- "The Calguns Foundation is claiming this selective practice violates the 2nd Amendment but, the right to own and carry a registered firearm in plain site (holstered) is completely legal at this time for everyone."
Actually Matt, that's not correct. In California a private citizen can carry an UNLOADED and UNCONCEALED firearm in public and only if it isn't in a place prohibited by law. Examples of prohibited places are a gun free school zone, which has a radius of 1000 feet around school property. Other places would be public buildings, like police departments, city hall, the water department etc. California gun laws are draconian compared to 80% of the country, What they're doing in the Calguns foundation is necessary for Californians to regain our rights from a government who would incrementally strip us of our rights if they could. - Reply to this comment
- Normally I would be against this. But seeing that
millions of illegal alien criminals have sneaked in our
borders and home invasion robberies and broad daylight
kidnappings are on going.
I would love to be permitted to carry a gun.

- Boy, glad I'm in Texas, where we're allowed to protect ourselves from criminals.
California used to lead the U.S.A. in many areas and be a trend setter. Sad to see it's become a laggard where allowing its own citizens to protect themselves and their families is concerned.
Maybe it's time to learn from the other 47 states who properly recognize American's 2nd Amendment rights. The California CCW law needs overhauling. You might want to start with a good set of laws that are working for the rest of us and save yourselves some grief and time.
Hope the lawsuit prevails. - Reply to this comment
- Who are these goof ball sherrifs? I recall one from California several years ago who ran around getting his face on TV and lieing about firearms types and exsisting law...confidently scince most Americans aren't aware and wouldn't know he was lieing!
Of course it had more to do with wanting a job with a major ($$) gun control group which has scince changed it's name.
I suport law enforcement --up to the time they lie! Particularly about public safety matters.Top cops acrossed the nation have caved in to the gun control advocates and news media template for decades...but these are The Few. Not the majority!
But it's that rotten apple few who get all the media attention when they lie or help stage rigged shooting demonstrations for network news. - Reply to this comment
- This case is in reference to the Concealed Weapons Permit issued by the Jurisdictional Sheriff's Office.
Most law abiding Americans that wish to purchase a firearm for the purpose of self protection usually will not seek a special endorsed concealed firearm permit through their local Sheriff's Office.
The Sheriff's Concealed Weapons Permit in California has been customarily issued to private citizens with work related applications such as: Diamond Couriers, Rent Collectors, Personal Body Guards, and of course Gun Dealers.
The Sheriff's Concealed Weapons Permit allows someone to conduct their normal business activities in a somewhat indistinguishable manner. In other words, a Diamond Jewel Dealer wouldn't want to bring unnecessary attention themselves while transporting their goods, thus the necessity of concealment of both the cargo and weapon.
This lawsuit references the selectivity practices demonstrated by the local Sheriff's Office. In some cases the good'ol boy network allows the issue of a permit while others (most) are rejected.
The Calguns Foundation is claiming this selective practice violates the 2nd Amendment but, the right to own and carry a registered firearm in plain site (holstered) is completely legal at this time for everyone. - Reply to this comment
- PS: We also don't have people getting decapitated on Greyhound buses and having their body parts eaten while the police watch.

- erasmus111 , you might want to check your facts. Canada, Great Britain, and Australia, all of which have tighter restrictions on gun ownership than the US, also have higher violent crime rates than the US as well. We have more shootings (which are almost all drug dealers shooting other drug dealers, showing that prohibitions, on drugs or guns, causes crime), but we have far fewer robberies, rapes, assaults etc. per capita than any of the other countries mentioned. Also, as our gun laws have loosened, our violent crime and gun crime rates have dropped. During the same time, all these types of crime in the other three countries have risen. And while the registration requirements for guns are stricter in Canada, Canada allows guns to be imported that are illegal to import into the US, such as Chinese AK-47s and M-14s, and modern "assault weapons", such as the new Israeli Tavor.

- First off, thank you CBS for covering this issue. It seems the media would rather vilify guns by covering every instance of some whacko on a rampage, but you never hear about one of the 7,000 times a day law-abiding citizens use their legally owned guns to stop a crime.
I have donated money to the Calguns Foundation, to help fight the fight to regain our fundamental right to self-defense. It is time to change the system in place in California and other states where only celebrities and politicians are granted the "privilege" of being able to protect their lives and those of their loved ones. My life is worth just as much as theirs.
Imagine if another fundamental right was treated with such disregard? Could you picture such a lawsuit taking place to secure our First Amendment rights? It is about time we took the Second Amendment just as seriously. - Reply to this comment

There's nothing to fix, other than stopping the shipments of U.S. guns from entering our country. What little gun crime we have, the guns are traced back to your country.
"This story is about our laws and our right to self protection in addition to defense of home and property with no outside interference."
We don't have that big of a problem in protecting our property. Our burglars are rarely armed and most times never enter the home when someone is home.
No problems walking down the street or going to bed at night and sleeping like a baby. No worries. Don't need a freakin' gun by my side to protect myself.

You're wrong. We don't have mass shootings everyday like you do. - Reply to this comment
- er-ass-mus posted "The schools in Canada teach about other countries." I bet they don't teach you this... Canada's billion-dollar boondoggle ? the national gun registration scheme ? has proven itself an abysmal failure, as that country's violent crime rates are double those reported in the United States, the Citizens Committee for the Right to Keep and Bear Arms (CCRKBA) noted today. A story in Canada's National Post by writer David Frum confirmed CCRKBA's independent finding. Frum wrote, "Canada's overall crime rate is now 50% higher than the crime rate in the United States." Later, Frum added: "Gun registries and gun bans?do not work." Apparently, your views are in line with the propoganda put forth in your country and its schools; not ours. Being a geography major doesn't qualify you as an international arms/self defense expert. This story is about our laws and our right to self protection in addition to defense of home and property with no outside interference. In each country that has enacted strict gun bans and mandatory firearm turn-ins by its citizens, the crime rate has risen dramatically. The criminals will get guns illegally and use them against the law abiding people because criminals know that there will be no defense. If you keep a weapon anyway and successfully defend your home against an invader, it is you who will go to jail. Check the UK, check AUS, GB, etc. Check the stats in our own Wash. DC. When guns are banned, only criminals will have them. Worry about your own country first and fix...it.

- Since she has never been to Montana, I wish she would describe it to us all, since she is such an authority on the state

The schools in Canada teach about other countries. Your country only learns about itself. I could probably name all your states and it's capitals long before you or a lot of people could name our provinces. Of course you might know a tiny little bit because your wife is Canadian. But who knows, you seem like a pretty self-absorbed person. - Reply to this comment

I have never discussed Montana for you to know whether I'm an authority or not. You have no idea whether I have been to Montana or not.

- Its a shame that the sheriffs, police chiefs and whatever can not be personally sued when they deprive someone the means to defend themselves. If they lost their house because someone was killed who they denied a permit then they would soon stop this crap.
But the taxpayers pay the lawsuits so who cares? - Reply to this comment

- The crime waves are caused by illegal immigrants and habitual criminals, who don't apply for licenses in the first place.

- The Calfornia system is in dire need of reform, as it allows rabid anti-gun people like Dianne Feinstein and Don Perata to obtain concealed carry permits through their political connections, while denying the right of self-defense to others.
It is time for California's ruling elite to recognize that there is a right to keep and bear arms in California, whether they like it or not.
For example, Oregon is a "shall issue" state, and CCW holders in Oregon are not causing a crime wave.
