Her father, Larry Birkhead, and Smith's executor, Harry K. Stern, will be co-trustees.
Superior Court Judge Mitchell Beckloff granted a petition filed by Stern, who wanted to clarify Smith's intentions toward her daughter. Smith drafted a will in 2001 - five years before the child was born - that left her estate to her then only child, Daniel. However, it said the assets in Daniel's trust should be shared equally if she had future children.

- Money doesn''t buy happiness, in fact, Anna Nicole and H J Marshall''s son (may they both rest in peace) spent over ten years of their lives fighting for money that neither will ever get to spend or enjoy. I hope that the love of money does not rule this childs life, and the lives of those who are entrusted with her care. There is nothing that takes the place of love, God, family and friends. I hope that the lesson this little girl learns, and lives is that one.

If the marriage is legal, and if the will by J. Howard Marshall is legally written, I don''t see why the relatives have to fight the will. Get over that kind of hatred. If J. M. Marshall was willing to marry Anna Nicole and put her in the will, that''s his wish. Why can''t that marriage be treated just like any other marriage.
