How about forcing the NBA, NFL, MLB, & NHL to conform to Affirmative Action?? The ratio large talented black men in the NBA is way out of proportion to the number of short Jewish men. This cannot stand! It's obvious that NBA owner are racists toward Jews & other vertically challenged citizens & the US needs to impose an hiring practice that reflects the ethnic diversity of their communities & of America!!

The main point is that..Allow all a fair chance & to the best man (or woman) win. It's been proven countless times that humans have the same capacity for intelligence & performance. (Note the word "capacity") I really don't care if every fire fighter in the nation is black if they are the best & most qualified candidates. Black dudes dominate the NBA, I think it's most likely because of some level of cultural identification but most important is they worked very hard at trying to be the best & they reaped the rewards of that hard work. It should be any different in any other field. If there happens to be racial patterns that are obvious, so be it. Unless you like the idea of the Gov. mandating the Lakers to hire Richard Simmons to play point guard next year!?!?

What we have from the court, in MY OPINION, is an open door to some states to resume what they did decades ago. I don't think the state involved would intentionally slant test or results to benefit Whites but I most certainly do in the State of Mississippi. People like to think these people have progressed so much, I can't see it. Sure they cleaned up a bit and at least now do not promote such things openly, but I see the same signs now as I saw in 1964.

What total bull. Out of 21 federal justices who have ruled on this matter, Sotomayor is in the majority with 11 justices, including four on SOTUS. She may be "wrong," but if so, so are a lot of other federal judges. So what? Decisions get reversed every day.

This is an interesting case, which resulted in a typical 5-4 decision. Those numbers are representative of the five conservtives who frequently team together to expouse thier conservative views. The reversal of Sotomayer's decision by that margin means nothing by itself. Those of you who are claiming the judge is a racist and seem to decry that practice should apply in your personal lives. Racism, has been, and remains, America's Achilles heel.

The racist accusations are absurd to begin with, and then are taken to a grotesque rant. The original ruling, based on how Appellate Courts are required to operate under rule of law, had that court ruled otherwise, then there would've been endless ignorant squawking about Sotamayor being an activist judge, overturning statute. The much more appropriate court to do that is the Supreme Court.

In other words, reversals are part of the job.

It is truly sad that there are those who think that various groups have some kind of "right" to have "representation" on the Supreme Court. If that is what you want - run for office. The court is not a "representation" organization. That Sotomayor is a bigot is beyond rational argument. She clearly is - based on her published views over her entire career. "Racist"? No - because latino is not a race - despite what the fools from La Raza think. We are a society that more and more wants to glorify stupidity, make excuses for failure, promote mediocrity, and try to discourage actual performance and success at any cost. The real cost will be the end of the society if we do not change.

Maybe employers as well as state and local governments will recognize that White people can be discriminated against. This seems to have been a novel concept for many, but last I checked they have the same protection under the law.

I can't see how you can oppose this ruling. Justice was served and it is evidence that Sotomayor is questionable. Her judgement was poor.

In life there are tests and you have to pass them to make the grade. Sometimes results do not follow racial quotas. This result is no more racist then the result that most NBA rosters are predominantly black. The test for the NBA is the tryout. Blacks did better. Whites did better on the firefighter test.

Outcomes are not racist as long as opportunities are equal.

Why do so many of you always seem to think that affirmative action only benefits minorities of a different skin color? Let's try to remember that WHITE women have benefitted more from affirmative action than any other minority group.............

Why? Because it's disingenuous to say otherwise. If you are honest, you will have to admit that affirmative action was not instituted to benefit white women, although white women were smart enough to make use of the opening.

Affirmative action was specifically designed to even the playing field for nonwhites by giving them an unfair advantage. No matter how good intentioned it was, affirmative action was racist and continues to be a failure.

White paternalism creates nonwhite dependency and further cripples a group who has to learn to stand up for themselves.

From what you provided it would be to bed the assertion that no minorities passed the test, in fact 6 minority firefighters and 16 white firefighters passed the test. So the stealth issue really is with the requirements of the city's charter (the rule of three).

Perhaps no others were "promoted ahead" of the white firefighters but they were denied their opportunity for promotion because of their race. How is it their fault that so few minorities passed the test?

afirmative action is just plain wrong. people talk about fairness, what about the more qualified white people who have been passed over and are making less then they have the potential to so a less qualified minority can take a high profile position.
The most qualified should always get the position. If that means it is always a white male getting the position so be it, fair is fair. On the other hand of the minority is the most qualified then they should get the position.
The brightest and best should always win. Stop giving those with lesser qualities an unfair advantage.
