Berg would need to file a new appeal as the District Judge still has a final decision on the record that has not been overturned. To date is had not even gotten the sufficient interest in a legal sense of Judges at either appellate level to actually review the legal principles used by the District Judge in his opinion. At this point in time the person that "got it right" is the District Judge.

Interested and interested in a legal sense are two different things entirely. In interested in a legal sense to me means they actually want to hear arguments to elevate the status of any final decision above the level it was affirmed (district or appellate) to a national standard -- whether they agree or disagree with the District Judge''s opinion. - Reply to this comment

My source was correct in asserting without a guarantee a pattern of denial on Monday after a Friday conference as we all know the court does what is sees as it''s duty on it''s own schedule. Then the denial that matches the reported pattern is announced in the usual way. I do not claim to have been right because I really did not choose either outcome. However the source that pointed out the pattern to me is looking very credible and experienced as a court observer now now. - Reply to this comment

- Yeah, too bad isn''''t it Misha, his case is still up for the 16th...and the denial of the writ simply means the district court judge will now have to receive Berg''''s amicus brief...and will have to rule on it...and if he denies it, it will be sent right back up to SCOTUS...

Unless the Supreme Court requires the district judge to review his decision, which would of course require that they actually hear the case instead of declining to hear it, The District judge has already made his final decision. - It is rare in history for a human being to cede illicit power willingly, and if Obama does so he will join a small but elite group of individuals who literally changed history by simply doing what was right.
Let us hope for our nation that he can resist the urge to hold the power of the ring for himself.
And let us hope for our nation that Bush, Cheney, and all there accomplices are justly tried for high treason against The United States of America, and crimes against humanity. And if found guilty, spend the rest of their lives behind prison bars.

Perhaps you need your glasses -- the executive branch waged the war and all issues I have heard about being litigated have to do with HOW the war was waged and not IF the war was waged (Congress and the UN approved the IF and not the HOW). Try reading the paragraph again -- you may eventually understand.

- The decision to take action was in essence ratified by the world with UN authorization which is what the Congress also approved. Again when specific actions are questioned the administration will be the ones called upon to answer those questions.
