The President, like the rest of us, is only allowed to use means that are legal.

This administration has shown time and time again that it holds itself to be above the law and above our Constitution as well.

You tell 'em, Bro. Don't forget to define rebellion, Al Qaeda, not being American, cannot be a rebellion. If you believe that Al Qaeda is anything other than a CIA construct, then they are resisting hegemonic control over their own "area", not in the US.

As for invasion, it is the US that is the invading party, exactly the opposite of the situation described in the constitution.

Thank you fellow patriot, but it is not my insight that you are attracted to, it is yours, and the insight of millions of other patriotic Americans. I only verbalize it as best as I can.

Our founding fathers fought and died, and created the government we had before Dictator Bush, because they so loved and believed in individual Americans like you.

They did not create it for the rich, the poor, the beautiful, the ugly, the eloquent, or the illiterate.

As you know fellow citizen, they created it for all of us. And they left it for all of us to protect, or abandon, together.

bluestardad, and all patriotic Americans, please know this. The confidence, assurance, and direction you seek from a leader already exists within yourselves, and our Constitution.

The truth is that a leaders time is most often short.

Finally the court of the U.S. is making a president out of a king. The president and the A.G. has been steping all over the constitution in name of terrorism. Before this ruling any U.S. citizen could be held indefinatly just by the government calling them an enemy combatant. Good for you Judge Motz for up holding the constitution. The AMF law is unconstitutional since it gives the military, police powers out side their military bases not intened in the constitution. I would consider being a member of Al Qaeda should be reason enough to arrest someone but you need proof that were doing or intending on doing illeagal acts. Should congress consider passing a law making it illeagal to be a member of Al Qaeda, guilt by association, therefore can be arrested and charged for seducious acts against the U.S.

Those Judges should read the Constitution. It gives two exceptions to the Right of Habeas Corpus. Rebellion and invasion. If an American going over to Al Queda doesn't fit one of those circumstances, what on earth does?

From wikipedia about the Reichstag fire trial ...

"In July 1933, Marinus van der Lubbe, Ernst Torgler, Georgi Dimitrov, Blagoi Popov, and Vassili Tanev were indicted on charges of setting the Reichstag on fire. The Leipzig Trial took part from September 21 to December 23, 1933, and was presided over by judges from the old German Imperial Court, called the Reichsgericht. The presiding judge was Judge Dr. Wilhelm B|rger of the Fourth Criminal Court of the Fourth Penal Chamber of the Supreme Court[2]. The accused were charged with arson, and attempting to overthrow the government.
The Leipzig Trial was widely publicized and was broadcast on the radio. It was expected the court would find the Communists guilty on all counts and approve the repression and terror exercised by the Nazis against all opposition forces in the country.

Only Van Der Lubbe was found guilty and sentenced to death. You could not be more right. Pro Iraq war people always compare it with WW2. They just fail to grasp the basics: check who was the invader (in chief) in each case ...

Hitler used the Reichstag fire (his 911 if you wish) as a pretext to get the parliament passing (and von Hindenburg signing) an "enabling" act (aka known as "patriot" act nowadays) giving him full powers to protect his people from the "communist conspiracy".
Hitler invaded Bohemia to "protect" german minorities living there. He then invaded Poland, France, etc ...

Another interesting fact which might lead to interesting comparisons: the Reichstag fire trial that the nazis wanted to show that the fire was a deed of the Comintern (from wikipedia) ...

A one man rebellion ?

There are always people committing acts like that. Do you want a permanent elimination of Habeas Corpus ?

You should read the Constitution. Congress decides if and when to suspend Habeas Corpus, not the President. Lincoln was in violation of the clear language of the Constitution when he did it.

That "Rebellion and Invasion" clause is found in the section of the Constitution limiting the powers of Congress.

You want one all powerful individual, the President, making that call ? Then kiss your American rights and liberties goodbye, because the next Julius Caesar will have taken over.

You can discuss the merits or problems with gun control all you want, but it is more important to ask what happens when the "decider" decides to invade your home, kidnap and torture your kids, and put you in jail without trial? Would you use your precious legal gun to resist? Then you are called an "enemy combatant" and therefore have no rights. This is what Bush has created.

Skip the useless bickering and trolling as to who is more right wing than who, it is time we all discuss and take actions to get this nut and his mob out of the white house now. You may be his next target people...

Although I think the tone here is a little childish, I agree with you xz. Because I detest Bush and strongly agree with this habius corpus ruling, you will probably think I am one of thos "liberals." But I strongly agree with you on the second amendment. I believe fully that the founding fathers meant we the people have the right to be armed, and this is a lot of justification for that belief in the writings of those founding fathers, above and beyond the constitution. I get very annoyed at people ignoring the 2nd amendment when defending the other rights and safeguards in the constitution. So liberal I may be, but I do support all of the amendments in the bill of rights! :O)
