Legal papers filed last week in Superior Court by Ronald and Joan Linclau said the construction weakened a hillside and left their deck and pool in danger of collapse.

DiCaprio "failed to exercise ordinary care ... in making the excavations and failed to take reasonable precautions to sustain the adjoining land ... in its natural state," the suit claimed.
A DiCaprio spokesman, Ken Sunshine, said the lawsuit "is totally without merit."
The lawsuit claimed DiCaprio ignored warnings that he was trespassing on the property, located in the hills above Sunset Boulevard.

- Honestly, I believe the lawsuit is without merit. In order to excavate the land for a basketball court, a survey would have to have been done and an excavation team would have had to be hired - all who have legal guidelines to follow and permits to file before any work can be done. If there was potential danger of risking the stability of the neighboring property, or if the basketball court was even just encroaching on the neigboring property, the location of the court would have had to be moved.
I'm all for actors having to act responsibly and with courtesy to neighbors - just as any other adult should - but sometimes people are just out for their fiteen minutes and a quick buck because they see a rich or famous neighbor and feel they can make a bogus claim - with hopes to settle out of court. - Reply to this comment
