- So a "freeloader" is someone who can afford the insurance but would rather pay the "penalty or tax" which is cheaper. Hmmm, lets see, $12,000 for a yearly private health insurance plan vs just for the fun of it say a $1200 a year penalty/tax. Wonder how long before everyone becomes a "freeloader". Big government doesn't work!!!

- Is it a tax or a penalty? I have self employment income so I have to pay estimated taxes. If I fail I pay a penalty. This penalty is legal under the tax law but it is a penalty not a tax. If I choose to make my payments I don't pay the penalty. If eligible people who can afford insurance choose to buy it they don't pay the penalty. It is only freeloaders who can afford insurance but don't buy insurance but will still be treated if they get sick or injured that have to pay the penality. Thus one can legitimately argue that it is legal under the tax code but it is a penalty and not a tax.
