Governor Tightens State Law That Allowed Virginia Tech Shooter To Obtain Guns

(AP)  Virginia's governor on Monday closed the loophole in state law that allowed the Virginia Tech gunman to pass a federal background check and buy the weapons used in the massacre.

Gov. Timothy M. Kaine issued an executive order requiring that a database of people banned from buying guns include anyone who is found to be dangerous and ordered to undergo involuntary mental health treatment.

Seung-Hui Cho had been ordered to undergo psychiatric counseling after a judge ruled that he was a danger to himself.

But because Cho was treated as an outpatient and never committed to a mental health hospital, the court's decision was not entered into the database that gun dealers must check before selling a weapon.

The database "should include any determination that someone is mentally ill and so dangerous to himself or others as to warrant involuntary treatment," Kaine said in a statement.

Cho, a 23-year-old Virginia Tech senior described as a troubled loner, bought his guns legally through gun shops. He gunned down 32 people in a residence hall and a classroom building before killing himself.

No motive has been established for his rampage.

You are wrong. If the second amendment was meant for the states, it would have said "...the right of the STATES to keep and bear arms, shall not be infringed." The PEOPLE are the militia. Any citizen from 17 to 45 who is able to handle a gun safely and properly are members of the militia of the United States of America. There are over 60,000,000 law-abiding gun owners in the U.S. with over 250,000,000 guns. We will not be giving up our rights and our homeland security very easily.

It's not as simple as you want it to be. Blaming guns for crime is like blaming cars for drunk drivers. Actually, I believe Scotland and England may now be more violent than America. Now I want them special interest groups to read it. I am sick of them work place,school, and the like shootings.. They must stop. The money,black market.gun dealers,NRA. No we don't disarm the ones that use them right. Get the guns out of the wrong hands. Any law abiding American is not going to go postal I think the term is.

I don%u2019t want the criminally minded, the unstable people, or the mentally ill to have access to guns.

If the gun control advocates would simply come out and recognize the 2nd amendment, they would find the NRA and gun owners in general very supportive of laws aimed at preventing the people above from getting guns.

But when the leading gun control advocates deny the 2nd amendment, and openly admit they are using gun control laws to destroy private gun ownership, does it come as any surprise that the NRA and gun owners in general don%u2019t rush in to help?

I have read it. Anyone with computer with net access can read it. What I am saying that non americans must not have arms, kids, persons not FIT not have arms. With the right to bear and hold arms means you know how to use it ,clean it,store it when not in use,BE able to use it right. If not they have no business bearing arms.Iknow us people have RIGHT to bear arms. Would you want some person going into a rage to have the right to bear arms. No. They go into a tizzy and quietly plan their mess,carry it out, and WE the people have to clean it up. The families want the whys. They will not know the whys. That is not right. Cho did it. He had no right to bear arms.

Second, the second amendment does not limit arms to me, it merely states the overall rational behind the right. It says %u201Cthe right of the people to keep and bear Arms%u201D

What it does not say:

If the intent of this right was not for %u2018the people%u2019 the framers had an entire dictionary of other words to choose, but they said %u2018the people%u2019. Please find me one other usage of the phrase %u2018the people%u2019 in the constitution/bill of rights that does not actually apply to the people.

But who is the militia? According to federal law Title 10 U.S.C. 311. Militia: composition and classes:

The militia is not simply the national guard! If you read the second half of 311. Militia: composition and classes:

(b) The classes of the militia are%u2014
(1) the organized militia, which consists of the National Guard

Naval Militia.

As to the constitutional issue reguarding the second ammendment: the right to bear arms is given to the people. If you read people to mean state the individuals have very few rights in the Bill of Rights, as an example individuals would not have the right to not be unreasonably searched; ie no more search warrants would be necessary exept when searching state or federal property. You can't have people mean the state in one right and public in another, you have to decide which people you want to have the rights.

Now I know this is a hot issue. There are people who can step upto the plate and handle their fire arms.By all meams should. With that gun comes knowing how to use it right,store it, keeping it out of the hands that ought not bear it and the like. I don't think it right that the cops can walk right in when we are law a biding folk. We need to keep guns out of the hands those who have no business in the first place to bear them. It is a right. Not for those for reasons set in the gun control laws as they never had that and or loss that right.

Then LEAVE!!! If you are that unhappy here by all means, leave. Australia and Great Britian and Canada ALL have fewer guns than us. Their assault rate is higher, too! But they have fewer gun deaths!Once the citizens were stripped of their firearms the criminals KNEW they would be safer during their robbing, raping and killing!
