She was at the ball field by her choice, she chose to sit where she did, knowing full well she could be hit by an out of control baseball, that little boy can't help the fact that she was stupid enough to sit close enough to be hit. Just another form of being a bully and someone wanting to suck some money from anywhere they can get it. If his parents insurance covers the medical bills then fine, that's the way it should be. But to allow her husband to file in addition to, just shows the sad state we are in. I sincerely hope there is a lawyer in that area that will take this case pro bono for the family, I also hope that the judge throws it out of court and reams their a$$ along with their lawyer for even thinking about it, he should also make their lawyer pay for the parents expenses. Child vs adult, it sounds like this little guy was only doing something he loves to do, at least he wasn't a street thug that came up to rob her and busted her in the face, that would justify something like this. Grow up lady, your an adult you are the responsible one. This is disgusting, I hope mom and dad have a friend with a video camera who would be willing to do some survellience, another that would do some major back ground checks to see what they are really all about. Sounds like a subrogation case to me. The lady was injured and her insurance company is forcing her to recover the cost of her injuries. Once the lawyers get hold of it there is no telling what will happen.
That's possible, since insurance companies don't care how stupid, mean or petty their customers look so long as the company doesn't need to pay them...
It sounds like the parents of the kid might settle just to make it go away. We can't let that happen. There are so many frivolous lawsuits in this country, and many innocent people, companies, schools have to settle because it costs so much to defend themselves. If people are powerful enough to raise $500K for a bus monitor bullied by kids, we should be able to set up much smaller fund so that greedy people and greedy lawyers (if they are working on contingency lesson) learn their lesson. We can put a cap on the fund account so that it doesn't get out of hand like with the bus monitor case. It should be just enough, or nearly enough to cover the standard costs. When the greedy couple backs out, the funds should be distributed back, or transferred to a different noble cause.

Is there any proof the child did it deliberately? I doubt it. Until the law is changed so that those who file and lose a frivolous lawsuit are held liable for the cost of the lawsuit this sort of money fishing will get worse. Being hit by an errant baseball at any game from little league all the way up to the pro players is always a possibility. Get used to it, or don't attend the game.
Those who engage in frivolous lawsuits already can be held responsible with a countersuit, and in a surprising number of cases, plaintiffs win. When a pattern is established, it becomes much harder to claim innocence.
The right to sue, however, is the basic entry point to our system of justice and should not be abridged or limited. Even suits by people who supposedly should realize the danger to which they expose themselves.
How interesting that those who claim the corporation is a person, with right of free speech, never seem to mind when a corporation sues another "person" at the drop of a figurative hat. But let an ordinary citizen do so, it ushers in the decline of civilization, as we know it.

I think this is so stupid she has no proof he did it on purpose i have know matt for years he is a nice funny smart kid that wouldnt hurt a fly she stated that he did go over to her cautiously seeing if she was alright! It sounds like to me like early retirment or vacation time. To think they were friends and now this happens its a shame its called stabbing in the back.The miggz should sue this horrible woman for the pain and suffering they are putting apon this family. They should put shame on the judge for going past the first case. This family shall have shame when they step foot on the Little League feilds. My prayers go out to them. If this was dog who got loose by accident and bit the woman you can BET the owner would be sued and the plaintif would win, even if the owner was 11.
Being an eleven year old doesn't automatically buy you a not guilty verdict, especially in a civil case. If it did, an eleven year old could get away with almost anything, intentional or not. So what are you people presuming? That a person can get away with anything, intentional or not, up to the age of eighteen? Or at what age do you want to cut it off. As soon as the child is no longer cute and cuddly?At one time a child's age could get him off in a criminal case, but that is no longer true. A person is responsible for the hurtful acts of their children just as they are a dog or a pet chimp. If the injured party is faking it, that's just too bad as long as they can get away with it. An injury is an injury, and its effects don't disappear because of the age of the person who injured you. This "shame on people for taking money from an 11 year old kid is MORONIC AND SENILE.

I couldn't believe what I was reading that is why you don't sit to close to an area where there are balls being thrown by children warming up to go play or this just might happen.
