There is no difference. This is exactly what this is - passing a law against who people are.

I wonder how many of the people who are rabidly against gay marriage actually know gay people. Have you ever seen a gay person? Can you actually look at Richard Simmons and Rosie O'Donnell and conclude that people aren't born gay? Are you old enough to know who Liberace was? Freddie Mercury?

Seriously, do you really think that the Village People chose to be THAT gay???

There is no violation of the "equal protection" and due process here at all as it also bans non gays from single sex marrage. Some folks may not like it but thats how the law works.

This is no different than if the citizens of California voted to deny blacks and hispanics the right to vote.

The Constitution guarantees equal protection under the law and no state can create a law that says otherwise.

There is a big difference, Beckie. The difference involves society passing a law against who you are (black, hispanic, etc.) as opposed to what you do (rob, kill, molest, etc.). No one would argue that the former would be discrimination on the part of government. But the latter, defining behaviors necessary for the continuation of a civilized and peaceful society, is absolutely necessary.

Apparently you. There is no other state in the union that more people care (like or dislike)or talk about more about than the state of California. Vermont and Massachusetts pass same-sex unions and no one gives a crap. California votes to ban same-sex unions and everyone gets PO'ed; from liberals that think it violates their civil rights to conservatives that hate California for simply existing.

Because the Constitution of the United States guarantees equal protection under the law. Civil Unions are "separate but equal" - the same concept that was used by other bigots keep blacks out of universities.

And so arises that old cynicism is me at seeing the George Bush and Al Gore label getting attached to the California gay marriage debate.

It has the flavor of the Clarence Darrow and William Jennings Bryant label being attached to the evolution debate.

It will start out with debating the law and turn into debating the bible, while all the while it is about politics and nothing more.

For those who cling to the Inherit the Wind fantasy about the Scopes Monkey Trial, neither Darrow, nor Bryant were actually interested in the subject of evolution. Darrow was the biggest trial lawyer at the time and Bryant the perpetual presidential candidate. Darrow was looking for a case to get him back before the Supreme Court and Bryant back on the ballot.

Neither cared about the innocence or guilt of the accused, as both knew he was innocent because he never taught evolution, he never even taught a science class. It was all a publicity hoax. Which is why the judge in the case would not let them debate evolution in the trial. Which the play unjustly demonizes him for. He knew it was a hoax, he knew the witnesses were lying and he was angry at getting roped into the fraud.

So, here we go again. The two opponents will join together to get the debate before the courts. They will talk about truth and the law and will turn it into a political debate to advance their own political agendas.

Why don't they just change the terminology to "civil union". The word "marriage" evokes strong emotions and polarizes the opposition on both sides. If they would just call it a "civil union" everyone could probably live with that compromise. Are they just stupid not to have thought about it? Duh. And we wonder why our country is in such a mess. Idiots in Congress.
