Affirmative action is needed, when poor folks can't afford to attend high end rich High Schools where education is superior. She had an educational disadvantage an still managed to graduate with Honors. She ain't no dummy......

Folks,

Two surveys of the Court's decisions put the lie to the idea that "judicial activism" is the bailiwick of liberals. One of them, conducted by Yale Law Professor Paul Gewirtz and Yale grad Chad Golder, reviewed Supreme Court rulings from 1994-2005. In this period, the Court either struck down or upheld Congressional statutes (or provisions of those statutes) in 64 cases:

"We found that justices vary widely in their inclination to strike down Congressional laws. Justice Clarence Thomas, appointed by President George H. W. Bush, was the most inclined, voting to invalidate 65.63 percent of those laws; Justice Stephen Breyer, appointed by President Bill Clinton, was the least, voting to invalidate 28.13 percent. The tally for all the justices appears below.

Thomas 65.63%
Kennedy 64.06%
Scalia 56.25%
Rehnquist 46.88%
O?Connor 46.77%
Souter 42.19%
Stevens 39.34%
Ginsburg 39.06%
Breyer 28.13%

One conclusion our data suggests is that those justices often considered more "liberal" - Justices Breyer, Ruth Bader Ginsburg, David Souter and John Paul Stevens - vote least frequently to overturn Congressional statutes, while those often labeled "conservative" vote more frequently to do so. At least by this measure (others are possible, of course), the latter group is the most activist."

Supreme Court Justice Samuel A. Alito, Jr said during his confirmation hearing that 'Irish make better decisions than Americans" which includes all whites, browns, yellows and blacks. Now, how much more racists can you get with that?

The 2012 election is already decided. The country will be such a wreck by the, the Democrats will lose by a landslide.

but lose to who? The Republicans? I sure hope not.

The Libertarians? Alan Greenspan is the poster boy for Libertarians. Libertarian is out.

Somebody better come up with a new party quick, or our next president will be Darth Cheney when the voters are fed up with the Democrats.

Remember how the GOP got in power 8 years ago when the voters got fed up with the Democrats back then? The same thing is going to happen in 2012.

If somebody hasn't stepped up to the plate besides the Libertarians, the Republicans have 2012 in the bag.

Gravypants.... Her support for minorities over caucasions is documented and was over-turned by the existing court. Her opinion that women form 'better' opinions then men is in her own hand. AND...This appointment itself is based soley on race and gender. She was selected only because she is a nominee that the GOP dare not vote against.

you don't know the difference between Appellate Courts and the Supreme Court.

The Supreme Court reviews the decisions of Appelate Courts to make sure they conform to applicable law.

So the Supreme Court is superior to the Appelate Courts.

And the Supreme Court has decided that in 3 out of 5 decisions they reviewed, Sotomayor STINKS as a judge.

It's all the same law in all courts. The Supreme Court reads the same law as the Appelate Courts.

And the Supreme Court found that Sotomayor didn't follow the law in 3 of the 5 of her decisions they reviewed.

That's a 40 on her final exam.

And Obama the failure wants to see Sotomayor the failure on the highest court of our land.
