James Martin Davis, the attorney for 26-year-old Kelsey Peterson, said his client will plead guilty Wednesday to federal charges of having sex with a minor across state lines.
It's similar to the original charge of crossing the border to have sex with a minor but doesn't carry a minimum 10-year-sentence, Davis said.
A message left for the U.S. Attorney's office in Nebraska on Tuesday was not immediately returned.
Peterson and the boy left Lexington in October. They were found a week later in Mexicali, Mexico.
The boy, who is now 14, has told The Associated Press that he did not consider Peterson his girlfriend but that they did have sex.
Davis has maintained that the law under which Peterson was being charged was inappropriate because it was intended to combat forced prostitution.
"She's always said like I did, she'd plead to what she did do, but she wasn't going to plead to what she didn't do," Davis said Tuesday.
Davis said he expects his client will spend six to seven years in prison.
He said he hopes state charges, which include kidnapping and first-degree sexual assault, will be dropped. An after-hours call to the Dawson County attorney's office on Tuesday was not answered.
The Associated Press previously named the boy as police were searching for him but stopped using his name after authorities charged Peterson with a sex crime.
He was an illegal immigrant in the United States when he left with Peterson. He is back in Nebraska temporarily after being granted humanitarian parole by the Department of Homeland Security.

What type of social / school pressures was she under at this school. She is obviously an attractive person, and we need to know if she was the center of "jokes" by male staff or students, thus forcing her into a role she did not want to play . Just because this was a ''boy" does not mean that he could not prey upon a female. In fact he sounds pretty "grown up". He is not an 8 year old.
As an adminstrator, I see the stress that women teachers have in dealing with any males over the age of 12, even so called "teenagers" - In truth, they are the most free to dominate girls in the classroom. In doing so , they want to step up to dominate the teacher as well. Sports for boys should be banned, as they encourage Boys to act like men, we do not need football, or baseball, or wrestling, as they just encourage the stereotype of MALEness, when in fact school should do all we can do downplay those primitive impulses.
This woman, like all woman , is not to blame. We all all.
There were any number of female teachers that I lusted after in high school.
Had I scored, I would''ve kept my mouth shut tight.
I also coach which I do not think enforces MALEness. There are traits which boys need to develop to become men that we learn from hopefully our fathers or else from our male peers not a sport. The fact that you think that sports brings about a maleness is ridiculous.
It seems to me that you have a self-righteousness about a man having a strong personality. Of course you are a feminist.

Just look around at your so called TEEN age boys. They are men. That is why the ARMY recruits them !
This teacher is a focal point, an emblem of all that our society claims but fosters itself in a mirror of lies. Who should be in jail ? perhaps the boys gym coach !
It is a crime very simple.
I had my Neighbor arrested for enticing my 15 year old daughter into sleeping with Him he was 21. It was a crime and he was jailed and did 6 years for that crime and I seriously doubt it changed his ways I moved my family across the country after that but doubt he would ever change as it turned out he had done it before to other teenagers who''s parents refused to prosecute which is a shame my Daughter might have not been plaxced in that position had he been in jail.
You simply and obviously do not have a Moral compas or Maturity to grasp the true nature of such a crime even if both participants are willing... Your repugnant in your ignorance.
Teachers have been fired for less and deservably so.
The world is not a better place for the kind of stewardship you would like to teach someone crawl back in the cave you came out of. If Ignorance was Bliss you would be a blister on the *** of society.
Most all boys are driven by hormones by the time they are 13, and boys will experiment with many forms of se*x, this is the time to keep watch over them, while not interfering with what comes naturally to them, just be there for them when they have questions, let them explore with their peers, and keep adult predators away from them - for the sake of the our children who are on the cusp of entering adulthood. Treat them as we would like to be treated, and most boys will become great men and leaders. It takes conflict and competition to make a great leader, Scouting, and sports will give that to them, and the Marine Corps will to the rest.

So the Boy Scouts are accepting G*A*Y scouts now?

Yeah, and look at all the teenage girls running around looking like WOMEN...I don''t see your point because if I banged one of them I was STILL GO TO JAIL. You sence of perception is warped ! !
*** is humanitarian parole? A 14 year old that admits to having sexxx with an adult but does not consider her his girlfriend. (he probably has to say that to keep from getting ribbed by his friends for screeeewing such a dog) But here''s the deal: this kid is obviously not some innocent--the woman is guilty and should be put in prison, but the kid is illegal and should remain in Mexico--at the very least, when next he decides to "indulge" an adult, we don''t have to let it be an American who is stupid and nasty enough to go with a child.
No way should this kid be allowed back here--if for no other reason than as an illegal--he does not belong here--and if he is illegal, odds are so are his parents. Send them all home, out of work Americans need their former jobs.

