Underage Girls Launch Lawsuit Against Prosecution Over Allegedly Lewd Pictures Found On Classmates' Cell Phones
- In 25 yrs of watching the news, it is about time that someone asks some hard questions. Julie I am really impressed with what you did. Keep this up & you will make my hero list. Of course this may have all been scripted, but I'll give you the benifit of the doubt. What law did they break... awesome. Now I wonder how come the same charges are not brought against the airport x-ray photos. Now * Those* are sick porn. But nothing will probably come of it because if blackmail is legal, the sky is the limit for our overlords. :)

- hopscotch23 you said "(And NO, it is not normal behavior, as some folks would have us believe for kids to act like this)".
It is absolutely normal behaviour (maybe not politically or morally correct, but normal just the same), consult an expert any expert you will find they all know and confirm it's normal childhood behaviour.. If you think this is not normal because maybe you never had a similar experience, then perhaps you need to consider you don't fall into the normal category. - Reply to this comment
- I can understand school officials taking phones that are used at the wrong time, but I can say with certainty that they do not have the right to access said confiscated phones. I would have all the teachers , principal school board all up on slander and violation of privacy, using their peer position to gain pictures of adolescents etc. That is 100% illegal anywhere. They took a private situation and made it public, sure there kids names aren't on this news broadcast but im sure a google search will tell us whom it was. If this was my child I would already have filed papers.

- Seams to me Skumanick is getting all excited about charging these teens. Or is it charging the teens thats so exciting to him or getting the files on each case? This guys a joke. Sure its politically incorrect, but even the 28+ teens mentioned here are nothing compared to the number or single or pregnant teen mothers out there. How boout charging them as well, I mean you have proof they got naked for another kid there pregnant. You won't and you can't because its a stupid idea all around, this is an issue for the parents, this Skumanick needs to get a wife, and a life and leave the t weens alone for god's sake, grow up Skumanick.

- If a 13 year old girl agrees to have someone take nude pictures of her than that person is called a child porn producer. If a minor sends nude pictures of herself to an adult than that person is tried for having child porn. I've had naked pictures of teens I don't even know sent to me. Some of these kids just send their pics out to random numbers. Couldn't I be charged with receiving child porn? I say convict a few teens, maybe then they will stop. Why should law abiding adults face criminal charges while the underage causes run free and just get their phones taken away?

- And this is Law gone wacko

- This is ridiculous. It is insane to follow the word of the law and abandon it's spirit. These laws are out there to PROTECT children from being predated upon. New laws are needed to allow such misguided young people to receive education and counseling, rather than treated as sex-criminals. PERIOD.

If you had listened to your teacher instead of watching kiddie-porn, maybe your diction and spelling would not be so atrocious. - Reply to this comment
- I can't think of anything more perverted than school officials and local police "looking for evidence" on kids cell phones. These folks are THE PERVERTS!!! Why are they SO CONCERNED...they want the pix for their own sick gratification! NO ONE ON THE PLANET HAS A MORE, SICK, PERVERTED, SCREWED UP VIEW OF HUMAN SEXUALITY THAN AMERICAN CHRISTIANS!!!! Anything and everything that is truly human they hate and despise. Insisting that that all that is HUMAN is evil and not of their god!!!!

- Hey- dennisall77 ---Ha, ha, ha. You crack me up! I never said I wanted "everyone to abstain from sexual activity, but then they want to prevent sex from being taught in the schools", OR " ALL SEX is immoral... sex is ORIGINAL SIN!"-------So PLEASE DON'T PUT WORDS IN MY MOUTH! I think it SHOULD be taught in schools!
You want me to think?? I think that I am reading what some idiotic people who obviously can't understand what I was trying to say means....and are instead PRE-JUDGING ME , PUTTING WORDS IN MY MOUTH, and PERSONALLY ATTACKING ME (by the way--did you read the TERMS OF SERVICE??--The posting of advertisements, profanity, or personal attacks is prohibited.)
You can have your life----I, like you, am not perfect, and forgive me for caring that anyone in this country grows up with any moral convictions. If you prefer to watch this country fall into a downward spiral--that is your choice, and on the same note, if I prefer to hope that we can go in the other direction, that is mine.
I just hope kids can learn something good from all of this in the end. - Reply to this comment
- Kids will be kids
I don't see where they did anything wrong, that should warrant any government or school Investigation period. Best way to handle this is fire the DA.... I know there is no shortage of real crime to be prosecuted in his district.
As far as the school goes, all party's involved in the confiscation of the phones should also be fired... they had no rights to search those phones, or had probably cause to search the phones, again it was about getting there name in the paper... the following is a quote from the above story "Sexting" Confounds Parents, Educators And Law Enforcement " This is a issue for the parents ...Educators And Law Enforcement have NO reason to be involved Period.... As far as I am concerned it wouldn't make any difference if the girls took nude pictures of them selves ... it's still a family issue this is a plain and simple case of abuse of power by both the schools and The DA office.... And guess what we the tax payers are on the hook for the cost of the investigation..... The cop that took the first report should have arrested the person who took there phones. the charge should have been for invasion of privacy.... It's a sad day in this country when we are more concerned about a teenager standing semi nude in her bra.... when banking and investment crime goes almost completely unchecked.
Every DA office and court calendar in this country is back logged and over booked.... And some Idiot /DA even take?s more then 5 min of taxpayer?s time to even consider this case.
Forget firing the DA, Lets prosecute him for grand theft... I would hate to think about, cost of time and resources his office, has spent on this issue... every time I pick up a newspaper, I read about some city or county or state government that is out money...or that the jails are full Then I see a story like this... words totally fail me. The terms of service, I had to agree to post this comment prevents me from saying, what I would really like to do to the DA?. God bless us all even the DA! One last question did District Attorney George Skumanick Jr, does any one Know if he even finished high school... - Reply to this comment
- Oh, and for the people saying this girl deserves jail time: realize that you're in the minority. Just because the case specifically hits a nerve with your religious beliefs does not mean you have any capacity to fairly apply and prosecute under the law, and neither does this DA apparently. The punishment should not be based on what sets off your emotions. If we punished based on emotion, we would be no better than we were in the medieval times. The fact that we don't, or aren't suppose to do this is what makes America great.

