Calif. Man Shot By Police During Fatal Roadside Beating Of Tot

(CBS/AP)  Police on Monday identified a man who was fatally shot by an officer for allegedly refusing to stop beating a toddler to death along a remote road.

Sergio Casian Aguiar, 27, parked his truck on an unlit road Saturday night, removed a 2-year-old boy from his car seat and proceeded to stomp, kick and punch the boy to death, authorities said. The boy was unrecognizable when he was pronounced dead at Emanuel Medical Center, the Stanislaus County Sheriff's Department said.

Authorities have not released the boy's name but say they believe he was Aguiar's son. The Stanislaus County coroner and the California Department of Justice are testing DNA to confirm the relationship.

Several motorists called 911 and tried to stop the beating, authorities said.

Dan Robinson, a local volunteer fire department chief, told The Modesto Bee that at first glance, he thought the child was a dead animal in the road. He said when he realized it was a child, he tried to stop Aguilar.

He said Aguiar had a "total hollowness in his eyes" and talked calmly of the boy being filled with "demons."

Witness Lisa Mota told the San Francisco Chronicle that Aguiar told people who tried to stop him that the boy was "trash."

Responding to 911 calls, a Stanislaus County Sheriff's Department helicopter landed in a dairy pasture near the scene. A Modesto police officer, Jerry Ramar, fatally shot Aguiar after he failed to heed the officer's warning to stop beating the child, authorities said. Aguiar flashed his middle finger at Ramar before Ramar shot him in the forehead, police said.

"I have never seen anything like that before and I hope I never have to again," Ramar said of the beating.

The San Francisco Chronicle reports that Aguiar's wife Frances had recently separated from her husband and was in Southern California when her son was killed. She lives in a modest apartment in Turlock. A bicycle, tricycle and a toy car sat outside Monday. No one was home.

Aguiar had no previous criminal history, police said. It is not known whether drugs or alcohol played a role in the beating. Results from toxicology tests on both Aguiar and the boy will be available in four weeks.

The Chronicle reports that Aguiar worked at the 24-hour FoodMaxx in Turlock, where a company spokesman described him as a good employee whose co-workers were traumatized by what happened.

At the Mulberry Mobile Park, where Aguiar, his wife and his son lived in a trailer for a few years before moving last year, manager Ronda Donner said she was "blown away."

"Nice, no trouble. Their rent was always paid on time," Donner told the newspaper while pruning trees on the property, where mobile homes encircle a parched island of grass. "I'm still kind of shocked. He didn't seem like that kind of person."

Officer Ramar has been placed on paid administrative leave, a routine response for officer-involved shootings.

Ramar told The Modesto Bee any officer would have done what he did.

"I'm just a regular cop trying to do a regular cop's job," he said.

First, the officer who shot this scum of the earth is a hero and an excellent shot! I am glad we did not have to waste time or money with the legal system.

My heart weeps for this poor defenseless, innocent baby who never ever deserved this. I am very appalled by the WITNESSES! People if you are not going to step up and do something you might as well have left the scene, why stand around and watch?!!! That is sick! People need to start preparing themselves for running into a psychos like this. There is pepper spray, a purse, a shoe, your car, something, people. If no one will step up to help an innocent, defenseless baby who will step up for you if you are being viciously attacked by some psycho on the street??? Unfortunately, there are way too many of them out there.

This is to the women and mother''s out there who are in a relationship with an abusive man. You need to take your children and get away from him sooner rather than later! Leave without warning! Do your very best to make sure a abusive partner or father is never unsupervised with the children. Get support to make this happen. There is help out there. Put your childrens safety first! If you don''t do it, no one else will!!!

People, THIS SITUATION that the motorists encountered is the reason EVERYONE DECENT should be ARMED TO THE TEETH and trained to use their weapons. If anyone had had a gun ready, the killer could have been STOPPED IN HIS EVIL TRACKS.

THINK about what you just wrote. This man was a "good worker" had no record and paid his rent on time--he would have been one of the decent people armed to the teeth. In that case, he could have just emptied his decent gun into his own kid instead of stomping him to death. The fact is--there is no such thing as violence and decency and guns meeting up. Because it takes a certain level of decency being suspended to kill another person, period. (not that it is not sometimes necessary to do that).

The best ending to this story would have been that the guy was captured by the police, sent to prison, and announced over the intercom to his fellow inmates why he was there!!!

I would have paid $10,000 to watch on pay-per-view!!!

sorry, the best ending for this was not that the man lived so you and people like you could watch him being gang raped in prison--the best ending would have been if the boy had survived this horrible beating--the next best has happened--that the perp was killed--so that he can never, ever do this again to anyone.

Got news for you--in prison, some of the child beaters and child molesters (if brutal and evil enough) are also some of the main rapists and beaters of others in prison--they don''t all get turned or preyed upon--if this man had lived--he could very well have ended up in prison in a Hispanic gang, terrorizing, raping and beating other prisoners--on our dime.

Nice. Good worker. Paid the rent on time. Yep. As we all know, folks who do their work and pay their rent on time just don''t ever do anything "criminal". (sarcasm). Oh there were demons alright--and they were in this man and Ramar shot him and put him and his demons out of their misery. This was a horrible story. That poor, poor child--Lord only knows how many times he may have endured "beatings" before this. Before his so called dad tried to take him and the beatings to this level.

Your emotions and morals are admirable, but without knowing all the facts of the case i do not believe we should pass judgement on these people. It said that the man had pushed them away when they tried to stop him. A person who is out of their mind mentally or because of drugs has super human strength. I had a 125 pound girl break my wrist while i was arrestig her and i was twice her size. It is hard to imagine what they can do. O also had a partner with me as big as me. We arrested her then it took six officers to put her in a cell. She was high on crack.

I did find what i was looking for in Budhism and have been shown more than once it is real. One thing that i really liked is the Thai people never push their religion on anyone. They live their beliefs daily. They are a very polite and kind people. It is a very rare instance to see a Thai show anger about anything. They believe that how you live your life, good or bad will come back to you tenfold. I have seen it happen already. Turning to the Budhist faith has made me a better person almost over night. I am a novice and have much to learn but i am spiritually at peace now. I have had so many wonderful experiences living here in Thailand. I must return to the U.S.
