WHITE PLAINS, N.Y. - Two victims of the wrong-way crash that killed eight people on a New York highway suffered terror and pain before they died, a lawsuit claims.

The lawsuit by the family of victims Michael and Guy Bastardi targets the estate of Diane Schuler, the 36-year-old Long Island mother who was blamed for the July 26 crash. It will be filed Thursday in White Plains, Michael Bastardi Jr., son and brother of the victims, said Wednesday night.

NEW YORK - Diane Schuler, the suburban New York mother who died in a wrong-way crash that killed three other adults and four children in July, was seen twice doubled over on the side of the road, "getting sick," witnesses told state police investigators in documents released to CBS affiliate WCBS.

Police told WCBS that this information supports a new theory of the fateful night -- that Schuler, who smoked marijuana regularly according to her sister-in-law, but did not drink often, was overcome by the 10 shots of vodka she drank during her deadly drive.
