prosecutors screwed up to an extent, but if this was a case of gender reversal and a male teacher slept with a 13 year old girl, he would be fried. Yes, I do agree all child predators should be taken care of, but we should not distinguish between men or women. I wonder if castration would be a better choice for men as this should stem all future urges. As for the women, something similar to castration could be used.

This sort of attitude does a major disservice to women. My daughters are just entering college; they want to be treated as human beings and as equals - not as helpless victims.

First, now that you are out of school get a job and see what reality is really like.

Second, an "illegal" is an abreviation (hamilton did tell you what that is didn''t they?) for illegal alien, you are not illegal for existing, but illegao for going somewhere you are not supposed to go, legally.

Third, yes women and men are both going to encounter compromising situations in life and work where they must do the right thing, or it is wrong and they have to deal with the results. A teacher is held to a higher standard. This lady admitted to commiting illegal acts with a student in her charge. She was caught red-handed and admitted her guilt.
