Law That Put 17-Year-Old In Prison For 10 Years Is Being Challenged

(AP)  In 2003, 17-year-old Genarlow Wilson was an honors student, standout athlete and homecoming king preparing for his SATs with an eye toward college. But that all changed after a New Year's Eve party involving alcohol, marijuana and sex.

Wilson, now 21, is serving 10 years without the possibility of parole after a jury found him guilty of aggravated child molestation for having consensual oral sex with a 15-year-old girl that night. He was charged with rape for being one of several male partygoers to have sex with a 17-year-old girl, but was acquitted.

Wilson's sentence has been widely criticized, even by members of the jury that convicted him and the author of the 1995 law that put him behind bars.

"The law was designed to protect kids against really, really bad people doing very bad things," said the sponsor, former state Rep. Matt Towery, a Republican. "It was never intended to put kids in jail for oral sex."

On Wednesday, Wilson's legal team will again try to free their client as a Monroe County Court hears a claim that Wilson's constitutional rights are being violated.

The lawyers will argue that his legal counsel during his 2005 trial was ineffective. Among other things, his lawyer did not subpoena the 15-year-old to testify. The petition also argues that the sentence was grossly disproportionate.

We agree that there is corruption throughout the system. And, as you point out, it is exacerbated by greed. We have the finest representation money can buy. And, if you can't afford it, you don't get it.

Feminists used the money Bill Clinton & a GOP controlled congress gave them to influence legislation through direct bribery ("campaign contributions"). And, also by financing professionals to produce phony statistics to support their phony claims that all men victimize all women. (admittedly the same method used by the NRA, ABA, AMA and all other organizations)

The only solution is to repeal laws that criminalize normal, routine sexual behavior between consenting individuals of similar ages.

I have no problem with prosecuting predators, but many of these cases, such as this one, do not involve predators, they involve young adults engaged in normal human relationships.

BTW, I have been to feminist meetings, including N.O.W. gatherings. "Shrieking, hysterical lesbians" is a literal description of many members of those organizations.

At one time, many years ago, I was personal friends with the state president of the Texas Chapter of N.O.W. We had great times together and never agreed on anything other than all politicians suck. She was not a lesbian, was not hysterical, nor did she shriek. Which was really diappointing given my neanderthal attitude towards women.

This is not a conspiracy by feminist groups A.K.A. lesbians to emasculate men through arbitrary and capricious laws, and as a former lobbyist you are well aware of how the political system works, "money".

Maybe if society re-socialize it's antiquated logic, "boys-will-be-boys" nonsense and start making men more responsible for their actions, these sort of frivolous cases wouldn't occur.

At one time, I was a political activist (aka "lobbyist"), concentrating primarily on family issues.

And, I have seen firsthand the horrendous damage feminists have done to the legal system. This is just one tiny case that came to light. There are literally millions of similar cases that do not make the headlines.

Hysterical, shrieking lesbians have corrupted the legal system beyond all usefulness. Having said that, they are actively assisted by self-serving politicians, many of whom are "family" lawyers, and/or heavily invested in private prisons or other enterprises that profit from malicious, unnecessary prosecution.

But, without the support of shrieking, hysterical lesbians, self-serving lawyers and politicians would have a much more difficult time justifying new laws, or the harsher sentencing that keeps the money rolling in. Most of it from unsuspecting tazpayers being fleeced by these unnecessary laws & sentences.

Feminists routinely characterize males as "men" regardless how old they are. And, they routinely characterize females as "children" when it is convenient.

Feminists are a greater menace to society than plague infested rodents.

You're wrong! I live in Atlanta and that's not the way it is. His sentence had nothing to do with his color. When are you "woe is me" blacks EVER going to grow up and quit blaming "whitey" for just upholding the law? Does EVERYTHING with you people have to have a racial component?

The law has been changed and his lawyer is arguing for his release....which will likely and rightfully happen.

You are correct and I apologize for misrepresenting my view of these boys. In this case these "boys" deserve what they got and more. The boys were in a position of higher stature because of their age and they should be punished for abusing the young girls. They video taped the acts and that is horrible. IMO, the boys deserve punishment for child porn.

My view of the girls remains. ***, ******, prostitutes whatever word you choose for them. Any female that will consent to performing oral s*x or intercourse with a boy or multiple boys (in this case) in a public setting is no better than a common ***. IMO of course.

Go to clubs, open new ones, create accessible venues, use your local business' ad budgets to sponsor live music, like jazz, for example, by live musicians, buy their CD/DVDs, give real artists the stage upon which to develop, put music education back in the schools, prepare talented kids for the multi billion dollar music market.

Neither one of these kids should have been at that party. The kids had alcohol and drugs. That being the case why was the girl not charged with underage drinking and drug use? Or for that matter, why were the parents not charged for the actions of there children at that party. I am about an hour south from where this happened and I can not stand that this has blown up this bad. Depending on the month of birth these two are less than 2 years apart in age. I wish him the best. BTW, I am a white male and I condemn the treatment this young man has gotten at the hands of my state judical system.

All statutory rape laws should be repealed.

Statutory rape laws rely on politicians establishing arbitrary ages of consent which are unrelated to anything.

Which means that the same act can be considered a crime by virtue of the hands on a clock. Rape before midnight, lawful sexual relations after midnight. Which is ridiculous on the face of it.

If statutory rape laws were repealed, resources would not be wasted on prosecuting cases such as this.

We have better uses for our prisons than giving a temporary home to some minors with raging hormones. This boy and girl were young doing something with no discretion or shame. The video capturing of this event and exhibition proved they have to grow up and learn some adult manners. They won't learn that in prison. I am afraid the prosecutor made pop-culture icons out of these minors. They may not have a future pursuing higher education with a prison record. I think the District Attorney is shooting at the wrong end of the problem. I do agree that teenage s*xuality is becoming too iconized in pop-culture, but much of the glamor originates right there in Atlanta on the broadcast networks and recording studios. I say the DA should pursuade the community to increase tax rates for studios that are known to promote public lewdness, and redistribute the funds to a s*x education program that teaches teens how to be smarter about managing their hormones.

How about this: This videotape could be considered "Child Pronography". That would be a felony and would send all those teenagers to prison for a long time. I understand teenagers get things on, but to video tape it and to be doing that in public, just ain't right. It appears that there were 5 or so boys and 2 young ****** involved.

Someone mentioned this being similar to the Duke LaCrosse case. The two cases are not even remotely similar. In the Georgia case there is videotape evidence of the act happening and in the Duke case there is overwhelming evidence that the girl was lying.

skyk, I was born and raised in the south, (south Louisiana and you can't get much more southern than that)and still live in the community where I was born. It may be because I'm somewhat educated, but most of the people I know are not racist. Sorry, not all southerners are. Maybe where you live, but not around here.

And a 17 yo, regardless of race, which according to modern anthropologists is a farce, getting blown consensually by a 15 yo shouldn't send any kid to prison for 10 years. That dog jus' don't hunt.
