Vito J. Fossella, who represents Staten Island and parts of Brooklyn, was arrested some time between midnight and 2 a.m., said Lt. Ray Hazel, spokesman for the Alexandria Police Department.
He was charged with driving while intoxicated as a first offense, Hazel said, which under Virginia law requires a blood-alcohol level of 0.08 percent or higher.
In a statement Thursday, Fossella apologized for his conduct.
"Last night I made an error in judgment," Fossella said. "As a parent, I know that taking even one drink of alcohol before getting behind the wheel of a car is wrong. I apologize to my family and the constituents of the 13th Congressional District for embarrassing them, as well as myself."
Hazel said he could provide no further details on the arrest, including Fossella's exact blood-alcohol level or where in the city he was arrested.
Fossella, 43, is the lone Republican member of the New York City congressional delegation.
He faced a surprisingly strong re-election challenge in 2006 and is bracing for a similar fight this year. His candidacy has drawn the support from national Republican leadership in recent weeks, including Vice President Dick Cheney.

- The biggest problem is that the average American wants change--but does not want to fight for it or work for it or sacrifice for it--they keep waiting for one man or one party to give it to them. That is like holding your breath under water and waiting for the Oxygen already there to make itself available to you.

Our government is getting closer and closer to eliminating the average citizen from politics altogether! They have come to the point where they (politicians) function to serve only THEMSELVES and their personal agenda''s and, no longer serve the best interests of our people or our nation as a whole. Let them keep going that direction and see how quickly a revolution springs-up. - Reply to this comment
- THIS, I agree with. It is NOT just Republicans OR just Democrats that embarrass us all ... it is ALL OF THEM! Our current party system sucks and we need to abandon it for something more effective and sincere!

Meanwhile, in April alone, 3 Democratic government officials have admitted to adultery which is still illegal in some states and immoral in all states. No halos there. If they get the mantle of power back as completely as the GOP had it since 1994, the Dems are sure to be just as corrupt, greedy and nasty--the writing is already on the wall.
Maybe one of the criteria for seriousness and really having only the public interest at heart, all men would agree to chemical castration or if a career politician to becoming eunuchs--at least then, their penizzes would not be the "root" of about 75% of the Government discrepancies--and that is cutting across both parties ala Vitter, Gingrich,Craig, Foley Spitzer and Kwame... - Reply to this comment
- Not embarrassing them; ENDANGERING them and yourself with your actions. Our congressmen ***, take bribes, lie, steal commit adultry and drive drunk--we keep lowering the bar and dismissing the proof before our eyes and then wonder why we only have roaches for government. The bar is too low for any upright citizen to walk under--only the vermin and roaches can squeeze under it now.

- Bill and Hillary BOTH are an embarrassment to our nation! First they have Vince Foster murdered, then they tried to steal half of the White House on their way OUT and tried to convince everyone that they really thought it would be okay for them to take MILLIONS of dollars worth of artifacts and furnishings to decorate their own home. LOLOLOLOL ... and YOU freaky libs think SHE is best to lead our country? MAN, what will they try to steal THIS TIME if she wins? A few F-18''s, an aircraft carrier and a few nukes?????

SHUT-UP STUPID! He admitted he was wrong, he apologized and is "taking his medicine"! Like YOU never drank and drove at any point in your life ... gimme a break!
By the way, the ONLY politicians I see getting away with MURDER are Bill and Hillary Clinton. Just ask Vince Foster! Oh, that''s right ... you can''t because Bill and Hillary had him OFFED right before he was scheduled to turn states evidence on them during the "Whitewater" scandal! Remember ... he had a .38 bullet hole in the BACK of his head, a .22 pistol in his hand and supposedly committed suicide! YEAH, RIGHT! Convenient though how everyone seems to have forgotten all of that. I DIDN''T though! - Reply to this comment
- This guy fesses up to making a bad decision, does not claim any special privileges, or that he was innocent, and all most of you can do is bash him. I must admit, this shouldn%u2019t be news outside of N/Y.

My response: I respectfully disagree with you that this shouldn''t be news outside of N.Y..
It SHOULD by virtue of the fact that he''s an elected public servant to the national government, AND supposedly cognizant and more responsible than the average citizen. Clearly, in his case, this is NOT true!
I belief anytime a politician is caught breaking the law, his party ought to be listed right up front in the first line with his name---regardless of party!
The citizenry has the right to know. - Reply to this comment

- Remember what happened to Rep. Kennedy when he was stopped for multiple violations in the wee hours of the morning. His claim was that he had to make a vote. Drunks need to be punished regardless of party.

- While DUI enforcement is extremely important and arrests are necessary, the publishing of the names of just the politicians, movie stars, sports stars is unfair. If you are going to single out, just the headliners and attempt to smear their character, you should be fair and publish a record of all people arrested for the same thing. You probably would be shocked to see how many regular, rich and influential business people "and" their wives, kids and relatives are also arrested but don''t get published for the world to see. People make mistakes and in cases where no accident or injuries occur, most get probabtion after school and fees are paid. Be fair to all people in how this is published.

- Typical NAZI! With ALL the corruption and ALL the failure of the Republican Party over the last 8 years this LOSER attack''''s CBS for noting the fact that THIS criminal is a Republican? Has it EVER occured to you freaks that what you need to do is CLEAN up your PARTY and not trying to control the free press! Sieg Heil Bush

I believe he was referring to the fact that CBS will post the party affiliation of Repubs in the first sentence, however when a demo is caught, the party affiliation is either buried deep in the story or not given at all.

- Its good that Rep. Fossella has the support of the DC Madame''s reported customer, Richard Cheney...Will Ms. Palfrey''s other reported customers step forward to support him?--Come on Juan McWar!...bet you are going to have to sleep with one eye!
Unlike other Republicans, at least he wasn''t out toe tapping, or cheating on his wife, or dressed up like a woman as Giuliani liked to do...or trying to pick up House pages... - Reply to this comment
- In this story the second word mentions the party affiliation of this smuck .... in any report that has a democrat is takes at least the third paragraph, if at all, to discover ...
