Woman Charged In Husband's Kinky Sex Death

She Covered Hubby's Mouth, Eyes With Duct Tape, Left Him Alone For 20 Hours, He Asphyxiated

(CBS/AP)  A Maury County woman has been charged with reckless homicide for what her attorney says was the accidental asphyxiation of her husband after he consented to be bound and gagged.

"The whole family is upset with what occurred," Samuel Patterson, an attorney representing 25-year-old Rebecca Bargy, told Columbia newspaper The Daily Herald. "We stand by the fact that this was an accident."

According to the arrest warrant, Rebecca Bargy placed duct tape over James Bargy's mouth and eyes, put a ball gag in his mouth and then tied a bandage around his head, leaving only his nostrils showing.

She also tied his hands and legs behind his back. She then left him for 20 hours.

"Apparently, this was not the first time it had happened," Maury County Sheriff's Detective Anthony Bailey said of the bondage.

Authorities found the 29-year-old's body around 4 p.m. Saturday. Rebecca Bargy faces up to 12 years in prison if found guilty.

"The proof will show that James consented to this being done to him and that he was an active participant," Patterson said.

But detectives told Nashville television station WTVF Rebecca Bargy was having an affair with another man.

Mona Phillips, Rebecca Bargy's mother, said it was an accident, but his sister thinks it was intentional.

Police think they know where Rebecca was during the 20 hours she left her bound husband alone and it may change the way they prosecute the case.

Detectives said she stayed with another man in a local motel at least two days last week. Bargy met him online and bought his airline ticket from California.

Detectives said she left briefly and returned home to see her husband.

Phillips said her daughter and son-in-law did what they wanted.

"They came and went as they pleased. It's pretty much what they did. Always been that way," Phillips said.

James Bargy's sister, Lisa Brady, wrote in an e-mail to WTVF, "Rebecca has repeatedly engaged in extramarital affairs over the last few months. She made sure she got him out of the way so she could have her single life again."

Rebecca Bargy has a bond hearing set for 8:30 a.m. Wednesday in Mt. Pleasant. She has pleaded not guilty to the charges.

If convicted for reckless homicide, Bargy could be sentenced to two to 12 years in prison, according to CBS News affiliate WTVF in Nashville, Tenn.

But the district attorney could upgrade the charge to murder.

Police questioned the man Bargy met stayed with at a Columbia motel. He was not charged with any crime. She is held without bond at the Maury County Jail. She will appear before a judge later this week.

If this was a consensual act and a part of a BDSM lifestyle then it was merely an accident. One that people within the BDSM lifestyle are very aware of and go to great lengths to avoid. Accidents do happen though, that is a fact of life. There are principals within the BDSM community that are followed to prevent these accidents. Oh please. Here we go again, given a little bit of information some of you condemn an entire family because of slanted press coverage. This happens more than anyone KNOWS about, and as long as the couple agreed upon the ground rules, then it''s none of our business. I''m sure the husband endorsed the extramarital hijinks and fantasized about what was going on while being tied up and "powerless" to stop what was going on. You guys need to grow up and think outside your own narrow little boxed up worlds.

The moral of the story - never consent to being tied up. Once you do, you are powerless and have placed your fate in the hands of another person, who may or may not have your interests at heart. You can have plenty of fun without being tied up. Always keep your own fate in your own hands, always be able to say "That''s it - I''ve had enough." Always be able to walk away.

to...tonysprout...if the situation were reversed, the news would be different, rather than death by a kinky act. it would outright murder. you need to know that the way the public sees the death of a man during a consensual act and the death of a woman under the very same circumstances are quite different. regardless, the man was willing, the wife should not be charged.

If the situation were reversed how many slimy comments would we see here? No, there''s be anger and comments about stringing up some man who could be so uncaring and unfeeling. Why, he''d be labeled a monster and we''d see comments about how he needed some dispicable act comitted upon his person. People need to grow up. A man is dead and his monster of a wife caused it. BTW, HOMICIDE is not always murder. Homicide is defined as a death caused by a human, accidental or otherwise.

This man and woman were in a consensual *** act, where the man got off knowing his wife was out getting pounded by another man. It is a classic form of cuckolding that dates back to long before television existed. The act of being left alone for 20 hours is part of the pleasure for the man, the fact that he died accidentally is a casualty that could have been avoided, but surely it does not constitute murder or homicide in any form. This woman most probably is already devstated that he is dead, for she now loses a perfectly willing and happy play partner.
