Wife and I are 70 years of age. Our prescription medicine costs us $35.00 dollars per month under Part D Medicare. We were told that if we did not subscribe to 'some' for of Part D insurance plan now, and pay for a policy that does not reimburse us our out of pocket expense, we would be penalized if we should ever need it in the future. How can this be true? We are making payments to an 'insurance' company that has nothing to loose. The selected company just 'banks' our dollars and has no pay outs. It grinds me to have to send them money each month and know that I am just throwing it out the window. How can this be a fair and just law of the land? There must be others in this same situation but how did this come to pass in the first place. Most laws do make a certain amount of sense to me but this one does not. If the information given to me is not correct I sure would like to be put on the 'right' path. Growing old is not for the faint of heart.
At least 49 states require mandatory liability car insurance. Why is this constitutional and some form of mandatory health insurance being considered not constitutional? I understand state's rights but many areas of this country do not have access to public transportation and and are a long way from job opportunities, stores, government offices,making having a car or access to one a necessety. There are serious ramifications for not having at least liability car insurance.
While I do believe that all citizens should have health coverage, mandating all US citizens purchase insurance from companies who have progressively raised rates and lowered coverage, in my opinion is an infringement on my personal liberty or freedom from arbitrary or despotic control or better still the "power of choice", as provided for by the 5th Amendment in the constitution.
The Constitutional Guarantee, as provided for by the 5th Amendment, prohibits all levels of government from arbitrarily depriving basic rights of life, liberty, and the pursuit of happiness. To that end, it would not be much different than the Government mandating all US citizens to purchase the latest erectile dysfunction drug. While on one side people can say the government is providing something beneficial, however on the other side of the coin, requiring a US citizen to pay money they may not have in some cases, to some insurance company is not a liberty I believe we as citizens should loose.
I do not have an answer for universal health care. The United Kingdom and Canada, two of our closest allies, have seemed to get a handle on offering health care to all citizens. However flawed one may perceive those systems to be, they are still in place, and they are not required pay some health insurance company some fee for insurance monthly. Now if the US government makes a valid case, with a free health insurance package for all citizens, and paid insurance for those with the money and means to pay the premium for extra coverage or special treatment, then sign me up.
If the government is going to mandate health insurance coverage, there should be a free coverage option for those who simply can't afford $1,300 a month for health insurance.
People would rather spend their money on greasy food, porn, alcohol, tobacco, and dope instead of health insurance.
The Medicare Drug Prescription program is not mandated-however, legal surcharges are imposed compounded monthly if one should CHOOSE not to participate. This same law which President BUSH passed can equally apply toward refusing to buy health insurance. The Supreme Court won't be going this route because it would invalidate Bush's drug prescription program as well. The government can do other lovely things like cut not-for-profit hospitals funding: CHOOSING to have No insurance is a refusal for treatment, so hospitals can equally refuse the non-insured (including Emergency Room!). The Supreme Court cannot touch this: It's free enterprise system: It's BUSINESS.
Free health care? No way! I hear the Republicans say that's socialism! If you all truly want to do away with socialism-this no insurance = No hospital treatment public option plan is it! This is 100% FREE ENTERPRISE and is 100% the American Way! NO FREE RIDE HERE.

What do we do with the jobless & homeless- "no fault of their own...? What about the too sick & weak to work & those who fall in the cracks that cant afford a decent meal- never mind "afford health-care payments? Do we lock all of them up for (non-payment?) Who will pay the health-bill then...?
Simply make it mandatory for any hospitalization the person must have health insurance or not be admitted-THEIR CHOICE FOR NOT CARRYING HEALTH INSURANCE.
It has to be mandatory or the system fails because of "adverse selection"; some guys got the Nobel Prize in 2001 for understanding this. It applies to health insurance as I explain; google "Single-Payer Health Insurance" "adverse selection" to see why. And why it's Constitutional.
This is kind of old, but I'd like to point out the irony in claiming that Congress can't pass a law or that it is unconstitutional because it is outside of their enumerated powers. When people say this, it's almost aways in regards to a law protected by the Commerce Clause (an enumerated power). It's up to the Supreme Court, not bloggers.
This is just in general, not necessarily pertaining to the healthcare issue. There would have to be an actual law passed before it can be legally challenged.
The Federal govt can make any law that it wants regarding its subjects on federal land and territories. The federal govt Cannot make laws that apply to people outside the scope of its delegated authority. The question that Americans have to ask as Inherent Political Power Holders*see your constitution if you don't know what that is*

3. A verified copy of the regulation that requires every American to buy health Insurance and its listing in the Federal register.

Please note deciding to not include any relevant,complete,accurate, information will be deemed the gov'ts admission that the proposed healthcare statues and regulations do Not Apply to me And I will make this a part of my permanent admin file to show that I made a "good" faith effort to comply with said "manadatory" Health Insurance regulations
