This has everything to do with ambition. I really hope that I'm never a part something that puts these kind of actions into motion. This entire event has nothing to do with justice an everything to do with greed. I really hope everyone who was involved in this case really looks at what kind of person this man was. He didn't do the things he did because of money, power, or prestige he was trying to give expensive scholarly articles to poor people. He was a good person and the people who did this to him aren't. Using the law as a weapon is wrong. After I graduate I'm leaving this country because of the corrupt justice system and governmet. Somewhere, where corporations aren't people and good people don't made an example of our used as a resume builder.

This sounds like the Adolf Eichmann defense. "I was just doing my job. I took an oath and was following orders." Pretty pathetic.

But then even the Eichmann defense doesn't work here. Prosecutors are not bound to prosecute every crime that comes to their attention, and often they do not. Especially in a case such as this, where there was no economic harm and the victim asked that the case be dropped, few prosecutors would proceed. So Ortiz is just lying. Which for her is typical behavior.

Hmmm! Folks are questioning the suicide; so am I but for much different reasons than in the current comments!!!

The folly of our youth where no harm comes to any person is not a crime that deserves years in prison; the only threat this young man posed was his God given brilliant mind that could have altered, for the better, a corrupt government. However, the theft of life, liberty and property through malicious prosecutions and civil pretense litigation where the CLERKS and some of the judges in these courts collude with attorneys, including prosecutors, to deprive rights where the means to an end is racketeering to promote profit for the corrupt over truth and justice does warrant years in prison. The entire justice system has been delegitimized by these alleged criminals and the tax payer is forced to support these corrupt fools where they have turned the houses of justice into nothing more than their own private playground! Where are the mail fraud, wire fraud and violations of the U.S. Computer Fraud and Abuse Act charges against the tax paid public servants working in these federal courts where they habitually render fraudulent judgments and manipulate dockets with computers paid for by the tax payer to obstruct justice and then send their bogus documents across state lines via the US Mail? Where are the RICO charges? Not only does the US Attorney hold responsibility for Aaron's death but you can bet she was pressured by the Administrative Offices of the US Courts to go after Aaron because he messed with their precious corrupt PACER System. Aaron was part of the movement that wanted access to court documents free to everyone; access to court documents means more than an opinion rendered by the court (sometimes rendered by the court). NOW THERE IS THE PROBLEM - how soon would the world be aware of the number of fraudulent documents routinely entered into PACER by corrupt court staff, and yes, corrupt judges with world-wide free access to ALL federal court documents? How soon would it be before the world became aware that the US Courts are not about truth and justice but simply a huge racketeering enterprise set up to pad the pockets of select "elite" attorneys? Publishing for view the corrupt decisions that come from these courts on justia.com without access to the documents filed by the parties is a huge scam promoted and protected by the US Courts. The fact that the tax payer has to support these alleged criminals while they pull off the largest dishonest service fraud scheme ever seen in the USA is more than clearly a good reason to torture this young man until he killed himself because they knew damn well no jury of his peers would ever convict him. All of you on 1 Court House Way and all of you working and providing dishonest service in the US Courts throughout this country are sick psychopaths; you all belong in prison! I say all because if not directly involved these tax paid public servants aid and abet; cover-up and protection of court staff who routinely obstruct justice and deprive rights to rob life, liberty and property is routine by court staff not directly participating, routine for the US Marshal and routine for the Clerks of the Courts. These corrupt tax paid scum are in fact domestic terrorist who have delegitimized an entire Branch of OUR Government!! We have to keep faith that our District and Circuit Judges are not complicit but it is not looking good. The FBI first harassed Aaron over his downloading of multiple court documents and "compromise" to the system. PACER gives free access to judicial opinions, and citizens don't have to pay if they look at less than $10 worth of filings during the billing quarter; BIG FREAKING DEAL;THEY LET YOU READ FOR FREE THEIR CORRUPT DECISIONS!!!! So let's RECAP on the corrupt and make public access to ALL COURT RECORDS fly full force. I find it interesting that when I first had access to file in the electronic filing system the very first page I accessed had a warning not to use the RECAP system.(the system initiated where court documents would be free to the public is called RECAP - PACER BACKWARDS) So in actuality Carmen Ortiz not only needs to be removed from office but she belongs in front of a Grand Jury along with the entire 1 Court House Way crowd.

This is all only in my opinion, but Ms. Ortiz's statement is not a true indication of her actions. If she had thought that it was such a minor crime, why then did they charge him the way they did in the beginning and continue put more severe charges upon him over the next 2 years if this is truly the way she felt: "The prosecutors recognized that there was no evidence against Mr. Swartz indicating that he committed his acts for personal financial gain, and they recognized that his conduct - while a violation of the law - did not warrant the severe punishments authorized by Congress and called for by the Sentencing Guidelines in appropriate cases" No evidence against him that he committed his acts for personal gain - hmmm, their charges that they pressed against him suggest otherwise. I don't know who she is trying to fool, some people will be fooled, because they don't see the whole picture. But there is a good reason why people do not trust the legal system. When they want to make an example of you - they will, unfairly and unjustly. Aaron's case is everything that is wrong with our system of justice. My law enforcement officer sister always told me never trust a cop or anyone in the legal system. When they say - "they can and will hold what you say against you" - they mean it and then some. They are not your friend. To them everyone is guilty of something - everyone is looked at as a potential criminal, they just have to force you to admit your guilty of the crime they deem appropriate for the situation. They went after this young man not because of his so called crime, but to make an example of him. He was a big fish in their little pond. You know this when the people/organization he pulled it against didn't want any charges to be pressed against him.

Maybe the parents should be looking towards their son's actions that warranted a federal investigation and impending prosecution before blaming the prosectution themselves. I have no sympathy for someone who does something illegal then kills themselves because (presumably) they can't handle the idea of being behind bars. I agree with the commenter before me. There had to be more to this man than just this case. Successful 26 year old men don't kill themselves over what could have been only 4 months in jail. and decent human beings don't try to ruin someone else's life just becaue their son obviously needed some psychological counseling and took his own.

The issue was in that the documents he 'stole' were public domain, and his sentencing was due to a terms of use violation. You know, the stuff that you 'agree' to before using stuff. None of the parties involved were pressing charges. Ortiz decided she wanted to punish Aaron to the full extent of the law, despite it being excessive.

The plea bargain is a legal trap where you avoid going to trial by pushing for 35+ year sentences if they do not accept the 6 month sentence. AND if they do accept the plea deal they have a FEDERAL record for the rest of their life.

This is a blatant case of abuse of power. where the punishment did not fit the crime.

There has to be more to this. Generally, a 26-year-old doesn't kill himself after turning down a lousy 4-month sentence for a crime he doesn't seem to have denied comitting. Isn't it better to suck it up and get thru that time instead of saying, "no deal" then committing suicide?

And all this because he thought files should be made available? Who gave him that right? Very strange story...
