BUT IT DOES NOT SAY YOU OR ANY OTHER INDIVIDUAL HAS ANY RIGHT TO REQUIRE PRODUCTION OF A BIRTH CERTIFICATE.
The Supreme Court has reserved enforcement of those situations to the government itself and not individuals -- a very short and incomplete definition of standing. - Reply to this comment

If they were to show you the real certificate, you would grab it, rip it to shreds and declare that it never existed. If his Mother had shown you 8mm movies of the birth on the top of Diamondhead you would call her a liar and swear it was done on a soundstage. A conservative organization WDN or WND has reportedly reviewed the original along with factcheck.org. Both pronounced it valid along with the Hawaiian department in charge of that area. - Reply to this comment
- If this is frivolous, Why hasn''''t Obama filed a case against Mr. Berg for Slander? I mean if this were correct, why has not Obama gotten tired and filed against him. And those rights are spelled out in the constitution -- and nowhere in the constitution is there a right for any individual to require the production of another individual''s birth certificate. Legally in law not the constitution for specified purposes organizations and their agents are required to review some documents. - Reply to this comment

The burden of proof rests on the Prosecutor in a criminal case or the plaintiff in a civil case -- this is not the UK as I understand their law from a few articles. - Reply to this comment

Frivolous in this case could be construed to be filing cases where any competent attorney would be expected to KNOW there was no standing for legal action. As Mr Berg continues repeatedly to file even though he has had his day in count and subsequent lost, being further informed of this significant standing issue, and several appellate actions also being rejected. In my non-legal opinion only, the more actions he brings in the same context the more likely his judgment as to the validity of pursuing those actions can be questioned as either harrassing or frivolous. Frivolous is not in a constitutional issue sense but in the actions considered reasonable for an attorney with the legal training and case law including decisions he has directly received in actions already taken. - Reply to this comment
