Personally, I hope Sotomayor does get confirmed and I'm generally fairly conservative. I think she will disappoint all those who are counting on her being a flaming liberal. She has a fairly mixed record including pro-life rulings. Generally the Hispanic community is fairly conservative so if she sticks to her roots the libs will get a surprise.

I would point out that the "Soto" means "thicket or bush" in Spanish...mayor means "more". Thus Sotmayor translates to "More Bush"....ironic isnt it?

I have witnessed this mentality too! Another thought is all they need to do is show up and they believe that an xx% of minorities are going to get promoted just so it looks good on paper.

On test like this it is a liability just to promote to maintain some balance whether it is racial or gender. The municipalities would get their butts sued off of someone got hurt or killed and it came out that the person responsible failed the test to be in a position of authority. I know many firefighters and police officers who have taken tests to advance, they are of all colors and those who really wanted it studied what they could to pass, those who did it to try and fill a "quota" spot got disappointed.

Sorry folks, you can be green with purple polka dots or a tranny, as long as you know what the heck you're doing with things get hot I do not care!

Would you go into a burning building knowing your superior did not pass the required tests?? I wouldn't and I could care less what color he or she is.

The main point is that..Allow all a fair chance & to the best man (or woman) win. It's been proven countless times that humans have the same capacity for intelligence & performance. (Note the word "capacity") I really don't care if every fire fighter in the nation is black if they are the best & most qualified candidates. Black dudes dominate the NBA, I think it's most likely because of some level of cultural identification but most important is they worked very hard at trying to be the best & they reaped the rewards of that hard work. It should be any different in any other field. If there happens to be racial patterns that are obvious, so be it. Unless you like the idea of the Gov. mandating the Lakers to hire Richard Simmons to play point guard next year!?!?

This doesn't prove she is a racist. Didn't the other judges also agree? I would want her to explain her decision again, and I don't agree with the original appeal decision, but racist??? But if you can't pass a test to be a fireman, I wouldn't want you to be promoted for being the less qualified person, black, white or whatever. Did the test ask...as a white person...didn't it just ask questions directly related to the position?

Probably, but it will be a nasty fight that will make Obama think twice next time before he appoints another superliberal

In the mean time, this is the death knell to affirmative action. The nation wants a merit system, and anything that gives preference is going to be fought.

This idea of giving minorities a leg-up on city-run jobs is nothing new! Many contracts that city's go out to bid for, are preferentially given to minority-own/operated sub-contractors. In fact sometimes it's actually mandated w/in the contract. I know from personal experience many cities certainly don't court the best or most-qualified person/company for the job; it's pretty much common knowledge if you work in city governments that many ill-qualified minorities are appointed and given opportunities in the name of "affirmative action." It even goes on in medical school - which has even scarier consequences. The best person should always get the job, black white or whatever. You don't do society a favor by putting someone in a job that they're really not ready for.

Divicar YOU have benefited from Racism if you are white and thats all there is to it. Affirmative Action was a Promise we made to blacks coming out of the Civil Rights Conflict. That was NOT the only solution people had to correct the decades and decades of Human Rights abuses and Racism, but it was what was settled on. Looking at it NOW through the rear view mirror it may look unfair to some but let me tell you, given some of the OTHER solutions toss about, it is the least offensive to the Crackers. I, for one, like the idea of Marshal Law and Trials for all those who aided the Terrorist. IF we'd have done that there would be no Republican Party today.

How's that exactly? I'm interested as well. This Woman made a decision based on the Law as she understood it and the Court overturned that decision by ONE vote. Now the fringe right is on here saying she's a racist? Being that I have fought Racist my entire life, I'd like an answer to that as well. How does THIS make her a racist?

"If the test is written in the Queens English, no black applicant could possibly complete it". Now if all of you want to know why I think this decision is a big mistake, I give you exhibit "A"!