Hmmmm yet another fake, psuedo educated troll wannabee-- pretending to be:
A.a woman
B. educated
C. informed
D. a spokesperson for God knows what with his/her head jammed firmly up her/his own azz. LMAO
We, women, don''t believe your tripe, let alone the men and you sound like that other idiot pretend "college professor" who used to post crazy feminist ******* so far fetched and fringed that even ardent feminist cringed in horror.
Give it up--no real college professor would preface their comments with their credentials, their actual verbiage would speak for them--the moment you do that, is the moment you underline that you are a poseur.

Wrong. The day we acquiesce to the system by accepting it and not fighting back (like you appear to suggest) is the day we are made slaves to it--as we all are. Which is why we get tazed, the rich get little to no sentences, and the rest of us can have our rights suspended, be eavesdropped on by anyone and can be shot, killed and police acquitted, even if the entire thing is captured on video.
Regards, indeed.
If you truly are a college prof, I am seriously scared of what comes out of your classroom.

For all the time Nancy Naive has been posting on these boards, her position has been as an ardent Democrat, hater of unnecessary wars and castigator of George Bush. Nancy may be many things, and may have many views you do not agree with--but being a parasitical Republican is not one of them.

There can be no successful intergration into a "Global society" without destroying the American middle class as we know it. In order for equilbrium in globalism to be achieved, we all must make comparable salaries in most countries for the same work. This means that Americans would have to continually lose jobs while companies maximized profits and could not regain those jobs until we make LESS or equal to the other countries--this would then force businesses to reconsider hiring us as we would be cheaper than where they are now. To get to that point, we would have to have a much lower standard of living. The pendulum will always eventually swing back this way. But those who promote "globalism" had best understand capitalism, which is to maximize profit and increase market share (or monopolise it) to do this, the most important tools are war and populations--war to open up new markets and resources, populations to use as workers--the cheapest population wins. Your "globalism" may seem like the wave of the future, but for those of us in the middle class, it spells the beginning of the end of us having a home, cars, etc--because we would end up as servants, to the new rich, and only generations later--would our descendants have a chance to recoup--if at all.

*The Iraq war is not just about oil, it is about grooming potential new consumers and also integrating them into the American hegemony. With the EU and China now being economic powers SUPERIOR to the US, we must either solidify NAFTA AND CAFTA or find new markets to tap. And we WILL tap them--like China and Japan, the west is prepared to invade and force economic partnerships if the countries will not join us willingly. both those countries were told to either trade with us--or have a war. (Perry in early 20th century and the Opium wars with Britain for China in the 1800s)

I really hope that this was your attempt at satire or sarcasm. If it was not, you really need help.
This sort of attitude does a major disservice to women. My daughters are just entering college; they want to be treated as human beings and as equals - not as helpless victims.

I think you should look a little further south where all the conservatives are showing their family values with young boys.
A 26 year old male teacher doinking & running off with his 13 year old female student would get destroyed - regardless of whether or not she was ''into it''. Again, stereotypes, sexism, and inequality are all fine & dandy when it suits their interests....

Do some research. Every state in the south has mandatory sentencing for these creeps that takes them off the sreets for decades. Vermont? Welcome to the land of NAMBLA. Look it up.
All I am trying to get through to you Joe and Janes, is that we need more facts, and should not judge this woman so quickly, as I do not believe we should judge even if she was not a teacher, or for that matter ant=y so called "criminal" of color or so called "illegal" ( how can anyone be illegal just to exist ??).
If you do not believe that young women can be conflicted by MALES in the work place, be it students or fellow staff, or their bosses--- I guess your mind is closed to certain aspects of --- reality, it happens, and we must guard against it, not hide from it. OR as your posts show, get angry !!!

Seems like you need to learn a new lesson or two, Professor. Now shut up and bring me my beer, wench!!!

In a previous post you made reference to this woman as being a "victim," did you not? Perhaps YOU should stop defending her until you have all the facts on the matter. Fair enough?
Posted by HAMILTONgrad
So all the people in jail are the vicitms? What a loser. She and her attorney said she commited criminal acts, being put in jail is a result of those acts.
Just out of college and know it all do you?

First, now that you are out of school get a job and see what reality is really like.
Second, an "illegal" is an abreviation (hamilton did tell you what that is didn''t they?) for illegal alien, you are not illegal for existing, but illegao for going somewhere you are not supposed to go, legally.
Third, yes women and men are both going to encounter compromising situations in life and work where they must do the right thing, or it is wrong and they have to deal with the results. A teacher is held to a higher standard. This lady admitted to commiting illegal acts with a student in her charge. She was caught red-handed and admitted her guilt. We are not judging her on guesses, but on her and her attorney''s testimony. GEt a clue.
yeah....
Toot your own horn much, COLLEGE GRAD? It''s obvious that you need some sort of confirmation for all of your "accomplishments". But, why in the world do you think it necessary to "de-male" boys in order for girls to be valued? Boys simply need to be taught right from wrong, no need to go as far as you suggest. Ridiculous.
I''m not an angry man, I am a woman and find your analysis of this situation as well as your opinion of boys/sports/agression/etc...utterly ridiculous. Believe me when I say, "no anger here, just observation."
