Doesn't matter if the state allows it or not face book has terms and conditions:
You will not use Facebook if you are under 13. You will not use Facebook if you are a convicted sex offender. You will keep your contact information accurate and up-to-date.
So how are they going to use FB if they are a convicted sex offender anywhere? Facebook is a public site and it should allow people to be social with there friends and family, people need that so recidivism is less likely to occure.
When I read about registered sex offenders in the Miami area having to live in the swamps and under bridges because no one is allowed to rent them a place to live, when they are dying of starvation and exposure or some disease associated with cleanliness, I'm convinced that is gruel and unusual punishment. Then I read about some girl falsely accusing a high school football player of rape and he spends 5 years in prison and she only gets "shame on you" I'm convinced that woman should incarcerated for life, since she inadvertently attempted to take that mans life, 5 years in prison is no different than kidnapping, is it?
Even though I know that kids will never do everything they learned at Daddy's knee, I still agree with those who see this as a parental issue and not a legislative one. No law can be written that will compensate for a lack of parenting. Children don't morph overnight into responsible media users. If kids are independently using social media and gaming sites without having been given the tools and knowledge to cope with the potential risks and hazards, especially those related to their own actions, then whom they encounter online is likely to be the least of their parents' problems.
For every registered offender, there are hundreds that are never convicted and therefore never registered. Banning the ones who are registered and complying with the law, will not protect children from the ones who are too sly and cunning to ever get caught.
I am a Sex Offender. convicted in 1986 of assaulting a 24 year old female. When I look back on myself, i see a loser young man addicted to liquor, beer, night clubs, drugs, sex with absolutely zero empathy for another and zero ambition. I do not wish to minimize what I have done. I received 25 years in TDC, of which I did 8 years and 4 months flat time. I spent the last 17 on parole and have completed this 25 years. I understand the need to register some offenders, some guys get out and fall right back in. But In Prison, there is no reform to help right the thinking habits of sex offenders. We have to choose to change our lives, and vow to give back as we have taken away. Jesus was my vessel, he forgave me, then I forgave myself. It was Important to me to come back into society and be as good as I was bad. The restrictions set upon me after I have done the time restrict my ability to give back, to succeed to leave a stronger legacy. The problem isn't Facebook, MySpace and other media outlets.. Ie Malls, Movie theaters, parks, churches you can go on and on. If a person is going to reoffend....they are going to reoffend. Life in prison for the second offense!! Period.....that fixes it. But here....the first offense has to KEEP subject in prison for no less than 6 years... You tend to bury some family members while your inside, I can not tell you how bad that hurts.... The problem is at the judges chamber... They are passing out 5-10 year sentences because they (offender) can afford legal help. With such a non-threatening sentence, no lesson has been learned, they do 3-5 years inside....and they have beat the system.... The other problem is: educating men/women who abuse sex. They don't have a clue!! And then the mistake is made, the fault also lies on society, men and women who see men and women doing things they should not do and then not confronting them (Sandusky)... I have been put in the same barrel with pedophiles and it makes me sick! I am treated as of I did molest a child, I have the same restrictions.. How is this fair? How is this legal? Murderers get off easer. My point is, among criminals, we are individuals and should be treated as such, some of us are trying to be an asset to the community. The lawmakers are just throwing them (laws) up in the air with no thought at all, hoping their "tough on crime" bodes them well on election day!! Also it's the non offenders, the cop In Houston molested his 14 year old been going on for years, the teacher who just won "educator of the year in his district" all the while having sex with a 15 yr old student. The ( Catholic) Priests a few years ago and all the little boys....they got a slap on the wrist and lawmakers turned their heads... I will again apologize for my crimes against this proud nation, I pray my victim has found peace In her life. I can only speak for myself, this crime took place 26 years ago. I am a changed and remorseful man. Humiliation is not the answer for a lot of these offenders, repeat offenders, should get life in prison, 1st offenders should do at least 6 years before being considered for parole. And all offenders should go through some "in your face" counseling, at their own expense. I did for 17 years, and I am a better man for it. Respectfully submitted.
While I am sure that there are people that really need to stay off social networks, and that each case is different, there are people, listed as sex offenders that truely are not a threat (nor were they ever) to anyone. Take for example two teens dating, he 17 she 16. As he turns 18 he is arrested for statutory rape of a minor (his now 17 year old GF soon to be wife). He now has that mantle of sex offender hanging over him even though he may even be married to the supposed victim. Don't say it doesn't happen because it does quite often.
They need to come up with a different label than "sex offender" for someone just dating a person one or two years younger than they are. That is not near the same thing as an adult sexually molesting a little kid!
These are just the sex offenders that people will KNOW about. The scary part is that there's many, many more on social networks everywhere that no one knows about. Ya got to be dilligent with your kids, and don't assume it will never happen to them because that's when something WILL happen.
The problem with this whole issue is about as basic as the problem with justice itself. We do make laws, but only the dumb ones get caught. The most clever and scheming seem to evade capture.
Said another way.....the dumbest s-e-x offenders are the ones fighting for their rights to use social networks.
The matter is easily legislated with a parallel issue that already exists with felon's rights to buy and own a weapon. For social networking, the issue of enforcement is far more difficult.
would think this is an easy fix. parents should not allow their children to use facebook until they are 18. how does anyone know there are no serial killers on facebook? there might be ex-convicts of violent crimes on facebook? how about scam artists? and the list goes on and on. facebook does not guarantee your online safety regardless of your age or gender.
even with parental controls kids always seem to find a way to access sites they shouldn't be on and posting pictures an info that shouldn't be seen by others I think that many parents have lost the battle to control this. And some don't even understand the seriousness of this epidemic
Registered sex offenders maybe should be allowed to use the social networking sites as long as they register their name and any alias's that they might use so they can be monitored. This is a stipulation of their release...to register as a sex offender. If they violate the rules of release, they should go back to prison. A case VERY similar to one I am speaking is a good example of how sex offenders, not monitored properly can run amuck on the internet.