- hey, onlymythoughts.. .you REALLY ought to THINK! THe "moral right" have boxed themselves in with all of their obessesive demand! First they want everyone to abstain from sexual activity, but then they want to prevent sex from being taught in the schools, where they might actually UNDERSTAND what sex about and why they might be crossing some boundaries. These are KIDS for god's sake, and they will push boundaries whenever they can; that is their job while growing up: discover, test, learn. This Puritan atmosphere advocated by so-called "moralists" is ridiculous. Religion is closed minded ("I know everything I need to know from one source - the Bible- please do not tell me ANYTHING ELSE) while science is naturally open minded (Tell me EVERYTHING possible so I can come to a good conclusion.. and then I will test it to see if it actually is true). That is why the right hates all science and ignores studies suggesting abstinance-only does not work and kids need to know more (not to mention evolution! lol). To make laws to punish pedophiles only works if you do not cast such a wide net that you capture relatively innocent behaviors... but to the the religious right ALL SEX is immoral... sex is ORIGINAL SIN! Please, moralists, get a life of your own and leave ours alone. And lawmakers need to stop pandering to the right just to get their votes.

- This is utterly ridiculous, and clearly Megan's law is not worded correctly if this is happening. Convicting a 14 year old for posting naked pictures of herself is as STUPID as charging a couple of 14 year olds with child rape for having sex with one another. Granted nobody at 14 should be having sex, but it just goes to show how this law ends up attacking the kids it was meant to protect.
This reminds me of that case where a 17 year old was convicted of having sex with a minor, who was 15. It was consensual. I think he still ended up getting a year in prison. What the hell? Is this the new fad? Prosecuting kids with sentences meant for predatory adults? The age difference could have been less than 2 years. And meanwhile real child predators are let go. What is wrong with this country? What type of message is the government trying to send here?
The bottom line? The government needs to know when it's an issue for the parents to deal with, and when it's a matter of law. We clearly should not be wasting public resources with a case like this, especially with the recession that they're suppose to be fixing. We can't jail EVERYBODY.
Or maybe that's part of the government economic recovery plan: To jail every single teenager that's taken a nude pic of themselves so we can build jobs by building thousands of new prisons. It's ingenius except for the fact that the whole country will be behind bars. Let's just build a fence around the entire country and call ourselves a prison. How's that? - Reply to this comment
- Sirman--must have hit a nerve. Sorry. And, thank you, I can "think" just fine. Really don't appreciate your saying I should be in prison because I am concerned with the morality of our society right now. Most decent people are concerned. I don't "force my religion" on anybody (and most certainly don't use violence) ....but I will be praying for you.
Oh no, we wouldn't want to "humiliate these kids" by trying to teach them right from wrong and trying to educated them a little bit...because it is not like they humiliated themselves to begin with, is it? Could be why we have 12 and 13 year olds expecting babies right now....no morals, no self respect.
I never said lock them up.....I said "what is the harm in a class?" - Reply to this comment
- Is this what we want? The Office of Public Morality will now decide that you can't take a picture of yourself and send it to a friend IF the OPM decides that it's immoral. Not only immoral but illegal. They decide and, presto, you're guilty on pornography charges. Now you can't get a job, can't rent an apartment because no one wants to rent to or hire a convicted pornographer.
Let's send the 'Morality' police to go live with the Taliban. They'll get along great. - Reply to this comment
- It is rather sad these young girls can't see how trashy such things as this "sexting" makes them seem. When I attended school--yes, a very long time ago---we had this thing call gossip that kept you from flashing your skivvies for all to see. We were aware that if we behaved in a manner that raised eyebrows we would become classified as a class s*** and be ostracized as a result. Nowadays kids seem to think they should be allowed to do whatever they want and not have to suffer for the poor choices they make. While being the object of cruel gossip is not something I advocate it did make us think twice before we did something that would bring into question our reputations. I'm not saying the girls should be prosecuted for this, only that once upon a time there used to be repercussions for the type of behavior they exhibited. (And NO, it is not normal behavior, as some folks would have us believe for kids to act like this)

- onlymythoughts -- "What is so wrong with morals and religion?" Just about everything. Like you, all religions want to force their twisted views on everyone by force of violence. Yes, enacting your stupidity into law is threatening legal violence via incarceration and humiliation.
It's your kind of "thinking" that allows idiots like this DA to do stupid things like charging these girls. Were they using bad judgement? Yes, but that's not a crime. If it were you and the DA would both be in prison. (not a bad idea, really) Was it pornography? Not by anr "reasonable community standard". But "reasonable" is not a factor in the thinking of zealots is it?
Religion is and has been a yoke of oppression upon mankind for far too long. If you are going to share your thoughts, first please make sure you can think. - Reply to this comment
