NYC Mayor: Killing Of Groom 'Unacceptable'

(AP)  Mayor Michael Bloomberg weighed in on the uproar over a deadly police shooting, saying bluntly that officers appeared to use excessive force when they fired 50 shots at an unarmed man in a confrontation outside a strip club hours before his wedding.

"I can tell you that it is to me unacceptable or inexplicable how you can have 50-odd shots fired, but that's up to the investigation to find out what really happened," Bloomberg said at a news conference Monday after meeting with elected officials and community leaders including the Rev. Al Sharpton and Rep. Charles Rangel.

The groom, Sean Bell, 23, was killed and two of his friends wounded early Saturday after a bachelor party at the strip club. Suspecting that one of the men had a gun, police fired 50 rounds into the vehicle. The men were unarmed.

"There is no evidence that they were doing anything wrong," Bloomberg said.

Sharpton called Monday's meeting "very candid." He said the message to Bloomberg was: "This city must show moral outrage that 50 shots were fired on three unarmed men." Some have also questioned whether the shooting was racially motivated because the victims were all black men. The five officers who fired their guns included two blacks, two whites and one Hispanic.

For a mayor to question the actions of the officers and defend the shooting victims — while reaching out immediately to the grieving community — sets a decidedly different tone than in the past. Former Mayor Rudy Giuliani was hounded for what some viewed as a slow response to the killing of Amadou Diallo, an unarmed West African immigrant who was shot 19 times in the Bronx by four white officers. They were later acquitted of criminal charges.

The gunfire in the current case stemmed from an undercover operation inside the Kalua Cabaret, where seven officers in plain clothes were investigating alleged prostitution and drug use.

Police Commissioner Raymond Kelly has said the groom was involved in an argument outside the club after 4 a.m., and one of his friends made a reference to a gun. An undercover officer walked closely behind Bell and his friends as they headed for their car. As he walked toward the front of the vehicle, they drove forward — striking him and an undercover police vehicle, Kelly said.

The officer who had followed the group on foot was apparently the first to open fire, Kelly said. One 12-year veteran fired his weapon 31 times, emptying two full magazines, Kelly said.

Bloomberg also said police appeared to have violated the policy stating that officers cannot shoot at a vehicle being used as a weapon if no other deadly force is involved.

But Bloomberg was steadfast in his support for Kelly, who has been denounced by some activists since the shooting.

The five officers were placed on paid administrative leave and were stripped of their guns during the investigation.

Michael Palladino, president of the Detectives' Endowment Association, defended the officers' actions and said police were responding to the threat of the car.

"The amount of shots fired does not spell out excessive to me," Palladino said.

Giuliani's response to the 1999 Diallo killing sparked protests nearly every day for weeks around City Hall, where demonstrators accused his administration of trampling the civil rights of blacks and Latinos.

Bloomberg's allies these days include some who were once at odds with Giuliani. Sharpton acknowledged that the tone has changed, but said courtesy only goes so far.

"This man has better manners than his predecessor. Let's see if we have better policy ... because we're not just interested in being treated politely," Sharpton said. "We're interested in being treated fairly and rightly."

Bloomberg told reporters he did not believe the shooting was racially motivated but said "it's clear that people in this city do feel that they are sometimes stopped, frisked, whatever, based on their ethnicity," and he said his administration would work to prevent that.

The mayor planned to meet with the victim's family as soon as it was appropriate, and said he would also visit the community in Queens.

Bell's fiancee, Nicole Paultre, made a quiet visit to the shooting site before dawn Monday, lighting candles clustered around a photograph of the smiling couple with one of their daughters.

The survivors were Joseph Guzman, 31, who was shot at least 11 times, and Trent Benefield, 23, who was hit three times. Guzman was in critical condition and Benefield in stable condition Monday.

Something that continues to stick out is that the man was ARMED. He didn't have a gun but he was sitting in his deadly weapon and he had his hands on the controls of it and, figuratively speaking, he had already fired "two shots" from it.

This is what will happen over the next two years. If the grand jury decides to send the case to a trial, the trial jury will be led to see the whole incident through the eyes of the trained officers and that is as it should be since they will be judging if the officers reacted in a reasonable manner to the circumstances as the officers perceived them. The officers will be found not guilty by a jury of their peers and NYC will have its own version of the Rodney King riots.

In response to the riots, political leaders and candidates will call for the federal government to step in and twice put these officers in jeopardy of life and limb in violation of their Constitutional rights. We'll hear calls to bring these men to justice or in other words, "screw the trial, somebody get a rope and make sure they photograph me from my good side when I put the noose on the first guy's neck."

Want to prove me wrong? Don't throw a riot...

Since most of us would not want that job and cannot imagine what is like to take our lives into our own hands everytime we go to work, we must stand behind their decisions until there is a legitimate reason not to. Let us get all the information on this case before we condemn. ...

go on the street as a police officer/sheriff deputy, be faced with this situation... then comment.

I find it very suspect for this undercover officer to have all this time to stop them before they even got to the vehicle and to identify himself, but still decided to wait untill these 3 unarmed men pulled off and tryed to stop them then.

Im pretty sure the 3 men inside the vehicles did not know it was undercover officers on the scene before trying to get away. The officers created this situation after placing there van in a position to use some tactic to stop them from getting away causing the car to collide.

I believe this cop was itching to shoot off his gun after having 2 drinks and his adrenaline was rushing. I feel that he wanted to escalate something out of nothing and thats why this whole situation turned deadly.

The cop couldve easily down played the whole situation before it got to the point where he had to pull out his weapon.

I really dont feel that there will be justice because cops always get away with murder. It happens time after time.

I dont believe this was racially motivated.

And i really feel sorry for what his family has to deal with for the rest of there lives and his 2 kids having to grow up with no father now. God bless his soul!

People have to really value your lives now days cus youll never know when your going to lose your life for some nonsense.

There is no doubt in my mind that the police involved used excessive force. Moreover, they violated police rules against firing at a vehicle, when no weapons were visible, or being used. These two things alone should insure that part if not all of these officers are guilty of murder. and should be charged with such.

As for the family of the young man killed, I would like to express my condolances, and hope that they can someday again find peace in their hearts.

This is a terrible tragedy, that should have never happened. Hopefully the city officals of New York will realize the terrible anguish that people in their employment have caused, and make ever effort to help this mother, and the children of this slain young man in every way possible.
