- Perhaps it wasn?t the mugging while jogging. Perhaps Justice Souter just missed solid, intelligent conservative company. Souter?s dissent in Bush v. Gore was trite conservative law. Where but in a place standing on its head would traditional common law adherence to precedent, social restraint and political abstinence makes a judge ?liberal??
The Rehnquist majority?s creationism reversed unanimous precedent that every vote must be counted. It is Souter upon whom former Senator Coleman now relies. Coleman is right to rely on Souter. Indeed, so does Franken.
For it was the shameful Rehnquist majority which is the stuff of suppressed tears and laughter in the rest of the Common Law World. The majority conclusions in Bush v. Gore are as toxic to the Rule of Law as Separate but Equal or the peacetime suspension of Habeas Corpus.
No. Souter?s writing stands comfortably on the shelf with Mansfield, MacKay and Warren. Not because any were liberal or conservative. But because they eschewed silly ipse dixit legal creationism. For an eminent bureau chief of a major news bureau to throw a trite personal swipe at David Souter?s back only helps ensure that no thinking conservative who believes in the Rule of Law - like Souter - ever lets his or her name go forward again.

- I wouldn't miss D.C. either. It's hard to imagine a bigger bunch of backstabbers and hypocrites anywhere else. It has nothing to do with beauty, which let me remind you, is in the eye of the beholder. Cherry blossoms 1 or 2 weeks a year and the Smithsonian wouldn't make up for crime, traffic jams, pollution, time wasted in traveling from point A to point B.

- I understand that Souter was mugged once while jogging. That may have affected the way he felt about Washington.
