I like my right to privacy. How is this individual mandate not a violation of the right to privacy? Does a state "opt out" clause make an unconstitutional law less unconstitutional? Would that state "opt out" clause in this law containing the individual mandate make that mandate constitutional? If this is held up as legal, then what's to keep some future government dominated with religious conservatives - modern Republicans - from mandating that everyone buy and use explicit content filters in their TV sets and computers (to save the children) or face an IRS fine? Suppose they were to try to outlaw abortion or outlaw women crossing state lines to get abortions by giving the states an "opt out clause" for these laws? -------- There is no end to this very slippery slope of violating our right to privacy using the federal power to tax or regulate interstate commerce as subterfuge. Where is the ACLU? Where are the true civil libertarians?
According to Senator Ron Wyden, the health care overhaul does allow "a state to go out and do its own bill, including having no individual mandate." provided these laws "Meet the coverage requirements of the bill."(Source:"Lawsuits Moot" by Sam Stein, Huffington Post, March 24, 2010.) This requirement was taken from Ron Wyden's Healthy Americans Act. If a state does not like the mandate, they can create a different system and apply for a waiver from the Department of Health and Human Services. This Waiver Amendment is part of the bill Obama signed into law.
The attempts of various GOP politicians to file suits to block health care reform is simply a waste of the taxpayer's money.
My question... If republicans are stating that it is illegal for the government to require americans to have health insurance, why is it not illegal for the government to force us to have car insurance.? I really dont understand the difference. If I wreck my car, it cost ME potentially thousands, but if I dont have health care, and get hurt in that accident, It cost the american taxpayers thousands. Somebody who knows the answer, please enlighten me.
You really can't see the difference? First of all, state government, NOT federal government, requires that you get car insurance. We have to buy car insurance if we wish to drive. But we still have the choice of whether or not we own a car, what kind of car insurance coverage we want, and who we get our car insurance through. Someone who does not drive a car cannot be stopped by a police officer while they are walking down the street and be fined if they do not show proof of car insurance.
Applying this logic to car insurance would basically mean forcing everyone to buy car insurance, whether they drive a car or not, so that the premiums of people who do drive can be lower. Can you see how wrong this is yet?
Also, health care is a service. Just like every other service, you pay. Depending on how much you are willing to pay will usually indicate the type of quality you will get. Are we all entitled to other services now, too? Should we add a lawn care tax so we can all have nice lawns? Should we add a home cleaning tax so we can all have our homes cleaned? No, health care is just like any other service out there. Some can afford it, some cannot. And there are programs in place to assist those who cannot afford it.
The thing about rights is none of the others cost us anything, they do not demand something of us, and they are all optional. I can choose whether or not to own a gun. I can choose whether or not I exercise my freedom of speech. But I HAVE to have health insurance. That means it's not a right, it is limiting my rights.
You look at the photo accompanying this article with (Palin, Romney, Backman and McCain) and you ask yourself, "What is wrong with this picture"? Four, self-serving windbags out to line their own pockets with lobbying money.
This is the best that the GOP has to offer. This is the best of the best of the Republican Party. Three quitters and a psycho. That's the problem. These folks do not care about the average American, Republican or Democrat. Whether you live or die, makes no difference to them.
The GOP brought in the fringe-element teabaggers hoping for a few votes. They've alienated everyone else. Now, name-calling, spitting, gun-toting, racist vulgarity is the face of the GOP. Sad, but true.
The Republican Party is salvageable. There are good people in the ranks of the party. Unfortunately they have let faceless ranters on right-wing radio shape their platforms. They have let lobbyists run them around by the nose. The Heads of the GOP are self-serving cowards, hanging onto this insane notion that Americans will hate the status quo so much, they will opt for the same old garbage they had before. Not going to happen.
The GOP has accomplished nothing in over 25 years. Come up with a plan. Run on a platform that appeals to the average voter. Then earn your money.
This bill is pure communism. I would like the right to decide whether or not I wanted insurance and where I wanted to get it from. How is this bill suppose to help the economy? If the people who complain about insurance companies just stopped buying insurance from them than what do think the insurance company is going to do? Answer: Make insurance more affordable or they don't get your money. Thats how a capitalist economic system works. The problem is too many Americans are wimps and wont stand up against companies. The public just want to cry to the government for help. This bill is unconstitutional and unAmerican. This bill isn't going to create more jobs for normal Americans, nor it will just cause more unemployment to the point where they wont be able to afford to pay for the insurance anyway. What will this bill do to insurance companies and those who work for them? Also the doctors and the nurses in hospistals? Where is the incentive? People complain about rich people but did you get off your butt and do anything to better yourself
by Mortar_29 March 23, 2010 3:20 PM EDT They arent legally allowed to do it. Thus, unlike the Dems, they were actually obeying the law!
If it's illegal, you can walk your pretty little cross-dressing aasss down to your nearest federal attorney's office, file a complaint, and get the ball rolling on the lawsuit to overturn ALL of those programs.
Because it is illegal for the Federal government to do this.
You see, an honest legislator would go "my constituents, I understand you want me to address healthcare. But, except for interstate commerce issues, I really have not been given that power by the states. Thus, you have two choices. Go to your state houses and have them address the problem. Or go to your state houses and ask them to approve a Constitutional amendment allowing me to do that. Until then, my hands are tied."
Republicans arent going to repeal anything...even if they are successful in sending a repeal bill to Obama's desk....guess what Obama is going to do???
