Actually the court is protecting the child from being indoctrinated into a religion full of hate.

Forcing a child to attend religious brainwashing in the isolation of a religious school is dangerous and not in the child's best interest. Especially if the school's doctrine attempts to alienate the child from one parent.

Incidentally the only reason the Christians don't support the obvious truth of what I'm saying is because they, too, have a tendency to enjoy their ability to treat their children as property when it suits them.

But if we are going to talk about equality meaning "everyone" - and of having one standard under the law, with no "second class citizens" - then all children should be equally entitled to having parents, laws, and judges who recognize and guard their interests.

And a child has an interest in having a healthy relationship with both their same- and their opposite-sex parents.

That is an interest that is in conflict with - and yet is just as important as - the rights gays are so concerned with.

If you take out 'father' and 'mother' and just use 'parent figure' in a case like this, both have equal rights. There are special bonds between a birth mother and her child, but using that to take the other parent's (man or woman) rights away makes them out to be nobodies in a relationship. A tactic used in many bad custody cases. And the person that said "All of you are pointing out here that you are homophobic" should reconsider that statement.

To the commenter who said, "I'd be "for" gay rights if they were attentive to what's fair - not only fair for themselves, but fair for their child, fair for those whose beliefs conflict, etc."... Why does someone seeking equal rights need to take into account whether someone else's "beliefs conflict"? If that were the case, we'd still have slavery in this country, women wouldn't have the right to vote, and we'd have polygamy, just for starters. The Constitution will eventually win out, and constitutionally speaking, there is no reason to deny matrimonial rights to any two consenting adults who want to pledge themselves to each other.

"Gay marriage is based on claiming the RIGHT (the presumption) without honoring the OBLIGATION THAT GOES WITH IT."

I can't believe you have the guts to say this... we'd love the obligation that goes with it, but it is precisely people like you that prevent us from having it. Are you completely blind to that fact? Lord, what a useless argument.

cidaia "Only the children of gay marriages are denied this right, and that because gays have scared and bullied people into thinking that the right to "have a positive parenting experience" matters more than actually guarding and protecting the child's interests."

All you are pointing out here is that you are homophobic. There is nothing anyone is going to say that will sway you to be more open minded.

Wow. A judge who honors and imposes the rule of law, no matter the gender of the persons involved. Gee, there's hope yet.

Good luck to Ms. Jenkins.

Read this story about a woman from Washington state, who snatched her kids 11 years ago when her husband was awarded custody. Now she shows up in Pennsylvania 11 years later saying she wants the state to take them she does not feel like taking care of them any longer. Probably mental instability was the reason her husband got custody.

http://www.cnn.com/2009/CRIME/12/31/custody.arrest/index.html

Being a Lesbian, finding God, and deciding that Homosexuals are evil sinners sounds like mental instability to me. Violating a court order for visitation for her ex-partner also shows mental instability. Now she is probably in Contempt of Court for fleeing into the night with the child, more insanity. And living on the run in hiding is so good for a child. And yet, this is the woman that the Christian Taliban is supporting.

The "presumption of paternity" - the legal presumption that says we must honor a mother's spouse as the father of the child - goes hand in hand with the rule that the mother's spouse should BE THE FATHER OF THE CHILD.

Gay marriage is based on claiming the RIGHT (the presumption) without honoring the OBLIGATION THAT GOES WITH IT.

The right is granted to married couples based on the expectation that if married people are going to procreate, it is going to be with each other.

Gay marriage is nothing but fraud, no better than lying on a birth certificate.

Hetero children have a legally presumed RIGHT to a relationship with their true parents. Even unwed mothers must prove the child abandoned (or the other partner unfit) and go through a legal process of adoption before a stepparent can adopt.

The children of gay marriage are denied a legal protection - a RIGHT - that all other children are entitled to.

My congrats to lisa for finding back the right way, I hope you can persevere. I also hope you can retain custody of your daughter , so she may also learn the proper ways instead of confusion.
