Elizabeth Smart Testifies For First Time, Claims Repeated Rape

SALT LAKE CITY (CBS/AP) Elizabeth Smart says she was raped repeatedly by her alleged kidnapper, Brian David Mitchell, during the nine months she was held captive as a teenager.

Smart, 21, testified Thursday about the case for the first time, claiming she was told she would be killed if she yelled or tried to escape. She described alleged abductor Brian David Mitchell as “evil, wicked, manipulative, stinky, slimy, selfish, not spiritual, not religious, not close to God.”

Her testimony in U.S. District Court in Salt Lake City came as part of a competency proceeding for the man charged in her 2002 kidnapping

Mitchell has twice been found incompetent for trial in state court. Mitchell and his estranged wife were found with Smart nine months after she disappeared from her Salt Lake City home.

A judge ruled earlier this week that testimony from Smart is relevant to the mental competency of Mitchell, who was removed from the courtroom before Smart arrived and taken to a holding cell where he could listen to the proceedings.

Smart was poised and composed while testifying for just under two hours.

She was 14 when she was abducted from her Salt Lake City home at knifepoint in the middle of the night. Shortly after her abduction, Smart said Mitchell took her to a mountain camp and performed a ceremony she said was intended to marry the two.

“After that, he proceeded to rape me,” Smart said.

She said he held her captive with a cable attached to her leg that had a 10-foot reach. That line was attached to another cable strung between two trees.

Smart said Mitchell plied her with alcohol and drugs to lower her resistance.

“He said that he would kill anybody that would come into the camp, or kill me if I ever tried to escape or yell out,” Smart testified.

Smart said Mitchell was motivated by sex and used religion to get what he wanted.

Mitchell's defense attorneys had sought to limit Smart's testimony to her experiences with Mitchell, without her opinions about his mental state.

The defense objected to the 39 so-called “lay witnesses” proposed by prosecutors, including Mitchell's family, friends or workers at Utah State Hospital, claiming they lacked the expertise to evaluate competency.

In a ruling Monday, U.S. District Judge Dale Kimball rejected the argument as it relates to Smart, saying her testimony may help the court settle differences in the findings of experts who have evaluated Mitchell.

Experts have split opinions over Mitchell's competency and have relied on statements from others - including Smart - and past evaluations to prepare reports for the court. Kimball's ruling said Mitchell has been uncooperative with evaluators and refused to participate in diagnostic tests.

In the state court system, Mitchell was twice found incompetent to stand trial.

Smart was rescued nine months after her abduction when a motorist spotted her walking through a Salt Lake City suburb with Mitchell and his estranged wife, Wanda Eileen Barzee.

Last year, Mitchell was indicted by a federal grand jury on charges of kidnapping and unlawful transportation of a minor.

Once an itinerant street preacher, Mitchell is said to have wanted Smart as a polygamous wife and may have taken her to fulfill a religious prophecy he laid out in a 27-page manifesto drafted in April 2002.

He certainly is a nasty little Charles Manson wanna be. He was sane enough to shackle her leg so she could not escape. That is proof enough for me.

I am sorry for Elizabeth. She is a lovely girl and is handling this very well. She is a beautiful, wonderful girl.

"Claims", not reports, states, acknowledges, but you choose to say "claims", like she's lying. I'm not even going to read your biased report, the headline told me all I needed to know about the "writer".

A 14-year old girl sexually abused and manipulated by a much older man who used religion, god, and force to get what he wanted...

...is soon going on a mission to spread the "gospel" created by a man who used religion, god and force to get what he wanted from a 14-year-old girl, Helen Mar Kimball.

Smart is the poster girl for irony.

Brian Mitchell and Joseph Smith...cut from the same twisted cloth. Raped by one, testifying of the other.

I'm surprised that Glen Beck support Brian Mittchell and his right to have weapons when they do horrible things.

Why do states that begin with the letter U support Glen Beck and his ilk?

It's OK now Elizabeth you don't have to worry about this CREEP anymore not only will he rot in prison.
I hope he gets raped in prison every single night until he is gone. So he can finally feel what it was like when he did that to you. He is where he's supposed to be and he won't hurt anyone else.

Being 'close to God' or being religious has nothing to do with rape and evilness. Just because you go to church every Sunday, pray, and read your bible, doesn't mean that they are not capable of doing any evil.

What do you mean he's not competent to stand trial? From what I've been reading about him, he pretty much knew what he wanted, how to do it, and keep the girl from doing anything about it. To me, that's pretty good. Now, thanks to our justice system this will drag on for years, the public will pay for this and the girl will have an even harder time trying to get on with her life.

I guess I don't understand why she had to testify? The man is incompetant to stand trial, so there will be no trial. Is this just a way to rape her again?

I don't think Ms. Smart saw it that way. If she had the courage to talk about her experience, then more power to her. I'm sure she just wants him to be put away so he won't hurt anybody else.

Why is it that people who commit these crimes, kidnap children, keep them locked up for months and years, repeatedly rape them, are usually considered insane? Of course it is an "insane" thing they did - but they were not that insane when they conceived their plan, and carried it out, and continued to live an innocent life under the eyes of their neighbours, the local authorities, police - - - they were clever enough to do that. Some may be of low intelligence, but insane? No way - - -

I just want to throw in my 2 cents as a woman who has gone through only a fraction of what Ms. Smart has experienced:

1-I wish we would take rape more seriously as a crime

2-Having said that, we should also seriously prosecute false allegations of rape (as in the Duke and Hofstra cases). Not only do they do damage to the men accused, but they make it less likely that, in the future, women who HAVE been raped, will be taken seriously. It's difficult enough as it is to have a successful prosecution against rape, Often the victim is put on trial herself (although, thankfully, that's changing). But we don't need the taint of false allegations clouding the situation as well.

My sympathies and respect to young Ms. Smart. I believe that she'll be a strong survivor!

Well at least Elizabeth has a great support system. I think of all those people out there who have experienced similar abuses and do not get the help and support they need. If it wasn't for her family and their support she would not be as poised and strong of a young lady today as she is. I wish her well in her future and I hope the two slimeballs pay for what they have done.

Yeah but it wasn't rape rape if you use that mental midget Whoopi Goldberg as a guide to rape. And I'm also struck by the "claims repeated rape" headline as well. I'm sure it really never was repeated since it's only a claim this woman experienced. I say we take a look at what films he made, talk about his credibility in the Hollywood community, maybe let him make a movie, and then just let him get away with it.

The things we do to women.

By your reference to Whoopi Goldberg, I'm guessing that that has to do with the recent developments in the Roman Polanski case.

However excellent a diraector he may be, no matter how the murder of his wife by the Manson gang may have affected him, however long ago the crime may have occurred and notwithstanding the fact that his victim would like to get on with her life and put it behind her--the fact remains that he is guilty of having sex with a minor. He has avoided punishment for over 3 decades. It's about time.

I am what most who post on these boards would call a liberal, but never in my lifetime have I (or anyone else I've known) apologized for seeing justice done in crimes such as these. It's sad that some people do, but they're not the majority of us, believe me.

I am stunned as well by her internal strength and grace--by not being afraid to show up, and by giving testimony that will, hopefully, put both him and his 'wife' away forever so they can never ever repeat the crime--i wish Elizabeth the very best--

What I find interesting is the headline of this article.

"...claims repeated rape..."

Like, why else does an adult, married male kidnap a child? For pretend tea parties?
