It says Federline wants more than $30 million from Spears, along with custody of the couple's two young children, Sean Preston, 1, and Jayden James, 8 weeks. The newspaper also reports that Federline has been offered $50 million for the tape by one film company that wants to put the video online.
The tabloid says Spears fears release of the tape would short-circuit the comeback she's attempting to stage.
But on The Early Show Tuesday, Us Weekly magazine's contributing editor Katrina Szish said Spears probably needn't worry.
"If a tape does exist, I don't think it will be damaging for Britney," Szish told co-anchor Rene Syler. "We've seen her at her lowest point. She's on her way back up. This would be a tape she did with her husband when they were married. Whatever may be in that tape, it really doesn't matter anymore.
"At this point, (the existence of the tape is) pure speculation … It's completely hearsay, so we can't necessarily yet say that Kevin is doing anything wrong."
And if Federline is indeed using such a tape the way the tabloid says he is, it is likely to backfire, Szish said, adding: "If this sex tape is real, if it does exist, if he is trying to demand money for it, that would certainly hurt his chances (with a judge) of getting sole custody (of the children). So, I do think it's probably unlikely that the sex tape does exist."
Separately, a judge in Los Angles last week threw out a Spears lawsuit against Us Weekly, ruling the pop star cannot be defamed by the magazine publishing rumors that she and Federline had made a sex tape and were worried about its release.
Superior Court Judge Lisa Hart Cole said Spears has "put her modern sexuality squarely, and profitably, before the public eye" and it would be unlikely for the magazine article to be found defamatory.
The judge's decision to dismiss the $10 million lawsuit filed last year did not address whether the October 2005 story was true or false.
"The issue is whether it is defamatory to state that a husband and wife taped themselves engaging in consensual sex," Cole wrote in the decision issued last week. "The backdrop against which this issue must be addressed is that the plaintiff has publicly portrayed herself in a sexual way in her performances, in published photographs and in a reality show."
Spears' lawyer, Martin Singer, did not return a call Monday seeking comment.
Us said in a statement it stood by its reporting and was pleased with the decision.
The lawsuit stemmed from an article published Oct. 17, 2005, in the magazine's "Hot Stuff" column under the headline, "Brit & Kev: Secret Sex Tape? New parents have a new worry: racy footage from 2004."
It claimed Spears and Federline feared the release of a secret sex tape, which they had viewed with their estate planning lawyers. The article said that Spears gave a copy of the tape to lawyers and she and Federline were "acting goofy the whole time" while watching the video.
"There was no laughter, disgust or goofy behavior while watching the video in the company of lawyers because they did not watch any video, and because there is no such video," the lawsuit said.
Spears sued after Us refused to issue a retraction.

See all 61 CommentsI will never understand people allowing themselves to be video-taped having *** - married or not, celebrity or not - that threat would always be out there. Dumb! Dumb! Dumb!

Exactly, Why would he ask her for $30 mil when he could get $50 mil for the tape? What she should do is leak it out and kill that opportunity for him to make anything off of it, Then take him to the cleaners with that pre-nup, leaving him the only option, get back with Shar. Kevin's album sucks too, heard a sample on the radio morning show and they were laughing about how he talks about all this designer stuff he got on his own. Like he could afford a ferrari before he met her. LOL
i want to know what grounds kev has for requesting custoday. are they legit? anybody?
This putrid *** should go play golf with O.J. Simpson or something. People should feel nothing but disgust and derision for a eunuch of his low caliber.
Selah
Such immaturity--he's a human FUNGUS--simply 'feeding' off any opportunity he sees (whether it be Shar Jackson, or Britney Spears)
For Britney's sake..and the sake of her children, the best thing he could do is releasing the tape. The children would likely disown him for hurting their mother in such a way--thus ridding them of his presence for good.
Granted, they are babies now--but there would be no valid explanation Kevin Federline could EVER give them to explain his actions.
What a sad revelation this must be for him--to know deep down inside that he is NOTHING more than he's made of himself--and even moreso, that he sees nothing wrong with his actions.
Kevin Federline does absolutely nothing to help himself in the media or otherwise and if this is all true then i think Mr. Federline should go into hiding and be ashamed of himself.
Britney is the children's Mother and he has never done anything to show he should have custody of a carrot much less young children and i for one am disgusted he would even ask.
All I can say is , Britney should ignore him and just get on with it - *** tape or not, they don't seem to have hurt Pamela Anderson or Paris Hilton.- I for one am looking forward to her new album etc.,
Kevin needs to just start acting like an adult and not some childish little gangsta wannabe. If he truly ever loved Britney he needs to show it and just let her be, move on. Be a real Father to all of his children and stop using them as bargaining chips plus, do the world a favor and learn to use a condom.
i guess i don't understand why everyone's down with kevin. maybe he's done nothing with his career but he is now, and britney herself hasn't put a thing out since 2004. and maybe he spent some of her money, but she hasn't kept anything from him so obviously she didn't care. nobody would care if she sat around on his money. plus kevin's brought britney SO much publicity he deserves a bone. and maybe he's not number one dad but we haven't seen pics of him driving with an unprotected baby in the car.

THIS ISN'T- Everyone's "down with Kevin" because he's white trash, feeding off others (mainly Britney) for fame (actually, he's becoming quite infamous) and money. Most people want money. And people will do varying levels of things to get it. I told my friends two years ago that they would eventually break up and he would try to come up with something, anything, to get money from her. It's unbelieveably obvious. I can't believe Britney married him. Hopefully he won't get anything from her but grief and misery for trying to screw with her.
