There is no war on terror. For one thing, no declaration of war was made. And more importantly, a war on "terror" is the stupidest concept ever conjured up by anyone, let alone by the leader of the free world. Just how do you propose that victory over "terror" will look like? When terror declares a cease-fire, armistice, or surrender? When there are no more terrorists ever? When terrorist activities worldwide are down to once a month average?

The fact is, this administration deliberately chose to define a "war on terror" as to leave it open-ended. It is nothing more than a lame excuse for never-ending conflict, unchecked military spending, and indefinite suspension of people''s rights and constitutional laws.

Kennedy, and Scalia to a point, alluded to the principle of "giving room for error" to the executive during exigency. Passing on cert, the court allowed, rightly or not, the president to deal with and emergency as he saw fit during a time of duress.

Kennedy and the majority saw six years as enough time for Cheney and the military to get their $hit 2gether. Scalia and Robert on the other hand feels the imprint of failure of Cheney''s policy in Iraq, specifically and the "war of terrorism" in general. They''ve basically had more than enough time to fvck thingz up and the military hasn''t come up with a good enough tribunal process to deal with GitMo prisoners.

They will be prisoners until DOD can come up with a better plan of trial procedure or Congress can legislate within the bounds of the Constitution. Roberts'' assertion of ''giving more rights to foreign combatants'' doesn''t deal with the failure of the government to meet the burden of state.

Also, Gitmo, the only foreign soil this administration controls, for all intents and purposes, is American soil and has been for over a century, therefore, can not be excluded from judicial review.

Great Writ

Thank God, one of the oldest and most cherished principles of Anglo-Saxon jurisprudence has been reaffirmed: The Great Writ, the Writ of Habeas Corpus which allows a prisoner to challenge his incarceration, to require the authorities to prove in a court of law that their confinement is legal or free them in the alternative. And, McSame, right on the heels of Bush, immediately deplored the ruling. These are the people charged with upholding the Constitution and guarding our freedoms. At the same time they did all they could to hold these prisoners on the basis of allegations alone. Some of these prisoners are only in custody because our government paid informants thousands of dollars to inform on others. The result, many who knew no more about terrorist activities than you or I, were arrested and have been incarcerated for as long as seven years without seeing the inside of a courtroom.

I posted this before but thought it could stand repeating.

Just another episode of the Bush''s reference to the constitution as nothing more than a G*d D*amn piece of paper.
